Chairman Koehler called the meeting to order at 7:08 p.m. S. Mulhall was seated for G. Carrington. Approval of Minutes: No action taken. Deferred to the next scheduled meeting.

Communications: (1) Council of Governments, Central Naugatuck Valley: Memo on revisions in Stati Statutes concerning notice requirements; (2) Nancy Levesque, NET Engineering, LLC: Lettei -withdrawing application at 80 Straitsville Road; (3) John Mancini, BL Companies: Letter acknowledging Bill Donovan's assistance with the Toll Brothers' application.

New Business: a. Motcat Inc., 80 Straitsville Road. New Septic system and driveway within regulated area. Nancy Levesque, PE with NET Engineering, LLC, Cheshire, CT represented the applicant. Ms. Levesque stated the applicant is seeking to build a new house in the rear of 80 Straitsville Road. Their intention is to utilize an existing driveway at 82 Straitsville Road and eliminate the need for a driveway crossing over the wetlands on this property. The portion of the driveway on 80 Straitsville Road is approximately 20 feet to wetlands; the proposed septic system is 60 feet to wetlands. Motion by J. Kaufman, seconded by S. Mulhall to accept Application 06-08 of Motcat, Inc. for two regulated activities associated with a new residential house. Unanimous. A site walk was scheduled for Tuesday, August 22nd at 6:00 p.m. Chairman Koehler asked for a motion to add V. C. Construction to the agenda. Motion by S. Mulhall, seconded by J. Kaufman to add V.C. Construction, 87 Coachlight Circle to the agenda under "New Business". Unanimous.

b. V.C. Construction, Inc., 87 Coachlight Circle. Application for a house addition, pool and pool deck within regulated area. Vincent Corsino represented the applicant. Mr. Corsino stated his company has been hired by the property owners, Leonard and Genine Candella, to construct a house addition, pool and pool deck within a regulated area. The house addition is approximately 21 feet to wetlands and the pool is 50 feet to wetlands. Motion by J. Kaufman, seconded by S. Mulhall to accept Application 06-09 of V. C. Construction for regulated activities including a house addition, pool and pool deck. Unanimous. A site walk was scheduled for August 22nd at 6:30 pan.

Old Business: a. Application 06-06: Highland Greens Golf Course, 122 Cook Road. Repair of French drain. George Sabo, in represented the applicant. J. Kaufman stated he and C. Dorman had inspected the site and is satisfied there would be no impact to the wetlands with the proposed drainage improvements at the #2 green. Motion by J. Kaufman, seconded by S. Mulhall to approve Application 06-06 with conditions that (1) a plunge pool to be constructed upstream of the existing culvert passing under Cook Road, (2) a berm will be placed around the well to capture overflow, (3) filter cloth to be added to help keep sediments out of the newly buried drainage pipe, and (4) B. Donovan to be notified prior to construction.

Public Hearing: a. 7:37 p.m. Application 06-02: Mark & Karen Southard, 17 Salem Road. Proposed driveways crossinj wetlands; septic system within regulated area. Chairman Koehler read into the record the "Notice o: Public Hearing" for this application as it appeared in the Republican American on August 3 & 10, 2006 Chairman Koehler also read into the record a letter from Land-Tech Consultants, Inc. dated August 10 2006 as the Town's reviewing engineers for this application. Rowland Desrosiers of R.J. Desrosiers and Associates represented the applicants. Mr. Desrosiers stated the applicants propose to purchase land from an adjacent landowner and construct twin driveways over wetlands for two homes. Mr. Desrosiers presented revised plans showing a changed location of the driveways from the original proposal. J. Kaufman asked for a map that better describes the location of these driveways relative to the surrounding area. Mr. Desrosiers clarified the location of these activities. He stated Chesprocott Health would not allow the driveways coming in from Salem Road because of the need to retain a portion of that property for future septic repairs or replacement. Mr. Desrosiers also mentioned that by shifting the driveways to the north, they were able to reduce to impact to wetlands to under 5,000 S.F. He stated he will submit a calculation showing the upstream watershed is less than the 640 acres referenced in Land-Tech's letter. Other comments by Land-Tech will also be addressed including reducing the common driveway to 18 feet. J. Kaufman asked for a copy of Land-Tech's letter and the soil scientists' report. Chairman Koehler asked if there was any way to access these lots from Salem Road rather than Straitsville Road. Mr. Desrosiers stated doing so may create a conflict with the Town's subdivision regulations concerning "stacking" of rear lots. At this time, the property to be subdivided consists of one piece of land with one house. Chairman Koehler asked to have the center of the new driveway locations staked. The Chairman also asked Mr. Desrosiers to meet with Planning & Zoning to get a sense of whether they would accept an application for driveway access coming in from Salem Road, which would eliminate the need to cross over wetlands. B. Donovan stated he would place the Southards on the next P & Z agenda. J. Kaufman views this as a prudent alternative to the proposed application. (Stephen Mulhall left the meeting at 8:00 p.m.). J. Kaufman encouraged the applicant to seek other alternatives to the wetlands crossings. Chairman Koehler asked for comments from the public. There were no comments and the public hearing was continued to September 11,2006 at 7:30 p.m. Hearing on Cease and Desist Enforcement Order.

a. Prospect Estates Subdivision, 193 Cook Road. Chairman Koehler stated with Stephen Mulhall having left the meeting, only he and J. Kaufman are in attendance. As a minimum of 3 members are required for a quorum to conduct business and vote or take action on any application, the hearing on this Cease & Desist Enforcement Order can not go forward at this time. Chairman Koehler asked Mr. Beausoleil and his attorney if they would be available for a Special Meeting to conduct this hearing. Attorney Towers stated they would make every attempt to attend whenever the meeting date is arranged. Chairman Koehler stated they will try to confirm a Special Meeting for Thursday, August 17th at 6:00 p.m. or whenever a quorum can be confirmed.
