Chairman Koehler called the meeting to order at 7:05 p.m.

Approval of Minutes: Chairman Koehler read aloud the unapproved minutes of March 11, 2002. Motion by D. Holley, seconded by B. Doody to approve the minutes of March 11, 2002 as amended. Unanimous.

Communications:

  1. Invoice #96564 from Land-Tech Consultants, Inc., for Professional Services through February 28, 2002 re: Summit Road.

Old Business:
a. Town of Prospect, 36 Center Street. Application #13-01 for an Ice-Skating Rink and Skate Board Park Within a Regulated Area. A site walk was held on March 23, 2002. Chairman Koehler read a letter from Mayor Robert Chatfield stating that Bill Donovan would represent the Town of Prospect for this application. The Commissioners reviewed the site plan with Bill Donovan. Bill stated that there didn't seem to be any direct impact on the wetlands. B. Doody stated there's an 8" pipe that drains behind the Senior Center that should be directed into the westerly side plunge pool of the skating rink before it discharges to the wetlands. Tony Augelli, 106 Clark Hill Road, stated his opposition to relocating the ice skating rink from Hotchkiss Field to Center Street. Mr. Augelli also asked why clearing of the property was taking place prior to site plan approval. Mark Chevrier of Colonial Irrigation stated that his company installed the watering system at Hotchkiss Field and the damage sustained to the watering system showed that it was not feasible to continue using Hotchkiss Field for ice skating. D. Holley stated that he didn't see any direct impact on the wetlands with this plan. Motion by B. Doody, seconded by D. Holley to approve Application #13-01, Town of Prospect, for an ice skating rink and skateboard park within a regulated area as shown on site plan prepared by William F. Orsine & Associates dated March 4, 2002 with the stipulation that the existing 8" pipe outletting behind the Senior Center be directed into the westerly side plunge pool. Unanimous.

New Business:
a. Lorraine Corsino, 250 Straitsville Road. Application for a Driveway within a Regulated Area. There was no application presented for this item.

b. Jean Reilly, 179 Union City Road. Application to Construct a Pole Barn within a Regulated Area. Jean Reilly presented a site plan for a 32' x 40' pole barn for the storage of her husband's boats and yard & garden equipment. There are (2) existing sheds on the property that will be taken down if this barn is approved. Mrs. Reilly stated they would like to construct the pole barn in order to clean up the area. Fees were set and paid for one regulated activity in the amount of $146.50 and $10.00. Motion by B. Doody, seconded by D. Holley to accept Application #14-01, Jean Reilly, 179 Union City Road, for construction of a pole barn within a regulated area. Unanimous. A site walk was scheduled for Saturday, April 27, 2002 at 8:30 a.m.

c. Mark & Joan Chevrier, 215 Cheshire Road. Application for a Proposed Garden Center within a Regulated Area. Mark Chevrier presented the application for a proposed garden center on property located near the Town Garage. Wetlands surround the property on three sides. A soil scientist has flagged the wetlands and Mr. Chevrier has begun clearing debris from the property. Silt fencing has been installed. Proposed activity is approximately 20 feet from the wetlands. Mr. Chevrier is proposing a temporary office trailer, a greenhouse for growing flowers and natural wood enclosures to contain the mulch piles. The area where shrubs and flowers are kept will be mulched and there will be no storing of pesticides or insecticides. Processed stone will be used for the parking area. Fees were set and paid for one regulated activity in the amount of $140.00 and $10.00. Motion by D. Holley, seconded by B. Doody to accept Application #15-01, Mark & Joan Chevrier, for a proposed garden center within a regulated area for property located at 215 Cheshire Road. Unanimous. No well or septic system is being proposed at this time. A site visit was scheduled for Saturday, April 13, 2002 at 8:30 a.m.

d. Mark Guastaferri, 36 Union City Road. Application for a Proposed Nursery within a Regulated Area. A previous application for regulated activities on this property has expired. Mr. Guastaferri of Paulmar Associates, LP, submitted a site plan for a nursery and reviewed the application with the Commission. B. Doody asked whether cement blocks near Route 68 would be moved back away from the road. Mr. Guastaferri stated he would landscape around the blocks to soften the appearance. Mr. Guastaferri stated he was not aware that the Wetlands permit had expired and stated that the regulated activities are basically finished. The parking area still needs to be stabilized. B. Doody noted that the site plan entails three parcels of property. Chairman Koehler read a letter dated April 3, 2002 sent to Mr. Guastaferri advising that a new application must be made to the Inland Wetlands Commission for the regulated activities taking place on this property. Fees were set and paid for one regulated activity for work being done at the rear of the property in the amount of $140.00 and $10.00. Motion by B. Doody, seconded by D. Holley to accept Application #16-01, Paulmar Associates, LP, for a proposed nursery within a regulated area for property located at 36 Union City Road. Unanimous. A site walk was scheduled for Thursday, April 11, 2002 at 6:00 p.m.

e. Richard Gruszka, 192 Straitsville Road. Application for a New Garage within a Regulated Area. Richard Gruszka presented the application for an attached garage for property at 192 Straitsville Road. Mr. Gruszka is currently before the Zoning Board of Appeals for a variance on a setback. The corner of the proposed garage is approximately 15 feet from a watercourse. Mr. Gruszka is notifying the Connecticut Water Company. Fees were set and paid for one regulated activity in the amount of $170.00 and $10.00. Motion by B. Doody, seconded by D. Holley to accept Application #17-01, Richard Gruszka, for an attached garage within a regulated area for property located at 192 Straitsville Road. Unanimous. A site walk was scheduled for Thursday, April 11, 2002 at 6:30 p.m.

Land Use Inspector's Report: Bill Donovan stated that the Town Attorney could be available for a workshop with the Inland Wetland Commissioners on May 9, 2002. Bill needs confirmation on which of the Commissioners would attend. Bill stated that he has a copy of the 2002 Connecticut Guidelines for Soil Erosion and Sediment Control published by the Connecticut Council on Soil & Water Conservation in cooperation with the Connecticut Department of Environmental Protection. This publication will used as a reference for future Inland Wetlands applications.

Motion by D. Holley, seconded by B. Doody to pay the invoice for Land-Tech Consultants, Inc., dated February 28, 2002 in the amount of $2,052.00.
