Chairman S. Sackter called the meeting to order at 1:00 p.m.
Bond Hearing:
a. Woodmont Estates, LLC (Summit Woods Development, LLC) –Summit Road. S. Sackter stated that the hearing was being held at the request of the Town Attorney to allow them to begin the process of calling a performance bond due to expire on March 8, 2009. Larry Farrell, principal of Woodmont Estates, LLC, was present and commented that he has had numerous discussions with Naugatuck Savings Bank, Land Use Officer Bill Donovan and the Town’s attorney regarding the bond renewal. Mr. Farrell stated that it was not his intent to allow the wetlands bond to expire but that due to circumstances beyond his control there has been a delay in rewriting the bond. According to Mr. Farrell the wetlands bond and the road bond for the development were initially combined into one bond. The two bonds have different expiration dates; consequently the bank is re-writing the bond as two separate bonds. Mr. Farrell assured the Commissioners that the bond will be secured by March 8th, that he is a man of his word and will give the Town $15,000.00 cash if necessary. The commissioners thanked Mr. Farrell for attending the hearing and stated that the actions needed to be taken were not to be construed as a reflection against him personally but to cover the Town’s position regarding the bond. Motion by C. Wentworth, seconded by S. Mulhall to call the existing $15,000.00 Inland Wetlands bond for Woodmont Estates, LLC (Summit Woods Development, LLC), Summit Road, due to expire on March 8, 2009. Unanimous.
Motion by S. Mulhall seconded by C. Wentworth to adjourn at 1:10 p.m. Unanimous.
