Chairman KoehJer called the meeting to order at 7:02 p.m. S. Sackter was seated for G. Carrington.
Approval of Minutes: Motion by C. Dorman, seconded by S. Sackter to approve the minutes of the Jum 12,2006 meeting as amended. Unanimous.
Communications: (1) Land-Tech Consultants, Inc. Letter regarding pond inspection at 35 Candee Roa< (see "Old Business" (c)); (2) Land-Tech Consultants, Inc. Review letter of "Summit Heights" subdivisior (see "Old Business" (a)).
Old Business: a. Application 20-05: Robert & Mark Capanna, 145, 145A & 147 Summit Road. Proposed lO-loi residential subdivision. Andrew Greene of Milone & MacBroom represented the applicant. Chairman Koehler noted receipt of a review letter on this application from Land-Tech Inc. dated July 7, 2006. Mr. Greene stated he had also received a copy of that letter and has prepared comments for the board. He submitted a response letter dated July 10, 2006. Mr. Greene reviewed with the commission the latest changes to the subdivision. The septic on Lot 3 has been relocated as far from wetlands as possible. Mr. Greene related that the original "Summit Heights" subdivision approved by the commission is basically the same as the current application up to the wetlands crossing. The difference between the two is that the original application showed Industrial use past the wetlands crossing while this application is all residential. The septic on Lot 8 is now 50 feet from the detention area whereas the prior plan showed no detention systems. Septic tank locations are shown on latest revisions. Mr. Greene stated the grading slope of 3:1 vs. 2:1 is preferable for maintenance and erosion considerations. Also, the 2002 Connecticut Guideline for Soil Erosion and Sediment Control recommends an embankment side slope of 3:1 or greater. The R.O.W. between Lots 4 & 5 is preferred as it reduces severe road cuts and places a defined boundary from wetlands. A house location by comparison is not so defined and future use could encroach close or into wetlands. As requested by the commission 4x4 wetlands marker posts are shown on the revised plans. Mr. Greene stated shallow footing and roof drain infiltration systems are not preferable based on soil data and by field observations of many areas remaining considerably moist for some time after a rain event. He believes satisfactory groundwater infiltration would be unlikely during wetter periods of the year. Mr. Greene stated gravel parking areas at detention basins are now labeled on the plans and that detention basin plantings will be field located and planted according to the site plans, directions from a wetlands scientist and town wetlands agent comments. Mr. Greene presented a revised set of plans dated to July 10, 2006. C. Wentworth questioned the added septic tank on Lot 7. Mr. Greene explained this is a pumping chamber to force the effluent to the higher septic field. Chairman Koehler asked whether the current design criteria for detention basins needs to be revisited due to the changing pattern of significant rainfalls now occurring in our area. Mr. Greene stated detention basins are designed for 100 year storms while storm water piping is often designed for lesser storm events. S. Sackter asked if the detention basins will be dry bottoms. Mr. Greene stated they will be dry by design. Ultimately, maintenance of the basins is turned over to the town. Mr. Greene presented a copy of the most recent set of plans revised to July 10,2006. There was no further discussion and Chairman Koehler called for a vote on this application. Motion by C. Wentworth, seconded by C. Dorman to approve Application 20-05 as presented with conditions that 4" x 4" permanent posts to be placed along the wetlands boundaries and numbered. A map drawing with the individual post numbering shall be provided to the commission Unanimous.
b. Application 23-05: Prospect Cemetery Association, Inc. 166 Union City Road. Proposed cemetery within regulated area. Roger Allen represented the applicant. Chairman Koehler stated a site wall occurred on June 27th. The Chairman indicated the intermittent stream shown on the applicant's plan doe; not appear to meet the definition of a watercourse as defined in the regulations and is not considered { regulated activity. The Chairman asked if the applicant has received D.O.T. approval for their curb cut Mr. Allen stated they have, and that they also received approval form the Chesprocott Health District Motion by C. Dorman, seconded by C. Wentworth to approve Application 23-05 for a portion of the proposed driveway within a regulated area and with conditions to remove the intermittent watercourse a* shown on the applicant's map. Unanimous.
c. Charlene Spreda, 35 Candee Road. Pond Restoration. Chairman Koehler read into the record a lettei dated June 16, 2006 from Christopher Allan, Land-Tech, Inc. saying he had inspected the Spreda pond or May 17, 2006 and observed a significant accumulation of sediments near the inlet of the pond. He also wrote it was beyond Land-Tech's capability to determine the source of the sediments in the pond and suggested contacting a limnologist. B. Donovan will contact a limnologist to arrange a meeting at the Spreda property. He will advise Mr. Beausoleil. Mrs. Spreda asked where the inspection records submitted by Juliano Engineering are located. B. Donovan stated they are in the files. Mrs. Spreda felt these inspection reports seem unavailable and should be included with correspondence. Mrs. Spreda presented a map and deed descriptions of the lots located within the "Prospect Estates" subdivision that have been transferred over to Nutmeg Investments. She questioned if the Commission had transferred authorization to Nutmeg Investments to work within the regulated areas in these lots as was required in the permit granted to Prospect Estates. There was no transfer approved. Mrs. Spreda then questioned why Nutmeg Investments is allowed to develop lots in this subdivision where there are regulated activities involved. She expressed her deep dissatisfaction with the commission and in particular Bill Donovan for not following up on the conditions of the permit, various requests by the commission, complaints and questions raised with this development. C. Wentworth also stated Bill needs to improve the files on this application to where correspondence, inspection reports and various records are readily available for an immediate or requested response or access as requested. He is disappointed in not having records from Juliano Associates available as has been requested. Mrs. Spreda also questioned why a recommendation was not implemented by David Lord, a registered soil scientist hired by Mr. Beausoleil, who suggested notations should be added on the three northern lots that would require the landowner to obtain Inland Wetlands permit approval for activities located within the upland review area.
