January 14, 2002

Chairman Koehler called the meeting to order at 7:03 p.m. H. Bernier was seated for J. Kaufman.

Approval of Minutes: No action was taken on the minutes of the December 10, 2001 meeting because there wasn't a quorm present of those who attended that meeting.

Communications:

  1. Letter dated December 26, 2001 to the Connecticut Department of Environment Protection from Mayor Chatfield and William Donovan re: Cleanup of Pond at the Intersection of 181 Union City Road and Spring Road.
  2. Letter from the Office of the Mayor re: 2002-2003 Annual Buget Request.
  3. University of Connecticut Cooperative Extension System - Education Presentations on Natural Resource Based Planning for Watersheds, Conducting a Community Resource Inventory & Economic Development Planning.
  4. Notice of Operating for Director, Inland Wetlands & Watercourse Agency for the Town of Greenwich.
  5. Connecticut Wildlife Publication - November/December 2001.
  6. The Nature Conservancy, Connecticut Chapter - Annual Report 2001.

New Business:
a. Vincent M. Jacovino, 21 Trotters Way. Application for a Detached Building within a Regulated Area. Mr. Jacovino presented the application for a detached garage for storage of antique cars. B. Doody noted that a variance is required because the proposed detached building is in front of the exisiting house. Mr. Jacovino stated that he would be presenting an application to the Zoning Board of Appeals. Fees were set and paid in the amount of $155.00 and $10.00 for one regulated activity. Motion by B. Doody, seconded by D. Holley to accept Application #08-01, Vincent Jacovino, for a detached garage within a regulated area at 21 Trotters Way as presented. Unanimous. A site walk was set for Saturday, January 19, 2002 at 8:30 a.m.

Old Business:
a. Floria & Lon Polverari, (Lot 5) 17 Roy Mountain Road. Application #07-01 for House and Septic System within a Regulated Area. Chairman Koehler stated that a site walk was held on Saturday, December 15, 2001. It was noted that the corner of the proposed house was almost right at the wetland boundary. There was a question as to whether there was an on-site existing curtain drain that the footing drains for the proposed house could connect to it. Bill Donovan had questioned Gene McCarthy, Assistant Director of Public Works, who stated that there is a drainage pipe. The Commissioners, however, could not find the drainage pipe at the site walk. Mrs. Polverari stated that she would downsize the proposed house and shift it away from the wetlands as much as possible. Chairman Koehler requested that the revisions be made on the site plan map, have Chesprocott approve the changes and have the four corners of the proposed house re-staked.

b. & c. CRT Realty, LLC, Summit Road & Cornerstone Real Estate, Inc., Melissa Lane. Application for Proposed Subdivision with Regulated Activies - Royal Crest North & Royal Crest South. Chairman Koehler read aloud a letter dated January 10, 2002 from Land-Tech Consultants, Inc., regarding Land-Tech's review. Mr. Carson reviewed the comments and described revisions made based on Land-Tech's review. An additional spring was noted by Land-Tech that had not been detected previously. An additional $100.00 was received from CRT Realty for this additional regulated activity. Discussion was held on Item #3 under Inland Wetlands and Watercourses regarding whether an application needs to be filed with the U.S. Army Corps of Engineers for a Category II Programmatic General Permit to permit wetland filling. Mr. Carson stated his opinion that such application is not warranted because the two applications before the Inland Wetlands Commission are for two separate subdivisions. Mr. Carson explained that although Lot 1 (Royal Crest North) is shown as part of the total project, it is already an approved lot and not part of this subdivision. The same is true for Lots 14 & 15 (Royal Crest South). As such, Mr. Carson stated that neither applications exceeds 5,000 square feet of wetlands disturbance. B. Doody asked whether separate applications should be submitted for Lot 1 (Royal Crest North) and Lots 14 & 15 meeting in order to present a clearer picture of the complete project.

Public Participation: Steve Pelletier, 66 Summit Road, stated his concerns with storm water drainage associated with the proposal on Summit Road as his property boarders the proposed subdisivion.

Land Use Inspector's Report: Bill Donovan explained the letter written to the Connecticut Department of Environmental Protection regarding cleanup of roofing materials in the pond at the intersection of Union City Road and Spring Road.

A brief discussion was held on the proposed Inland Wetlands Commission budget for 2002-2003. The proposed budget will be voted on at the January 28, 2002 meeting.

Motion by D. Holley, seconded by B. Doody to adjourn at 8:55 p.m. Unanimous.
