Chairman Koehler called the meeting to order at 7:04 p.m. S. Skrebutenas was seated for B. Doody and H. Bernier was seated for D. Holley.

Approval of Minutes: Chairman Koehler read aloud the unapproved minutes of November 26, 200l noting that site walks were held on December 8, 2001 at 23 Luke Street, Royal Crest North, Royal Crest South, and Lot 15 Highland Drive as indicated in the minutes. Motion by S. Skrebutenas, seconded by H. Bernier to approve the minutes of November 26, 2001 as amended. Unanimous.

Communications:

  1. Connecticut League of Conservation Voters - 2001 Environmental Scorecard.
  2. Minutes of November 29, 2001 Meeting of the Naugatuck Inland Wetlands Commission, including Public Hearing on Fawn Meadows, 99-Lot Subdivision (Maple Hill & Mulberry).

Old Business:
a. Prospect Sportsdome, LLC, 155 Union City Road. Discussion of this application was moved to later in the meeting.

b. Robert Capanna, 23 Luke Street. Application #03-01, to Create a Pond Within a Regulated Area. This application was accepted at the November 26, 2001 meeting. Chairman Koehler noted that a site walk was held on December 8, 2001. The wetlands were fairly dry at the time and because the depth of the pond is proposed to be about 3 feet, the Commissioners stated they would like to see a fence around the pond. Mr. Capanna questioned the necessity for the fence, noting other ponds in the Town that are not fenced in. Bill Donovan confirmed that there are other ponds in the Town that are not fenced in. Bill further explained that there is a building code that requires an in-ground pool with more than 24" of water in it to be fenced in but there are no regulations regarding standing bodies of water. Generally the embankments of a pond are sloped which provides a more controlled entry. Mr. Capanna agreed to slope the embankments of the pond to the area that would be 3-feet deep. Chairman Koehler stated that he was concerned that there would be an open body of water with no fencing around it and suggested that Gene McCarthy, Assistant Director of Public Works, review the application to be sure that a fence would not be required. Motion by A. Koehler, seconded by S. Skrebutenas to approve Application #03-01, Robert Capanna, to create a pond within a regulated area at 23 Luke Street, with the stipulation that Gene McCarthy review the application to be sure that a fence is not required. Unanimous.

c. & d. Royal Crest Subdivision. Discussed after Item (e) on the agenda.

e. Peter Sydoriak, Bilt-Rite Homes, LLC, Lot 15 Highland Drive. Application for House and Septic System within a Regulated Area. Motion by H. Bernier, seconded by S. Skrebutenas to accept Application #04-01, Bilt-Rite Homes, LLC, for a proposed house and septic system within a regulated area at Lot 15 Highland Drive. Unanimous. Chairman Koehler noted that a site walk was held on December 8, 2001. Dan Hurst of Bilt-Rite Homes, LLC, was agent for Peter Sydoriak. The Commissioners reviewed the site plan map with Mr. Hurst. Chesprocott has approved the site plan map. Fees were paid in the amount of $240.00 and $10.00 based on (2) two regulated activities, a house and septic system within a regulated area. The applicant was instructed to begin cleaning out the debris from the property as soon as possible. Chairman Koehler also asked that a second silt barrier be installed above the stone wall and noted the second silt barrier on the site plan. Motion by A. Koehler, seconded by H. Bernier to approve Application #04-01, Bilt-Rite Homes, LLC, for regulated activities at Lot 15 Highland Drive with an amendment to install a second silt barrier next to the silt barrier noted on "Plot Plan prepared for Peter Sydoriak, Prospect, Connecticut, December 14, 1993 with revision January 3, 1994 per Chesprocott and latest map revision of January 11, 1994." Unanimous. It was noted for the record that Chesprocott approved the site plan map on November 29, 2001.