New Business: a. Town of Prospect, 36 Center Street. Planned drainage improvement projects for 2006-2010. Bill Donovan presented a package from Mayor Chatfield detailing the Town's road improvement projects planned for the next four years. The commission chose to carry this over to the next meeting when Mayor Chatfield is available.
b. Katherine O'Grady, R Grenier, D & W Rek, 32 Rek Lane. Culvert over watercourse. David Rek represented the applicants. Mr. Rek stated they are proposing to extend the existing culvert over the brook in the front of their property an additional 5 feet. There is no disturbance to the brook. Motion by C. Dorman, seconded by S. Sackter to accept Application 06-01 as presented Unanimous. A site walk was scheduled for July 18th at 6:00 p.m.
c. Mark & Karen Southard, 17 Salem Road. Proposed driveways crossing wetlands; septic system within regulated area. Rowland Desrosiers of R.J. Desrosiers and Associates represented the applicants. Mr. Desrosiers described the application as a 2-lot subdivision utilizing driveway access from Straitsville Road and Salem Road. Regulated activities consist of driveway construction over wetlands including the piping of a watercourse and septic systems within a regulated area. B. Donovan asked Mr. Desrosiers tc have his soils scientist prepare a narrative for the next meeting. A letter from the Chesprocott Health District is also required for the septic system. Motion by C. Wentworth, seconded by C. Dorman to accept Application 06-02 of Mark & Karen Southard as presented. Unanimous. A site Walk was scheduled for June 18* at 6:20 p.m. Chairman Koehler asked for a motion to add Stephen Lombardo, 84 Union City Road to the agenda. Motion by C. Dorman, seconded by S. Sackter, to add Mr. Lombardo to the agenda. Unanimous
d. Stephen and Karri Lombardo, 66 Union City Road. Application for an in-ground pool within a regulated area. Mr. Lombardo stated they are applying for a permit to construct an in-ground pool within the regulated area. Motion by C. Wentworth, seconded by C. Dorman to accept Application 06-03 of Stephen and Karri Lombardo for an in-ground pool. Unanimous. A site walk was scheduled for June 18th at 7:00 p.m. Chairman Koehler asked for a motion to add Steven McLean to the agenda. Motion by S. Sackter, seconded by C. Dorman to add Steven McLean to the agenda. Unanimous.
e. Steven McLean, 59 Plank Road. Application for filling over wetlands area -within lawn. Mr. McLean stated his back yard is continually wet due to a high ground water table. He is having clean fill brought in raise the grade on a portion of his yard. Bill Donovan noticed the work and asked Steve to apply for an Inland Wetlands permit. Chairman Koehler asked Mr. McLean why he did not include this work with his recent application for a garage addition. Mr. McLean said he did not think to do so. Motion by S. Sackter seconded by C. Dorman to accept Application 06-04 of Steven McLean. Unanimous. A site walk was scheduled for July 13th at 5:30 p.m.
Public Participation: Adelle Gray, 192 Cook Road. Questioned what conclusions the limnologist would reach at the Spreda pond after a visit She also asked who is responsible. Chairman Koehler stated the limnologist may be able to determine the extent of recent sediment deposits within the pond and the general health of the pond. It may be difficult to determine exactly where all the sediments came from. Charlene Spreda questioned where is the follow-up on issues brought up during discussions with Mr. Beausoleil regarding the 4 stand pipes that were to have been installed to monitor ground water to Sanford Brook, Juliano's records of site inspections and verification that these inspections are continuing, and the property deed descriptions she mentioned earlier. She again criticized Bill Donovan for not following through on any of these requests. Patricia Audette, Roaring Brook Road expressed her concerns with safety at the cul de sac of the Prospect Estates subdivision on Cook Road. There is an extremely steep drop off just beyond the back side of the cul de sac into the detention basin with no protective barrier to stop a car, bicycle or pedestrian.
Land Use Inspector's Report: Bill Donovan mentioned that Senior Paflcho's restaurant on Cheshire Road had recently replaced an existing deteriorated catch basin and piping adjacent to a watercourse and had removed trees and brush within a regulated area. He has asked the owner to apply for an Inland Wetlands permit. Mrs. Spreda wondered what follow up would take place to ensure this application goes forward. At this time, Chairman Koehler called for a short recess. Maryann Bear, 209 Cook Road is Mr. Rosanelli's daughter (see New Business) and stated the sedimentation going into the Spreda pond is not from her parent's property. Under general discussion a Special Meeting was scheduled for Wednesday, July 19* at 6:30 p.m. to set up an inspection schedule for site visits.
