Chairman Koehler called the meeting to order at 7:05 p.m. C. Dorman was seated for J. Kaufman; G. Carrington was seated for B. Doody.
Approval of Minutes:
Motion by C. Wentworth seconded by A. Koehler to approve the minutes of the March 14, 2005 meeting as presented. Two votes in favor with one abstention. Motion to approve carries.
Communications:
CT Department of Environmental Protection: Copy of an approval of the statewide drainage maintenance plan issued to the DEP for various drainage projects within State forest and park areas.
Old Business:
a. Application 12-04: (continued from February 14th) Patrick Graziano, 13, 17, 19, 21, 23 Old Schoolhouse Road Regulated activities associated with a residential subdivision. Andy Greene of the engineering firm Milone and MacBroom represented the applicant. Chairman Koehler stated that the Site Walk on this application scheduled for March 19th did take place. Mr. Greene reviewed changes made to the subdivision plans since the last meeting that consisted of added reinforced concrete pipe culverts to be installed under the driveways for Lots 2 & 3. Mr. Greene presented an "Existing Watershed Map" detailing 2 separate watershed areas within the subject property and one small watershed abutting a portion of the eastern boundary. Waters passing through these watersheds flow in a southerly direction. Commissioners discussed in length the presence of an existing 8" storm water drainage discharge pipe on Lot 6 that comes from the abutting Dairy Bar and the potential for pollutants from this discharge entering wetlands. Mr. Greene presented a water quality report prepared by Connecticut Testing Laboratories located in Meriden, CT of samples collected at the direct discharge from the Dairy Bar outfall pipe on March 24, 2005. Results of that sampling indicate the presence of E. Coli and Total Coliform bacteria. All other parameters tested were below the DPH WQS. Commissioners questioned why this discharge pipe is located on this property at all. Commissioners asked Mr. Greene not to extend piping from the point of discharge to the wetlands. Mr. Greene also reiterated that there is to be no impact on existing curtain drains on the property from the design and placement of septic systems or house drains. A review of regulated activities determined there is a direct wetlands impact of 1,207 S.F. with the construction of twin driveways for Lots 2 & 3; driveway construction for Lots 3, 4 & 6 within a regulated area and a portion of the septic system for Lot 6 within the regulated area. With no further comment Chairman Koehler called for a vote on this application. Motion by C. Wentworth, seconded by G. Carrington to approve Application 12-04 of Patrick Graziano for regulated activities located at 13, 17, 19, 21 & 23 Old Schoolhouse Road as presented by the applicant's engineer and as shown on Sheet 3 of 5 sheets prepared by Milone & MacBroom, 716 South Main Street, Cheshire, CT 06410 entitled "Site Development Plan, Wooded Acres Subdivision Lots 2-6" dated February 10, 2005 with latest revision date of April 8, 2005 with conditions that there be no extension of existing curtain drams that were installed on this property in conjunction with a prior proposed development for an elderly housing complex, and no extension of the existing 8" storm water drain pipe coming from the abutting Dairy Bar. An additional water sample from the Dairy Bar discharge pipe shall be taken on or about the first week of August, 2005.
The applicant or his assigns shall notify the Land Use Inspector of any disturbance to the existing curtain drains that occurs during development of the subdivision. With three votes in favor and one abstention the Motion to approve carries
New Business:
a. Joseph Capuano, 32 Luke Street. Application for constructing a detached garage and an above-ground pool within a regulated area. Mr. Capuano was present and informed the commission of his desire to construct a detached garage in the rear property and an above-ground pool on the left side of the house. Inland Wetlands are located within the side and rear boundaries of the property. Motion by C. Wentworth, seconded by G. Carrington to accept Application 12-04 of Joseph Capuano for regulated activities at 32 Luke Street. Unanimous. Chairman Koehler scheduled a site walk for Tuesday, April 19, 2005 at 6:00 p.m.
b. William and Karen Mullen, 14 Blue Trail Drive. Application for constructing a house addition within a regulated area. Mr. Mullen was present and informed the commission he would like to construct a house addition off the right side of his house. Wetlands are located approximately 50 feet to the rear of the proposed addition. Motion by C. Dorman, seconded by G. Carrington to accept Application 13-04 of William and Karen Mullen for regulated activities at 14 Luke Street. Unanimous. Chairman Koehler scheduled a site walk for Tuesday, April 19, 2005 at 6:30 p.m.

Land Use Inspector's Report:
Under discussion, C. Wentworth questioned if Justin Gill, 117 Cook Road has intentions of producing a wetlands map for the commission showing the wetlands boundary relative to Mr. Gill's new detached building. C. Wentworth noted that Mr. Gill is placing rocks and doing site grading off the back side of the building that extends closer to wetlands. Bill Donovan stated he had sent a letter in January to Mr. Gill asking for a wetlands map and has had no response. The commission directed Bill to begin enforcement actions on Mr. Gill to mandate he produce a wetlands map of his property. Commissioners also discussed a prior application of Tara Petta, 12 Boardman Drive that was denied in January, 2004. Chairman Koehler stated he will contact the Pettas to confirm with them what information the commission is asking for regarding the filling in of a portion of their rear yard over wetlands.
