Chairman Arnold Koehler called the meeting to order at 7:03 p.m. Lawerence Gomez was seated for Joseph Piotrowski and Harold Bernier was seated for Brian Doody.

Approval of Minutes: No action taken.

New Business:
a. Peter Conroy, 59 & 61 Summit Road. Application for (2) Houses, Septic System & Driveway in a Regulated Area. Peter Conroy Development Corporation, agent for property owners Nick & Nicolina Bollella, presented the application. Mr. Conroy stated that this project had been approved by the Inland Wetlands Commission in October 1988 and again in May 1993. Copies of the previous approvals were submitted with the application and read aloud by Chairman Koehler. A map drawn by Harry E. Cole & Son, 28 Werking Street, Plantsville, CT, with a revision dated 1993 was also submitted. Mr. Conroy stated that there was a question with Lot 2 because the primary septic location is not within the area shown as being perk-tested for the septic system. Lot 2 was again perked in November 2000 and it was decided to push the house on Lot 2 back about 15-20 feet further from the regulated area. Lot 1 is to remain the same as shown on the original map. Chairman Koehler asked Mr. Conroy to provide the Commission with an updated revised map for the project at the next meeting. A plunge pool is proposed for the beginning of the driveways consisting of a 30" plastic pipe with rip rap on both sides. Storm water discharge will stay with the direction of the current stream. Fees were calculated and paid in the amount of $385.00 and $10.00 based on three regulated actitives. Motion by John Kaufman, seconded by Lawerence Gomez to accept Application # 07-2000 as presented. Unanimous. A site walk was set for Saturday, January 20, 2001 at 8:00 am.

b. J.N.J. Realty, LLC, 97 Waterbury Road. Application for a Car Wash Facility/Quick Lube Center within a Regulated Area. David Carson of OCC Design Consortium, represented the applicant and presented the application. The property was surveyed by Robert Cole and the regulated areas were flagged by Cynthia Rabinowitz. Mr. Carson stated that there are questions as to what the regulated activities actually are. The applicant's soil scientist noted that there are no wetland soils. There is storm water discharge from Route 69 that runs through the property in a drainage ditch. At the rear of the property it becomes a seasonal water course that intersects with a defined watercourse located about 70 feet from the back property line. Mr. Carson stated it was his opinion that the water course running through the property is scoring discharge from the storm water drainage from Route 69. Water is not channeled from the opposite side of Route 69 onto this property and there are no wetlands on the opposite side of Route 69. The applicant is proposing to run a pipe for the storm water drainage from Route 69 along his property line and discharge into a detention basin at the rear of the property approximately 70 feet from the wetlands. Mr. Carson described the proposed Car Wash Facility/ Quick Lube Center for the Commissioners. Fees were set at $170.00 and $10.00 based on regulated activity being the detention basin at the rear of the property. John Kaufman noted for the record that the Commissioners may determine at a site walk that there are other regulated activities which would require additional fees. Motion by Arnold Koehler, seconded by John Kaufman to accept Application #08-2000 with the stipulation that fees calculated for regulated activites may increase if it is determined by the Commissioners at the site walk that there are additional regulated activities involved. Unanimous.
A site walk was scheduled for scheduled for Saturday, January 20, 2001 at 8:45 a.m. Chairman Koehler asked the applicant to schedule the soil scientist to be presented at the site walk if possible. The Commissioners agreed to have Bill Donovan contact the owner of Southbury Car Care, LLC, a facility similar to what the applicant is proposing, and schedule a site visit for the Inland Wetlands Commission to observe the operation.

c. Rossi Corporation, 97 Summit Road. Application for a Logging OPeration within a Regulated Area. Rod Burgess of the Rossi Corporation, agent for property owner Neil Walsh, presented the application for a selective thinning logging operation on approximately 67 acres of Mr. Walsh's property. The property boundaries have been marked with pink flagging and the main skid roads have been identified with blue. The project is expected to last approximately three to four weeks. Regular working hours are from 7:00 a.m. to 7:00 p.m. One intermittent stream will have to be crossed in the area south of Summit Road. Portable bridges will be used. This project is similar to the operations previously approved by the Inland Wetlands Commission on property owned by Rosenfield Enterprises and Robert Capanna. Fees were calculated based on one regulated activity involving 2 acres of property and set at $155.00 and $10.00. Motion by Aronld Koehler, seconded by Harold Bernier to accept Application #09-2000 with the stipulation that application fees of $155.00 and $10.00 be paid to Bill Donovan by January 12, 2001. Unanimous. A site walk was scheduled for Saturday, January 20, 2001 following the schedule site walk at 97 Waterbury Road.

d. Budget Request for 2001-2002 Fiscal Year. The Commissioners discussed the current budgeted line items and agreed to reduce Line Item #6400-04, Maps, to $1,000.00 and increase Line Item #6400-01, Supplies, to $525.00 to allow for the purchase of updated technological tools. Line Item #6400-00, Clerk, will remain at $2,300.00 but it was agreed to increase the Clerk's salary to $115.00 per meeting based on 20 meetings for the year. The total budget request for 2001-2002 will remain at $6,350.00. Motion by Arnold Koehler, seconded by John Kaufman to approve the proposed 2001-2002 Budget Request at $6,350.00 as discussed, including an increase in the clerk's salary to $115.00 per meeting based on an estimated 20 meetings. Unanimous.

Enforcement Hearings: Bill Donovan reported that Mr. Slapikas is starting the project at the corner of Union City Road and Dorothy Avenue and he will be monitoring it closely.

Land Use Inspector's Report: Bill Donovan stated that the major subdivisions in Town are winding down. There are some problems at Tradition Estates with stabilization that Bill is following.

Public Participation: Donna Marlak, 8 Maria Hotchkiss Road, Sherri Cocchiola, 10 Maple Drive, Mike Dreher, 2 Stonefield Drive, and Jane Folwer, Maria Hotchkiss Road, all expressed their concerns on the evironmental impact the proposed car wash would have: Pollution of the Waterbury Reservoir; asphalt runoff of oil and gaseline leaking from vehicles outside of the car wash and the effects on residential wells; wax and polishes used in the detail area being contained; proper maintenance of the filtration systems; exhaust fumes from several idling vehicles, and soil erosion from the asphalt runoff were the major concerns stated. Bill Donovan mentioned to the members of the public that their concerns could, individually or collectively, be put in the form of a letter to be read into the record by the Chairman. Bill also suggested to the Commissioners that Land Tech Engineers should be hired to do an envirnonmental review on behalf of the Town for the proposed car wash facility. The Commissioners agreed.

Motion by Lawrence Gomez, seconded by Harold Bernier to adjourn at 9:16 p.m. Unanimous.
