Chairman Koehler called the meeting to order at 7:16 p.m. Steve Skrebutenas was seated for Lawrence Gomez.

Approval of Minutes: Minutes of the May 14, 2001 meeting were mailed to the Commissioners prior to the meeting for review. Motion by Steve Skrebutenas, seconded by Brain Doody to approve the minutes of the May 14, 2001 meetings as presented. Unanimous.

Communications:

  1. Memo from Jennifer Sills, Esq., of Carmody & Torrance dated May 18, 2001 re: Feasible & Prudent Alternatives.
  2. Copy of a letter of resignation from Enver Kaba received by the Prospect Town Clerk on June 6, 2001.
  3. Publication from Connecticut Association of Conservation and Inland Wetlands Commissions, Inc. - The Habitat, Spring 2001.
  4. Quinnipiac River Watershed Partnership Report - Preliminary Assessment of Water Withdrawals & Stream Flows in the Quinnipiac River Watershed.

Old Business:
a. Diversified Builders, Lot 14 Brookshire Drive. Application #14-2000 for a SingleFamily Home and Septic in a Regulated Area. Discussion on this application was held after the public hearing.

b. David Michalowski, 90 Summit Road. Application #15-2000 for a Septic System in a Regulated Area. This application was accepted at the May 14, 2001 meeting. A site walk was held on June 5, 2001. Chairman Koehler stated that he didn't see any problems with this application but indicated that there are wood chips piled in the wetlands area that have to be removed. David Holley recommended that rip rap be put in the area where the curtain drains discharge. A rip rap pool was added on the map and initialed by the applicant. Motion by Brian Doody, seconded by David Holley to approve Application #15-2000, David Michalowski, for a septic system within a regulated area as shown on a map prepared by Land-Data Engineers dated April 11, 2001 with revision date of May 8, 2001 with a modification to put a rip rap pool at the curtain drain outlet and a stipulation that the wood chips be removed from the wetland area. The motion was approved 4 - 0 with John Kaufman abstaining.

c. Pete Conroy, 59 & 61 Summit Road. Application #16-2000 for a Single Family Home, Septic System and Driveway in a Regulated Area. This application was accepted at the May 14, 2001 meeting. A site walk was held on June 5, 2001. Paul Bunevich of Land-Data Engineers presented updated maps showing the final proposed location of the house and septic system on Lot 2 as requested by the Commissioners at the previous meeting. David Holley questioned whether the existing 30" pipe at the base of the driveway on Lot 2 would handle runoff once the applicant removes the debris from the watercourse. The Commissioners asked the applicant to provide stormwater calculations at the next meeting to ensure that the 30" pipe is sufficient.

d. Donald Oldakowski, 7 Spring Road & 173 Union City Road. Application #17-2000 for a Single Family Home, Septic System and Driveway in a Regulated Area. This application was accepted at the May 14, 2001 meeting. A site walk was held on June 5, 2001. Paul Bunevich of Land-Data Engineers presented a copy of a letter dated May 23, 2001 notifying the Borough of Naugatuck of this application. No reply has been received. John Kaufman stated that he would like to see a more detailed map showing how close the regulated activities are to the Indian Field Well Field public water supply. He would like to see more detail depicting the wetlands and the flow of water. Mr. Bunevich stated that he would have a more detailed map available for the next meeting.

Public Hearing:
a. J.N.J. Realty, LLC, 97 Waterbury Road. Application #12-2000 for a Car Wash/Quick Lube Facility. This public hearing was continued from May 14th and was opened for the evening at 8:00 p.m. Chairman Koehler read the notice of the continued hearing as it appeared in the Waterbury Republican American. Also read into the record was a letter dated June 11, 2001 from Robert Oley, PE, Land-Tech Consultants, Inc., a memo dated May 18, 2001 from Attorney Jennifer Sills, of Carmody & Torrance and a letter dated June 11, 2001 from David Carson, OCC Design Consortium, LLC. Attorney Edward Fitzpatrick representing the applicant, submitted copies of the surfactants and detergents that might be used at the proposed facilities and commented on the correspondence read into the record by Chairman Koehler. David Carson, OCC Design Consortium detailed changes that have been made to the proposed facility to address the concerns of the public. Mark DiTommasso and Brian Millerton of Worldwide Water Works explained how the reclaim system works and answered questions from the Commissioners and the public. The public was invited to comment. Ed Scarpati, Bayberry Drive, and Bob Doyon, 2 Forestridge Road, spoke in favor of the proposed facility. Mike Dreher, 2 Stonefield Drive, read a letter dated June 11, 2001 from Donald Ballou, PE, commenting on Land-Tech Consultants review letter dated June 11, 2001. Mr. Dreher also commented on Land-Tech's review letter as well as detention basin concerns. Mr. Dreher stated that he feels that the applicant has not properly assessed what's coming onto the property, what's on the property and what happens when it leaves the property. Barry Lane residents stated their opposition to the proposal citing concerns for residential wells in the area. Sigrun Gadwah, Carya Ecological Services, representing the Concerned Prospect Citizens, stated that there are alternative commercial ventures that would not generate such a high intensity of land use and that it is essential that calculations be done properly. Ms. Gadwah reviewed the regulations regarding grounds for decisions and stated that this site is not suitable for the proposed facility. Attorney Fitzpatrick summarized by stating that the site for the proposed car wash has been malfunctioning for years and the proposed facility will improve the situation. Attorney Fitzpatrick further stated that this use has been unanimously approved by the Planning & Zoning Commission in a C-G zone. Bill Donovan suggested that the Commissioners determine the number of regulated activities associated with this application prior to closing the public hearing. The Commissioners agreed that the intermittent watercourse does not meet the criteria for a regulated watercourse and therefore there is only one regulated activity associated with this application. The public hearing was closed at 9:54 p.m.

The meeting recessed for 5 minutes.

Old Business:

A site walk was held on June 5, 2001. Chairman Koehler stated that there's a wood chip pile in the wetlands that has to be cleared. Jim Kulpa, Milone & MacBroom presented a revised map with Chesprocott approval. David Holley suggested that the lower end of the driveway should be stabilized. Mr. Kulpa indicated on the map to add a 10' x 12' wide area of 1 ¼" crushed stone to encourage groundwater flow and extend 2' below the pavement with filter fabric cover for stabilization of the driveway. Motion by Brian Doody, seconded by Steven Skrebutenas to approve application #14-2000, Diversified Builders, for a single family home and septic system within a regulated area as shown on map prepared by Milone & MacBroom, Inc., dated 4/9/01 with latest revision dated 5/9/01 with a recommendation noted to add crushed stone at the base of the driveway and a stipulation that the debris and wood chips be removed from the regulated area. Unanimous.

New Business:
a. Mike McAllen, Lot 5 Hughes Court. Application for a Single Family Home and Septic within a Regulated Area. Jim Kulpa of Milone & MacBroom represented the applicant and presented an application for a single family home and septic within a regulated area. The Commissioners determined that the septic system is the only regulated activity as the proposed home is 80 feet from the wetlands. Mr. Kulpa will submit a new check to Bill Donovan for the correct fee of $144.50. Motion by David Holley, seconded by Steven Skrebutenas to accept Application #18-2000, Mike McAllen, Lot 5 Hughes Court, for a septic system within a regulated area. Unanimous.

Enforcement Hearings: None

Land Use Inspector's Report: Discussion was held on fees charged to applicants on individual lots previously approved under the original subdivision. The Commissioners agreed that fees are calculated on a case by case basis.

Public Participation: None

Motion by David Holley, seconded by Steven Skrebutenas to adjourn at10:37 p.m. Unanimous.
