Chairman Koehler called the meeting to order at 7:02 p.m. No alternates were seated.
Approval of Minutes: Motion by C. Dorman, seconded by B. Doody to approve the minutes of the August 23, 2004 meeting. Four votes in favor with one abstention. Motion to approve carries. Motion by S. Skrebutanus, seconded by J. Kaufman to approve the minutes of the August 30, 2004 Special Meeting. After discussion, S. Skrebutanus withdrew his motion to approve. motion by S. Skrebutanus, seconded by B. Doody to approve the minutes of the September 13, 2004 meeting. Three votes in favor with two abstentions. Old Business:
a. Application 03-04: Prospect Estates, LLC 193 & 193R Cook Road. Regulated activities associated with a propsed 6-lot subdivision. Timothy O'Connell of Juliano Associates, Engineers and Surveyors, represented the applicant, Lawrence Beauspleil. Chairman Koehler stated a Site Walk did take place on Saturday, September 25th. Prior to the meeting, Commissioners and the applicant reveived copies of Land-Tech Consultants' review comments on this proposed subdivision dated October 11, 2004. Mr. O'Connell presented a written response to those comments, and addressed in detail Land-Tech's review with the commissioners. Mr. O'Connell also presented revised plans that incorporate items referenced in Land-Tech's report. J. Kaufman asked if added fill at the cul-de-sac would also require additional fill on either side of the roadway. Mr. O'Connell stated added road materials will be required. J. Kaufman suggested adding a porous underlay of material to allow ground water movement to pass under the road. J. Kaufman also asked for a drawing showing the surrounding land area and how the development of this parcel would affect wetlands and watercourses on adjacent properties. Mr. O'Connell discussed the detention pond and stated no stormwater from the pending Phase II portion of this project would drain to the detention pond. Commissioners discussed various measures such as check dams, silt fencing, etc. to control runoff during the road construction. Chairman Koehler adked what alternatives have been considered to reduce the impact on the wetlands. As an example, could the detention basin be relocated out of the wetlands? Also discussed was access to the deterntion basin for future maintenance by the Town. A consensus of the commissioners agreed there are significant proposed impacts to the wetlands and a public hearing on this application is required. Chairman Koehler scheduled a public hearing for Monday, November 8, 2004 at 7:30 p.m.

New Business:
a. Tara Petta, 12 Boardman Drive, Filling in rear yard within regulated area. Chairman Koehler stated a Site Walk on this property took place on September 15th. Mr. Petta had previously filled in his rear yard to level the property without first obtaining the necessary permit to do so. He was now applying for the Inland Wetlands permit. Chairman Koehler stated the back portion of the fill area is bleeding into wetlands and needs to be contained. Sediment within the wetlands also should be removed. Silt fencing/hay bales are to be installed along the northerly boundary of the fill area, and the fill materials need to be hydroseeded for stability. Motion by D. Gokey, seconded by B. Doody to accept Application 05-04 of Tara Petta for depositing fill within a regulated area.Unanimous.
b. Town of Prospect, 36 Center Street. Road drainage improvements within regulated ara on Birchwood Terrace. Mayor Robert Chatfield presented the application. Mayor Chatfield stated the Town is seeking to install 3 catch basins and 200 feet of 15" piping to alleviate hazardous road conditions during rain heavy rain events and winter ice storms. The drainage improvements should help capture sediment/road sanding that would otherwise discharge into the downstream wetlands. Motion by J. Kaufman, seconded by B. Doody to accept Application 06-04 of the Town of Prospect for regulated activities associated with road drainage improvemts and waive the fee. Unanimous. Motion by J. Kaufman, seconded by S. Skrebutanus to approve by Summary Ruling Application 06-04 of the Town of Prospect as presented. Unanimous.
c. Lornic, LLC, 18 Spring Road, Application for regulated activities associated with a proposed 8-lot subdivision. Darrin Overton of Malone & MacBroom, Inc. represented the applicant. Mr. Overton described the project as an 8-lot subdivision in the Fulling Mill Brook watershed. Wetlands and a portion of the Fulling Mill Brook are located in the northern portion of the site. Mr. Overton presented with the application a wetlands delineation and soils report from David Lord, Certified Soil Scientist. Mr. Overton also stated a DEP Storm water General Permit would be required as the project will disturb more than 5 acres. He further advised the commission that the CT Water Company has been notified as the projectis located within their Indian Well Field Aquifer. A report from the Chesprocott Health District will also be available at the next meeting. There are eight regulated activities consisting of (1) roadway construction, (2) fill at the cul-de-sac, (3) detention basin, (4, 5) Lot 4: house and septic, (6 & 7) Lot 5: house and septic, and (8) Lot 6: septic. J. Kaufman questioned the location of the berms shown on the plans with concerns that should the septic system fail, these berms could direct septic effluent into the storm water system and downstream wetlands. Motion by J. Kaufman, seconded by C. Dorman to accept application 07-04 of Lornic, LLc for regulated activities at 18 Spring Road. Unanimous. Two site walks were scheduled for Saturday, October 30th at 8:30 a.m. and Saturday, November 6th at 8:30 a.m.
d. Edward Corey, 91 Scott Road. Application to extend driveway over wetlands and seasonal watercourse. Robert Luddy represented the applicant. Mr. Luddy stated Mr. Corey, who is hearing impaired, is seeking to extend his driveway to enhance the site line at Scott Road and have greater visibility of on-coming traffic. The proposed driveway extension is 12 feet wide and will disturb approximately 1500 S.F. of wetlands and will cross over a seasonal watercourse. An 18" crossover pipe will direct the waters to the nearby existing headwall and 18" pipe that directs stream water under Scott Road. Top of driveway will be processed stone. A tara fabric will be placed beneath the process to prevent cross contamination of underlying organic matter or soil. Motion by S. Skrebutanus, seconded by J. Kaufman to accept Application 08-04 of Edward Corey for regulated activities at 91 Scott Road. Unanimous.
Enforcement Hearings: None.
Land Use Inspector's Report: Bill Donovan mentioned the letter from the Prospect Land Trust included with "correspondence" references a possible regulated activity near a vernal pool. Bill will investigate. Commissioners also expressed concern with the added materials being placed in the upper northwest portion of the Boulder Brook development and asked Bill to investigate. Bill stated engineers from Harry E. Cole & Son will be at the next meeting to present a proposal for sediment removal at the Reilly pond. The commission should also consider establishing a performance bond figure for Boulder Brook.
Correspondence (continued): Chairman Koehler asked for motions to approve the Land-Tech Invoicrs presented with correspondence. by J. Kaufman, seconded by S. Skrebutanus to approve 3 invoices by Land-Tech Consultants dated September 10, 2004 and October 15, 2004 with the understanding that Land-Tech will correct the "In Reference To" address on tow of the invoices from 80 Straitsville Road to Boulder Brook. Unanimous.