c. & d. CRT Realty, LLC, Summit Road & Cornerstone Real Estate, Inc., Melissa Lane. Application for Proposed Subdivision with Regulated Activities - Royal Crest North & Royal Crest South. Motion by S. Skrebutenas, seconded by H. Bernier to accept Application #05-01, CRT Realty, LLC, for regulated activities at Royal Crest North Subdivision. Unanimous. Motion by S. Skrebutenas, seconded by H. Bernier to accept Application #06-01, Cornerstone Real Estate, Inc., for regulated activities at Royal Crest South Subdivision. Unanimous. Chairman Koehler noted that a site walk was held on December 8, 200l. Regulated activities at Royal Crest North, Application #05-01, are as follows: Lot 1, (5) regulated activities - filling in of wetlands, house, septic system, stream crossing and level spreader; Lot 4, (1) regulated activity - level spreader; Lot 8, (1) regulated activity - driveway; (3) general regulated activities - road crossing, cul-de-sac and level spreader; Lot 10, (1) regulated activity - septic system; Lot 11, (2) regulated activities - stream crossing and septic system. Total number of regulated activities for Royal Crest North is (13). Fees were set and paid in the amount of $1,760.00 and $10.00. Regulated activities at Royal Crest South, Application #06-01, are as follows: Lot 14, (1) regulated activity - septic system; Lot 12, (1) regulated activity - driveway; Lot 13, (1) regulated activity - driveway/stream crossing; Lot 15, (2) regulated activities - septic system and house. Total number of regulated activities for Royal Crest South is (5). Fees were set and paid in the amount of $675.00 and $10.00. S. Skrebutenas asked if the application should go to a public hearing because of the size and scope of the project. Chairman Koehler stated that, in his opinion, a public hearing may not be necessary. The application will be given to the Town's Reviewing Engineer for comments. David Carson of OCC Design Consortium, LLC, represented both applicants and presented revisions made to the site plan based on comments at the site walk. Bermed swales were created along the rear of Lots 8, 9, 10 and 11. Swales will be along the limits of the disturbance at Lots 9, 10 and 11. At Lot 8, the swale was pushed uphill further and directed to connect with an eroded drainage channel caused by the discharge of the detention basin from the Holley Lane Subdivision. The drainage channel will be rip rapped and directed back into the wetlands area where it originally drained. Mr. Carson also stated that in his opinion a public hearing is not warranted because although there are a great number of regulated activities, there is no significant impact to the wetlands. Chairman Koehler questioned Mr. Carson on the possibility of installing a bridge at the stream crossing. Mr. Carson explained the complexities of a bridge and the disturbances associated with the construction of a bridge versus setting a culvert section by section into the channel with very little disturbance. B. Donovan asked approximately how much of the wetlands would be filled in. Mr. Carson stated that the Overall Development Layout included with the site plan shows approximately 12,000 square feet of disturbance. The only wetlands filling will be 1,800 square feet on Lot 1 and 4,100 square feet at the driveway crossings for Lots 12 & 13. Bill Donovan will see that the Reviewing Engineer receives a copy of the site plan.

a. Prospect Sportsdome, LLC, 155 Union City Road. Application #19-2000 for a Sports Complex with Septic System, Detention Pond and Building within a Regulated Area, and a Stream Crossing and Site Work within a Watercourse and Wetland Area. The public hearing for this application was closed on November 26, 2001. Chairman Koehler related that the many improvements and revisions made to the site plan by the applicant, both prior to and consequent of comments received during the public hearing, satisfies as feasible and prudent alternatives from the original proposal. A Draft Resolution of Approval dated December 10, 2001prepared by Bill Donovan was read aloud. S. Skrebutenas stated his concern with whether the parking lot will be paved at some point and what effect that will have with runoff. Bill Donovan stated that Land Tech had no strong preference one way or the other. In looking at the parking area sub-base, most of the original soils have been scraped away, providing a subsurface fairly close to bedrock. The parking area therefore would be on fairly stable ground. The Commission had also recommended that a gross particle separator be positioned to accept the immediate runoff of the parking area. Any runoff that does occur will initially go into the gross particle separator and then to the detention basin. Consequently, there should be no direct discharge of fines or particles from the parking lot into the downstream wetlands. H. Bernier suggested that Item #3 of the Draft Resolution of Approval should be amended to read, "No equipment or materials including without limitation fill, construction materials, or debris shall be deposited, placed or stored in any wetlands or watercourse on site or where a wetland or watercourse may be adversely impacted." Motion by A. Koehler, seconded by H. Bernier to approve Application #19-2000, Prospect Sportsdome, LLC, for a sports complex with septic system, detention pond and building within a regulated area and a stream crossing and site work within a watercourse and wetland area as outlined by the Draft Resolution of Approval dated December 10, 2001 with amendments. Unanimous.

Public Hearings: None

New Business:
a. Floria & Lon Polverari, (Lot 5) 17 Roy Mountain Road. Application for House and Septic System within a Regulated Area. Floria Polverari submitted the site plan map to the Commission and stated that this lot was approved by the Wetlands Commission as part of the original subdivision approval in 1985. Fees were set and paid in the amount of $240.00 and $10.00 for a house and septic system within a regulated activity. Motion by H. Bernier, seconded by S. Skrebutenas to accept Application #07-01, Floria & Lon Polverari, for regulated activities at Lot 5 Roy Mountain Road as presented. Unanimous. A site walk was set for Saturday, December 15, 2001 at 8:30 a.m. with a rain date of December 16, 2001.

Enforcement Hearings: None

Land Use Inspector's Report: Bill Donovan reported that he has noticed extensive filling in of property located at the Cheshire end of Summit Road and an enforcement letter is probably forthcoming.
