Chairman A. Koehler called the meeting to order at 7:02 p.m. The meeting was taped. D. Michaud was seated for C. Wentworth.

Approval of Minutes: Motion by S. Mulhall, seconded by S. Sackter to approve the minutes of the November 26, 2007 meeting as presented. Unanimous.

Communications:
1. Council of Governments of the Central Naugatuck Valley - Land Use Seminars for 2008.
2. Building Inspector's Report November 2007.

OLD BUSINESS:
a. Reilly Pond, 179 Union City Road. Significant sedimentation in pond. B. Donovan updated the commission regarding progress on the clean-up. Bill stated that he spoke with both Hank Berberat of Tesco Rentals, LLC. and Jean Reilly. Mrs. Reilly has signed letter of authorization for Mr. Berberat to do the work on her property. Mr. Berberat is still hoping to complete the forebay and removal of sedimentation from the Reilly pond before the end ol year.

b. Application #14-07 - Town of Prospect, 36 Center Street. Drainage improvements bet\veen #3 and #9 Gramar Avenue. B. Donovan explained to the commission that the State had recently unblocked a drainage basin on the easterly side of Route 68 near 3 Industrial Road. The basin drains onto 3 Gramar Avenue and is now causing a flooding problem and causing the parking area to break apart. The existing drainage system can't handle the additional waters going onto the property. The Town is proposing to increase the size of the drain pipe, directing the flow to a swale and basin at 15 Buckley Lane, then track along the westerly side of Gramar Avenue to discharge al the end of Buckley Lane. S. Sackter questioned road runoff being discharged into the wetlands at Buckley Lane, Bill stated the Town is only increasing the size of the piping to avoid upstream damage at Gramar Avenue. Motion by S. Sackter, seconded by S. Mulhall to approve Application #14-07 of the Town of Prospect for drainage improvements between #3 & #9 Gramar Avenue as presented. Three votes in favor/D. Michaud abstained. Motion carried.

New Business: Bill Donovan stated that Chris Caporaso, 176 Straitsville Road, was in attendance to review with the Commission his proposal to obtain a special permit for two greenhouses on his property. Bill indicated that he has visited the site and doesn't believe Mr. Caporaso is within a wetlands review area. Bill asked Mr. Caporaso tc come before the IWC because his property is within a public water supply watershed area. Mr. Caporaso stated thai there will be no major excavation taking place; he is only trying to level off the area for the proposed greenhouses, Mr. Caporaso will be using the greenhouses for growing flowers for the Flower Farm on Scott Road and the back portion of the property will be used for his own use for organic farming. Mr. Caporaso is not expecting to bring ir fill. He will move existing material and boulders around to level. Storage of fertilizers would not exceed what it used at the Flower Farm and there will be no selling of flowers from this property. A. Koehler verified with B Donovan that Mr. Caporaso would be working more than 100 feet from wetlands and noted that an application will be submitted to the Planning & Zoning Commission for the special permit. The IWC will send a letter to the Planning & Zoning Commission indicating that the IWC has no issues with the project as presented.

Enforcements: B. Donovan updated the commission on the progress at 181 Union City Road, whereby Jeremy August stated that he is moving ahead with installation of the berm at the dam. Bill spoke with Capital Heav\ Hauling who indicated that they hope to have the berm completed with a winter cover by December 21st. Bill asked to have a silt fence put on pond side of the berm. Dr. August would like to bring in additional fill for more grading on the far left side of the property where there is an accessway to a rear house. Bill left a message for Dr. August tc file an application as the work would be within 100 feet of wetlands. Dr. August has not contacted Bill regarding ar application. S. Sackter asked if Mr. Nunes from Juggernaut Road has poured a concrete slab to relocate his shed, Bill will follow up with Mr. Nunes. Bill also stated that Larry Beausoleil had been given an "as-built" for the detention basin at the Prospect Estates Subdivision; however, there was a scribers error relative to certain elevations. Mr. Beausoleil indicated to Bill that he should have a corrected "as-built" within a day or two.

Public Hearings: None

Public Participation: Jim Kollcinaku, 22 Union City Road, was questioning a variance at 1 Old Schoolhouse Road. Bill Donovan explained that the variance would be discussed at the Zoning Board of Appeals and was not £ matter for the IWC. Mr. Lotto of 7 Williams Drive has concerns with property owners being able to dig test pits foi septic systems without approval from the IWC. A. Koehler stated that most applicants have done test pits prior tc submitting an application so that there is no duplication of process.

Land Use Inspector's Report: D. Michaud asked what can be done when an application is approved with the condition of a bond and the work is completed without a bond being in place. B. Donovan will check with the Towr Attorney to see what recourse if any should be taken.

Motion by S. Sackter, seconded by D. Michaud to adjourn at 7:55 p.m. Unanimous.
