Chairman Koehler called the meeting to order at 7:02 p.m. C. Wentworth was seated for S. Skrebutenas.
Approval of Minutes: Chairman Koehler read aloud the Unapproved Minutes of the March 24, 2003 meeting. C. Dorman was seated for D. Holley. Motion by C. Wentworth seconded by C. Dorman to approve the minutes of the March 24, 2003 meeting as amended. Three votes to approve; two abstentions. Motion to approve carried. Chairman Koehler unseated C. Dorman and re-seated D. Holley.
Communications:
a.) CT Bar Institute, Inc. Seminar announcement on the use of experts in a municipal land use application.
Old Business:
a.) Theodore & Tracy Grieder, 140R Union City Road. Proposed new septic system within regulated area. Chairman Koehler stated on past site walks the proposed septic location was not staked out. Mr. Grieder responded that he did have the septic located with stakes as requested, but trespassers on ATV vehicles kept pulling out those stakes and discarding them. Mr. Grieder has since re-staked the septic. Bill Donovan said he had recently gone to the site and did observe the stakes in the same approximate area where the septic is shown on the site plan. Bill did not see any problem with the location. There was no further discussion. Motion by B. Doody, seconded by D. Holley to approve Application # 10-02 of Theodore & Tracy Grieder, 140R Union City Road for a proposed septic system within a regulated area as shown on map prepared by Connecticut Consulting Engineers, LLC dated January 6, 2003 with latest revision date of January 28, 2003 entitled " 'Septic System Plan' prepared for Theodore Grieder, 140R Union City Road Route 68, Prospect, Connecticut".Unanimous.
b.) Mayor Robert Chatfield, Town of Prospect. Proposed public water supply water main installations within regulated areas on Putting Green Lane and Straitsville Road. At the March 10th meeting Mayor Chatfield presented maps and described the Town's intention to contract with The Connecticut Water Company to install 760 feet of 12" water main on Route 69, (New Haven Road), 1570 feet of 8" water main on Putting Green Lane and 6250 feet of 8" water main on Straitsville Road. The new water mains will cross under an existing storm water drainpipe and within the regulated area on both Putting Green Lane and Straitsville Road. All work will be within the Town roadway easement and State highway easement. Motion by J. Kaufman, seconded by C. Dorman to approve Application #14-02 from Robert Chatfield for water main installations within regulated areas as presented and detailed on maps entitled "Proposed Water Main Extension, Site Location: Route 69, Putting Green Lane & Straitsville Road, Prospect, Connecticut as shown on maps prepared by Gesick & Associates P.C., 19 Cedar Island Ave., Clinton, CT 06413. Unanimous.
c.) Shannon Development Company, LLC, 80 Straitsville Road. Regulated activities associated with proposed 5-lot subdivision, Application # 15-02. Michael Mazzio represented the application. Chairman Koehler stated the site walk and the weather cancellation date site walk scheduled for this application were both cancelled due to poor weather conditions. Chairman Koehler mentioned that he and Bill Donovan did walk the site together and from his observation Chairman Koehler believes there is sufficient potential wetlands impact to warrant a public hearing on this application. The commission agreed and set a public hearing for May 12, 2003 at 7:30 p.m. Bill Donovan will contact Land-Tech Consultants to request they review the plans for this subdivision and provide comment prior to the public hearing. Chairman Koehler set another site walk date for this application for Wednesday, April 16th at 6:30 p.m.
d.) Connecticut Water Company, 120 New Haven Road. Proposed 1.25 million gallon above ground water storage facility. Craig Dowling, Facilities Engineer for the Connecticut Water Company represented this application. He presented site plans and described the project as a needed high elevation water storage facility to augment the public water system within Prospect-primarily for improved fire protection. The proposed tank will be located on Connecticut Water Company property adjacent to the upper elevation section of Putting Green Lane. Bill Donovan indicated the site is not within a regulated area, but that Mr. Dowling wanted to make the commission aware of the proposed storage tank and answer any questions they may have. The commission did not feel it necessary to accept an application from Mr. Dowling as there does not appear to be a direct or potential impact to wetlands. Chairman Koehler acknowledged the presentation by the Connecticut Water Company and thanked Mr. Dowling for coming before the commission.
Enforcement Hearings: None scheduled. Under discussion, commissioners mentioned the Curtiss Gardens site on Union City Road still has not installed the required catch basin per the approved permit, nor have they removed the piles of rock and other materials from the front of the building. The landing area continues to be disturbed from vehicular traffic, and as a result silt is being eroded and washed into the adjacent drainage ditch. The commission is of the opinion that unless these issues are corrected very soon, that an enforcement action is needed. Bill Donovan will again contact Mr. Gustafieri on this matter. Chairman Koehler also stated he would like to have a site walk here in conjunction with the scheduled site walk on Straitsville Road this Wednesday. A time of 6:00 p.m. Wednesday, April 16th was set to re-visit the Curtiss Gardens site at 36-38 Union City Road. Brian Doody mentioned he has observed a build-up of road sediment within the Car Wash facility on Waterbury Road and the potential for this sediment to begin washing over into the downstream wetlands. Bill Donovan will investigate.
Land Use Inspector's Report: J. Kaufman discussed his concerns that there may be a potential conflict of interest of allowing the Town's engineer, who reviews applications and site plans for both Inland Wetlands and Planning & Zoning to also represent other applications before both commissions. He asked Bill to speak with the Town Attorney on this matter.
