Chairman S. Sackter called the meeting to order at 7:00 p.m. The meeting was taped. D. Michaud was seated for S. Mulhall.

Approval of Minutes:
Motion by C. Wentworth, seconded by D. Celotto to approve the minutes of the June 8, 2009 meeting as presented. 3 votes in favor/D. Michaud abstained. Motion carried.

Communications: None

Old Business:
a. Prospect Estates Subdivision. Modification to Approved Permit – Lot 5 & 6 Stream Crossing. Scott Poryanda of Connecticut Consulting Engineers, represented the applicant. Mr. Poryanda presented a revised plan identifying the location of two 24-inch drainage pipes and is proposing a plunge pool and concrete level spreader to address the commissioners concerns with increased velocity in an extreme storm event. W. Donovan has forwarded the revisions to the Town engineer and South Central Regional Water Authority for review. Comments should be received prior to the next meeting. W. Donovan reported that he noticed a tree had fallen into the stream just below the driveway crossing that in his opinion is causing the stream to divert off of its natural course. In an effort to help the Town engineer make a fair determination whether the driveway crossing is having any effect on diverting water downstream, Bill asked the commission to allow the developer to remove the tree prior to the review. The commissioners agreed that the tree should be removed, but without the use of heavy machinery. The applicant agreed to remove the tree using a chain saw and, if necessary, a winch to pull the trunk of the tree out of the stream. S. Sackter asked C. Wentworth if he had noticed any increase or decrease at the inlet at the Spreda pond located at 35 Candee Road. C. Wentworth stated that he could not determine that at this time because per the Inland Wetlands permit the contractor was to monitor the inlet of Sanford Brook at the Spreda pond for the duration of the construction of Prospect Estates, however, that monitoring only took place initially for about 5-6 weeks when they incurred a dramatic silting from upstream which later was litigated by the Spredas with Prospect Estates. C. Wentworth commented that the monitoring aspect of the permit has never been enforced and there is very little documentation from any subsequent owners of Prospect Estates. S. Sackter asked if it would be beneficial to install standpipes to monitor the water flow downstream of the driveway crossing. Mr. Poryanda indicated that it would make sense to monitor the discharge with the standpipes. D. Celotto suggested a site walk so the commissioners could have a better sense of what is taking place. A site walk was scheduled for July 6, 2009 at 4:00 p.m.

b. Review of Regulations/Fee Schedule. B. Donovan stated that he has not received any new language from. J. Kaufman regarding open space and has no additional comments at this time. A public hearing has been scheduled for August 10, 2009 at 7:15 p.m.

Enforcements:
W. Donovan stated that a third letter has been sent to Mr. Sima regarding dumping at his Sherwood Drive property stating that he needs to come before the IWC to describe what activities are taking place. If Mr. Sima doesn’t’ contact Bill within the next week or two the Town Attorney will be asked to send a letter. Mr. Nunes on Juggernaut Road has been cited and fined under the zoning regulations for violations related to a shed on his property. W. Donovan is now sending a wetlands enforcement letter. Mr. O’Rourke on Mixville Road is moving ahead with the garage and dismantling the shed that had stored paints and chemicals. There is still more to be done but he is moving in the right direction.

New Business:
a. Michael Lynch, 27 Luke Street. Proposed Shed within a regulated area. Mike Lynch was in attendance and presented his application for a shed in his back yard. A soils report dated June 17, 2009 from David Lord of Soil Resource Consultants was submitted and Mr. Lynch stated that the wetlands have been flagged. A site walk was scheduled for July 6, 2009 at 4:30 p.m. Mr. Lynch was instructed to stake the proposed location of the shed prior to the site walk. Motion by C. Wentworth, seconded by D. Michaud to accept Application #07-09 of Michael Lynch for a shed within a regulated area for property located at 27 Luke Street. Unanimous. Fees were set and paid in the amount of $140.00 and $30.00.

b. Robert & Richele Gugliotti, 92 Straitsville Road. Septic system and drainage within a regulated area. John Schieffer of Prospect Excavating presented the application for repair and replacement of existing drainage and repair of the septic system at 92 Straitsville Road. W. Donovan asked if the septic system is failing. Mr. Schieffer replied that there is a periodic problem in the Spring. W. Donovan asked if there was a health issue that would require work to be started prior to the next scheduled IWC meeting in July. Mr. Schieffer stated that there was no health issue and that he would prefer the area to be a little drier before starting the repairs. Mr. Schieffer does not see a need to begin working prior to the next meeting. A site walk was scheduled for July 6, 2009 at 5:00 p.m. Mr. Schieffer was instructed to stake out the proposed areas of repair including drainage repairs on the abutting property at 90 Straitsville Road. Motion by D. Celotto, seconded by D. Michaud to accept Application #08-09 of Robert & Richele Gugliotti for repair/replacement of a septic system and drainage for property located at 92 Straitsville Road. Unanimous. D. Michaud asked that a letter be submitted from the applicant and the property owners at 92 Straitsville Road allowing Mr. Schieffer to represent them.

Land Use Inspector’s Report:
C. Wentworth reported a deviation from the approved site plan for an added forebay at Knollwood Estates Subdivision on Candee Road. The commissioners instructed W. Donovan to ask the developer to attend the next meeting to explain the modification to the permit. C. Wentworth also noted drainage work completed by the Town on the northern side of Saddle Court and asked whether the developer would be reimbursing the Town for the work. W. Donovan explained that the work performed by the Town was within the Town’s drainage easement and therefore the developer would not be responsible to reimburse the Town.

Motion by D. Celotto, seconded by C. Wentworth to adjourn at 8:00 p.m. Unanimous.
