October 28, 2002

Chairman Koehler called the meeting to order at 7:00 p.m. No alternates were seated.

Approval of Minutes: Chairman Koehler read aloud the Unapproved Minutes of the September 23, 2002 meeting. Motion by D. Holley, seconded by B. Doody to approve the minutes of the September 23, 2002 meeting as presented. A. Koehler, D. Holley & B. Doody voted to approve; J. Kaufman abstained. Motion to approve carried.

Old Business:

a.) Paulmar Associates, LP, 36 Union City Road. Resubmittal of prior application for a proposed nursery with activities within a regulated area. Mark Guastaferri submitted a revised site plan showing existing on-site conditions and location of a proposed catch basin with detail drawing. J. Kaufman questioned whether the number of bins shown on the site plan in the stockpile area should be four - rather than the three bins indicated. Mr. Guastaferri acknowledged there are four separate bins, but they are contained within the same area of the three bins detailed. B. Doody asked that the existing pile of loam and other materials be relocated to the rear of the building to reduce the potential of direct sedimentation getting into the drainage swale and reduce the potential of future intrusion into wetlands. Motion by J. Kaufman, seconded by D. Holley to accept Application #12-02 of Paulmar Associates, LP, for regulated activities at 36, 38 & 40 Union City Road. Unanimous. Motion by A. Koehler, seconded by B. Doody to approve Application #12-02 of Paulmar Associates, LP for regulated activities at 36, 38 & 40 Union City Road as shown on "Wetlands Delineation Plan" prepared for: American General Investors, Inc., P.O. Box 7055, Prospect, CT 06712 by ASW Consulting Group, LLC, 329 Main Street, Suite 203, Wallingford, CT 06492-0495 dated August 4, 2002 with latest revision date of October 17, 2002 with the stipulations that the existing loam pile located in the southwest portion of the stockpile area be relocated northerly of the stockpile area and no other outside storage of materials be located forward of the building/store area. Additionally, the proposed catch basin is to be installed by the end of this calendar year and a berm covered over with woodchips is to be created and maintained along the southerly boundary of the stockpile area as a permanent barrier against runoff into the drainage swale. Unanimous.

New Business: Motion by D. Holley, seconded by B. Doody to add Eagle Auto Body, Inc. (Peter Scionti), 128 Union City Road, Prospect under "New Business". Unanimous.

a.) Eagle Auto Body, Inc., 128 Union City Road. Mitigation of 700 S.F. +/_ of disturbed wetlands. Mr. Scionti was not in attendance. Bill Donovan explained that this application is in part a response to a previous DEP enforcement action involving site contamination. The commission did not accept the application, but did schedule a site walk for Saturday, November 16, 2002 at 8:30 a.m.

b.) Edward J. Hankey & Jane Valetkevitch, 200 Coachlight Circle. Regulated activities within a proposed 8-lot subdivision. Stephen Giudice of Harry E. Cole & Son represented the applicants. Mr. Giudice related there are two regulated activities involved: (1) a proposed storm water detention basin that will discharge into a watercourse and (2) house footing drain discharge and landscaping at one lot (Lot #4). There is no filling of wetlands or otherwise direct impact. Cynthia M. Rabinowitz, Soil Scientist, presented a Soil Report detailing soil type and descriptions found on site. Ms. Rabinowitz also stated the wetlands involved with Lot #4 are located outside of the boundaries of the proposed subdivision and consequently she did not perform an on-site field investigation. However, she stated these particular wetlands were included in a previous wetland application and approval for the abutting "Tradition Estates" subdivision, and further information would likely be available in the Commission's files. Motion by J. Kaufman, second by B. Doody to accept Application #13-02 of Edward J. Hanky and Jane Valetkevitch for regulated activities at 200 Coachlight Circle and schedule a site walk for Saturday, November 16, 2002 at 9:15 a.m. Unanimous.

Enforcement Hearings: None

Land Use Inspector's Report: Bill Donovan presented copies of the 1997 Inland Wetlands State Model Regulations published by the Bureau of Water Management along with 1998 and 2001 revisions to the Inland Wetlands and Watercourses Act (CT General Statute Section 22a-36 through 45). Bill is suggesting to the Commission that we proceed to up-date and otherwise revise Prospect's Inland Wetlands Regulations to be current with changes made to the State Statutes since 1996 that have a direct impact on an Inland Wetlands Commissions' authority, proceedings and permitting requirements.
