Chairman Koehler called the meeting to order at 7:03 p.m. S. Skrebutenas was seated for D. Holley and H. Bernier was seated for L. Gomez.
Approval of Minutes: The Commissioners reveiwed the unapproved minutes of December 10, 2001. Bill Donovan noted changes in regulated activities for Royal Crest North and Royal Crest South. Motion by S. Skrebutenas, seconded by H. Bernier to approve the minutes of December 10, 2001 as amended. Motion carried, 3-0 with J. Kaufman and B. Doody abstaining. Chairman Koehler read aloud the unapproved minutes of January 28, 2002 noting that a site walk was held on February 9, 2002 at 174 Summit Road as indicated in the minutes. Motion by B. Doody, seconded by H. Bernier to approve the minutes of January 28, 2002 as presented. Motion carried, 3-0 with J. Kaufman and S. Skrutenas abstaining.
Communications:
b.CRT Really, LLC, Royal Crest North Subdivision. Application #05-01 for a proposed Subdivision with Regulated Activities - Summit Road. David Carson, OCC Design Consortium, submitted a revised site plan explaining that separate applications were submitted and approved for Lot 1, Lots 12 & 13, and Lots 14 & 15 and consequently those lots have been eliminated from the original site plan for Royal Crest North. The revised plan also details a special level spreader for Lot 4 and a final sheet was added with all of the septic testing information. Mr. Carson verified that there would be a concrete curb that will run the entire top length of the level spreader at Lot 4. Chairman Koehler and Mr. Carson reviewed the changes made to the original application with S. Skrebutenas and J. Kaufman. J. Kaufman stated his concern with preserving a natural environment for wildlife in the area of Lot 7 and asked if there was some way to designate it as a conservation area. Mr. Carson noted that the driveway for the exisiting home at 50 Summit Road is being relocated over Lot 7. Mr. Carson also stated that the entire area is a regulated area and therefore any future activity would need approval from the Wetlands Commission. Chairman Koehler stated that conservation tags could be placed on the trees along the wetlands boundaries as well. Motion by B. Doody, seconded by H. Bernier to approve Application #05-01, CRT Realty, LLC, as submitted on site plan map for Royal Crest North Reference Parcel No. 2-11 with access off Summit Road dated 10/15/01, with revision date 2/25/02 prepared by OCC Design Consortium, LLC, with the stipulation that trees be marked with conservation tags every 50 feet along the watercourse at Lot 7 and the (2) stream courses at Lot 11. Land Use Inspector's Report: Bill Donovan stated that the Town Attorney would be conducting an informal workshop regarding legal issues on April 24, 2002 at 7:00 p.m. at the Town Hall for Inland Wetlands, Zoning Board of Appeals, and Planning & Zoning Commissioners. Bill reported that as a result of the site walk held at 174 Summit Road, the Commission instructed Mr. Cocchiola to remove all materials deposited within 50 feet of the defined watercourse, including grinding of the large pile of stumps. Bill stated that the cleanup has not been started. J. Kaufman felt that at the site walk Mr. Cocchiola understood the necessity to begin corrective measures as soon as possible and Mr. Cocchiola seemed willing to cooperate. The Commissioners decided to hold a second site visit on March 9, 2002 at 9:00 a.m. to see what progress has been made.
