Chairman Koehler called the meeting to order at 7:04 p.m. Harold Bernier was seated for
David Holley.
Approval of Minutes: Chairman Koehler read the unapproved minutes of the September 10, 2001
meeting. Motion by H. Bernier, seconded by J. Kaufman to approve the minutes of the September
10, 2001 meeting as presented. Unanimous.
Communications:
- Connecticut Association of Conservation and Inland Wetlands Commission, Inc.-Summer 2001

- State of Connecticut, Department of Environmental Protection-Prepaid registration and
information on Segment III of the 2001 Municipal Inland Wetland Commissioners Training
Program.

and Watershed Land Acquisition Grant Program.
- Letter from Kollcinaku, LLC, 22 Union City Road regarding nuisance complaint and possible
oil spill at the Prospect Service Center and Towing, 20 Union City Road.
- Enforcement letter from William Donovan, Land Use Inspector to Louis Dimuzio, 52 & 66 New
Haven Road regarding filling of wetlands without a permit.
Old Business:
a. Thomas Battiste, 38 Industrial Road. Discharge of Storm Water Drainage from Self-Storage
Facility and Site Grading within Regulated Area. Terry Meyers of Meyers Associates, P.C.,
represented the applicant. Chairman Koehler stated a Site Walk at this location scheduled for September
18th at 6:00 p.m. did take place. Mr. Meyers restated the purpose of the plunge pool and
riprap located within a regulated area is to dissipate energy from storm water runoff before
draining into wetlands. Existing large boulders below the riprap will further help to reduce
water velocity and protect wetlands. The total area draining to the proposed drainage outlet
is 0.99 acre of impervious surface and 0.60 acre of non-impervious surface. No permanent office
is planned to be on site and no septic system or sanitary facility is proposed. Motion by J.
Kaufman, seconded by H. Bernier to approve Application #02-01, Thomas Battiste, 38 Industrial
Road for two regulated activities involving storm water discharge and site grading as shown
on drawing entitled "Site Plan for Proposed Self-Storage Facility, prepared for Thomas
Battiste, Prospect Industrial Center Road, Prospect, Connecticut" prepared by Meyers
Associates P.C. 60 Linden Street, Waterbury, CT 06702 with latest revision date of 9-10-01.
Unanimous. It was further mentioned that any proposed added buildings, expanded paving or
grade changes that impact or require modifications to the proposed drainage system or fall
within a regulated area will require a new Inland Wetlands permit.
Public Hearings:
a. Prospect Sportsdome, LLC, 155 Union City Road. Application #19-2000 for a Sports Complex
with Septic, Detention Pond and Building within a Regulated Area and a Stream Crossing and Site
Work within a Watercourse and Wetland Area. The Public Hearing was continued from the September 10th
meeting and began at 7:30 p.m. Henry Berberat of Tesco Rentals, LLC as property owner spoke
on behalf of the applicant. Mr. Berberat stated that the applicant's engineer recently received
a copy of the Town's engineering review of this project and has not had sufficient time to
respond to all the comments mentioned in that review. Accordingly, the applicant is requesting
the Public Hearing be carried over to the next meeting scheduled for October 22nd at which time
a revised Site Plan would be submitted addressing the Town Engineer's review, Chesprocott Health
District requirements for the septic system and other revisions or improvements as feasible. The
Commission urged Mr. Berberat to have the applicant's engineer contact Land-Tech Consultants as
the reviewing engineer for this project to discuss with them their review and comments and also
to allow Land-Tech Consultants sufficient time to review and comment on the revised plan before
October 22nd. Chairman Koehler further added that all required erosion and sediment controls
must be installed and maintained. The public was invited to speak. Beryl Montville, 165 Union
City Road has concerns that the existing R.O.W. to the building site be restored and stabilized.
Peter Montville, 165 Union City Road questioned whether a special meeting was being scheduled
for October 8th on this application. Chairman Koehler related no additional meeting has been
scheduled. There were no other comments from the public. H. Bernier queried whether the revised
septic plan would keep the system 50' from wetlands. B. Donovan related that the septic system
would have to meet the minimum separating distances from wetlands and watercourses as required
in the Health Code. Chairman Koehler continued the Public Hearing to October 22nd at 7:30 p.m.
Enforcement Hearings: Bill Donovan read a letter sent to Louis Dimuzio, 52 and 66 New Haven
Road regarding filling in of an inland wetland area without first obtaining the necessary
permit. The letter requires Mr. Dimuzio submit an Inland Wetlands application for the work
completed within a regulated area and also appear at the next scheduled meeting to discuss
this matter.
Land Use Inspector's Report: B. Donovan mentioned a letter Mayor Chatfield received regarding
a possible oil spill at the Prospect Service Center, 20 Union City Road. Bill and the Fire
Marshall will investigate. Bill also mentioned that thus far, Yankee Gas has been very good
in installing and maintaining silt fencing along Routes 68 and 69 adjacent to those areas
identified as a wetland or watercourse. J. Kaufman asked Bill on the status of the College
Farms subdivision. Bill related that the Site Improvement bond was recently released on that
project and the Town is finalizing ownership of the fire pond located at the intersection of
Straitsville Road and Cambridge Drive. Final clearing of watercourse check dams remains to be
done by the developers.
