Chairman Koehler called the meeting to order at 7:02 p.m. S. Sackter was seated for J. Kaufman.

Approval of Minutes:
Motion by S. Sackter, seconded by G. Carrington to approve the minutes of the August 8,2005 meeting. Unanimous.

Public Participation: None

Old Business:
a. Application 02-05: John P. Gatzak, 78 Melissa Lane. Above-ground pool within a regulated area. Chairman Koehler stated a site walk was conducted on this parcel on August 18th. Chairman Koehler commented that the amount of fill existing on site appears additional to what was approved on an earlier application for this parcel. Father Gatzak stated he had placed fill to allow safe access to his gazebo. Chairman Koehler noted the fill area that is where the proposed pool would be located is not stabilized. He requested the applicant have rock placed at the toe of slope to help prevent bottom erosion into the wetlands. The bank of the slope also needs to be stabilized with permanent plantings or a permanent cover. Chairman Koehler also requested the applicant have the existing silt fencing re-installed properly to where the bottom of the fencing is below ground level and secured. Father Gatzak mentioned that he plans to have retaining walls installed to further stabilize the back area. Motion by G. Carrington, seconded by S. Sackter to approve Application 02-05 for installation of an above-ground pool within a regulated area with conditions that (1) the applicant advise the Land Use Inspector or Chairman when site work is hi progress to allow for an inspection to view stabilization improvements of the fill area, (2) stabilization methods shall include rock placed at the toe of slope and permanent ground cover of the slope itself, (3) re-establishment of silt fencing, properly installed, between the work area and wetlands, (4) construct a plunge pool or other acceptable water retention devise to prevent a direct surface discharge of pool backwash or drainage waters in the wetlands. Unanimous.
b. Application 03-05: Application 03-05: Tesco Rentals, LLC, Pond restoration at 179 Union City Road. Chairman Koehler stated a site walk on this parcel took place on August 18th. Mrs. Jean Reilly, owner of 179 Union City Road, was present at the site walk. Henry Berberat spoke for Tesco Rentals. Commissioners reviewed with Mr. Berberat his engineered plans to restore a portion of the Reilly's pond that has received sedimentation from Mr. Berberat's abutting elderly housing project currently under construction. Mr. & Mrs. Reilly were in attendance and also reviewed the plans. They were satisfied with the plans as presented. Chairman Koehler discussed with Mr. Berberat the stages involved in the restoration project. The Chairman urged Mr. Berberat to bring in a machine large enough to significantly remove the sediment deposits at the headwater of the pond. Laborers will be required to hand remove sediments within the contributing streams. It was noted that the current stream water levels are low and the project should not be delayed. Mr. Berberat stated he hopes to have the work completed by mid September. Motion by G. Carrington, seconded by S. Sackter to approve Application 03-05 of Tesco Rentals for pond restoration work at 179 Union City Road as detailed on plans and narrative prepared by Harry E. Cole & Son, Consulting Engineers entitled "Pond Restoration Plan", Prospect, Connecticut" dated November 1, 2004 and waive all fees. Unanimous. Motion, by G. Carrington, seconded by S. Sackter to set a site improvement bond for this project in the amount of $ 6,700.00. Unanimous.

New Business:
a. Timothy O'Rourke, 15 Mixville Road. Tree thinning and filling of wetlands; equipment storage in regulated area. Mr. O'Rourke was not in attendance.
b. J. C. Mechanical, LLC, 5 Holley Lane. In-ground pool in regulated area. Steve Docchio represented the applicant. Mr. Docchio stated his client, Lisa and Thomas Dumond, are hoping to have a 16' x 32' in-ground pool. Because of restrictions resulting from the location of the septic system and septic reserve area, the pool would be located approximately 30' from wetlands. Motion by S. Sackter, seconded by G. Carrington to accept Application 04-05 of J.C. Mechanical, LLC for an in-ground pool within a regulated area. Unanimous. A site walk was scheduled for Wednesday, September 7 at 6:00 p.m.

Public Hearings: None

Enforcement Hearings:
Bill Donovan reported that at the direction of the Town Attorney, a second "Cease & Desist" order should be sent to Justin Gill, 117 Cook Road advising him that the commission will hold a hearing to provide Mr. Gill the opportunity to be heard and show cause why the order should not remain in effect.

Land Use Inspector's Report:
Bill Donovan reported that the developer for the "Wooded Acres" subdivision on Old Schoolhouse Road has directed his engineer to take the required water sample from the existing drainage pipe on the property and provide a copy of the water test results to the commission. Bill also contacted the engineer for the "Prospect Estates" subdivision on Cook Road concerning water monitoring at the abutting Spreda pond. The engineer stated he will be contacting Mrs. Speda on the testing and begin monitoring the pond for water levels and flow rates.
