Chairman Koehler called the meeting to order at 7:03 p.m. G. Carrington was seated for B. Doody.
Approval of Minutes: Chairman Koehler read aloud the Unapproved Minutes of the June 9, 2003 meeting. Motion by S. Skrebutenas, seconded by G. Carrington to approve the Minutes of the June 9, 2003 meeting as amended. Unanimous.

Old Business:
a.) Application 18-02: Thomas Broderick, 11 Alison Court for an in-ground pool installation within a regulated area. Chairman Koehler stated a site walk did take place June 16th. S. Skrebutenas stated he did not see any problem with the location of the pool. G. Carrington also stated he felt the water table was down sufficiently not to create a problem with the stability of the pool installation. S. Skrebutenas mentioned the need for Mr. Broderick to separate the back wash and install a dry well/plunge pool to allow waste water to penetrate into the ground rather than flow over the surface to the wetlands. Motion by S. Skrebutenas, seconded by G. Carrington to approve with conditions Application 18-02 of Thomas Broderick for an in-ground pool within a regulated area. Unanimous.
b.) Application 19-02: Tesco Rentals, LLC, 151/155 Union City Road. Regulated activities associated with a proposed Elderly Housing Complex. (Continued from June 9th) Stephen Guidice of Harry E. Cole & Sons represented the applicant. Mr. Guidice mentioned that at Building #1 there will be approximately 1,700 square feet of area filled in or approximately 400 cubic yards of material. Mr. Guidice further stated an oil and water separator will be placed between catch basins #5 & #8 as shown on the plans. Emergency vehicle parking will also be provided. Mr. Guidice presented a preliminary plan showing a proposed walking trail within the property boundaries. Paved sidewalks are also proposed within the complex that will connect with the walking trail. J. Kaufman asked what type of cover (wood chips, mulch, etc.) would be placed over the trail. Mr. Guidice is suggesting a mulch cover over process. The trail would be four feet wide. J. Kaufman further suggested the possibility of a small fishing or sitting area be created at the pond. The detention basin will be fenced in with plantings around the basin to aid in stabilization and also to enhance the natural appearance of the area. Maintenance access to the detention pond will come from the southerly end of the development. There should not be any crossings over the brook for maintenance. Roof drains will discharge directly to ground level and not into the storm water system. S. Skrebutenas asked about stabilization of the steep slopes on the eastern boundary. S. Guidice stated erosion control blankets with plantings will be utilized. There are no plans to construct a retaining wall. D. Holley asked about a response from the Connecticut Water Company, being that this project falls within the Level “B” aquifer of the water company’s Indian Well public water supply well field. Mr. Guidice read into the record a letter dated June 16, 2003 from the Connecticut Water Company addressed to Robert Hiscox, Chairman Planning & Zoning regarding this proposed elderly housing project. D. Holley asked what type of controls will be in place during construction, particularly around the detention area, pond and upper stream. Mr. Guidice stated that he is also in discussion with the Health Department regarding their required 100 foot separation between the outflow of a storm water pipe and a watercourse. J. Kaufman asked about various controls associated with the sanitary pump station. There will be a generator stand-by power source in the event of a power outage and in-line check valves every 500 feet along the sanitary line to Naugatuck. G. Carrington asked about the discharge of the roof drains at Building 4. S. Guidice stated they can be run either into the storm water system or to the wetlands area. D. Holley asked what kind of chemicals/ice remover agents would be utilized for winter road maintenance within the complex. He is concerned that harsh chemical run-off would damage the downstream wetlands over time. C. Wentworth asked where the fuel storage would be for the back-up generator for the pump house. Response is that the generator is to be powered by the available natural gas line. Chairman Koehler stated they are expecting to hear from Land-Tech Engineers shortly, who are the Town’s reviewing engineers for this application and will forward a copy of those comments over to Mr. Guidice when they are received. The application review is being continued to the July 14th meeting.
Public Hearings:
a.) 7:30 p.m. Application 15-02: Shannon Development Company, LLC, 80 Straitsville Road. Regulated activities associated with a proposed 5-lot subdivision. This public hearing was continued from the May 27, 2003 meeting. Chairman Koehler read into the record a letter from Kathleen Mazzeo of Shannon Construction Company, LLC requesting they be allowed to withdraw their application without prejudice at this time with plans to re-submit at a later date. Chairman Koehler concurred with the applicant’s request and closed the public hearing. The application was acknowledged withdrawn. No further action was taken.
New Business:
a.) Town of Prospect, 21 Cheshire Road. Pond aeration system installation. Bill Donovan, Land Use Officer for the Town of Prospect represented the applicant. Bill stated that the Mayor is proposing an aeration system for the small pond located at McGrath Park. Bill described the system as a submersible pump with attachments sending a continuous spray of water approximately 8 feet high with a 25 foot wide diameter. At the surface will be a rock-looking mosaic giving the impression of water coming out of a natural rock formation. The system is designed to operate year-round with lights coming on at night to accent the spray. The aerator will help circulate water to improve water quality. Chairman Koehler asked about the security of the electrical box. No draining or lowering of the pond is needed for installation. Motion by J. Kaufman, seconded by G. Carrington to accept Application 20-02 as presented and waive the fees and acknowledge the agent approval of this application. Unanimous.
b.) Father John Gatzak, 78 Melissa Lane. Added fill over previously filled wetlands and into wetlands, and replacement deck within a regulated area. Kevin Robinson of Sullivan Brothers Remodeling spoke as agent. Mr. Robinson stated Father Gatzak’s intentions to replace the existing deck with a larger deck. The buried piers for the deck are approximately 20 feet from the wetlands. Father Gatzak also stated he would like to lessen the existing pitch of the slope at the end of the back yard and increase the usable yard area by bringing in fill. He further would like to place a gazebo on cinder blocks in an area of the wetlands where there is normally no standing or running water. Motion by S Skrebutenas, seconded by J. Kaufman to accept Application 21-02 of Father John Gatzak for two regulated activities at 78 Melissa Lane. Unanimous. Chairman Koehler scheduled a site walk for Wednesday, June 25, 2003 at 6:30 p.m.

Land Use Inspector’s Report: Bill Donovan mentioned he has noticed activity in the wetlands at 117 Cook Road and will notify the property owner of the need to obtain the necessary permits or restoration.
