Chairman S. Sackter called the meeting to order at 7:00 p.m. The meeting was taped.

Approval of Minutes: Motion by C. Wentworth seconded by D. Celotto to approve the minutes of the January 26, 2009 meeting as presented. 4 votes in favor; 1 abstention. Motion Carried.

Communications:
1. Council of Governments Central Naugatuck Valley – Annual Report 2007-2008
2. Connecticut Association of Wetland Scientists - Notice of Annual Meeting
3. Connecticut Department of Environmental Protection – 2009 Municipal Inland Wetland Commissioners Training Program.

Old Business:
a. Application #01-09 – William Brundage & Brenda Nadeau, 143 Plank Road. Landscaping/tree removal within an upland review area. No discussion was held. A site walk will be scheduled at a later date when the weather breaks.

Enforcements:
a.William Brundage & Brenda Nadeau, 143 Plank Road. Activities in a regulated area without a permit. An application has been accepted for regulated activities. No action taken pending a site visit.

New Business:
a. Anthony Dorso, 30A Scott Road(20 Peter Gilkey Road). Release of bond. S. Sackter stated that he and W. Donovan had visited the site and all stabilization measures have been completed. Wetland markers have also been placed in accordance with the site plan. Motion by J. Kaufman, seconded by S. Mulhall to release the Wetlands bond for Anthony Dorso for property located at 20 Peter Gilkey Road noting that all conditions of the bond have been met. Unanimous.

b. Clover Development, LLC, Woodmont Estates (Summit Heights). Status of bond. W. Donovan stated that the Town Attorney had contacted him regarding the $15,000 Wetlands bond for Woodmont Estates. The bond is due to expire on March 8, 2009. The bank is in the process of renewing the bond and Bill stated that he expects the process will be completed prior to the expiration date. The Town Attorney, however, has asked that the IWC hold a special meeting to vote to proceed with the calling of the bond in order to allow sufficient time for the process if necessary. The commissioners agreed to set a special meeting on Wednesday, February 25, 2009 at 1:00 p.m. to discuss and take action on proceeding with the calling of the bond for Woodmont Estates.

Land Use Inspector’s Report: W. Donovan stated that he is reviewing the Inland Wetlands Regulations in order to make recommendations for updating the regulations to reflect more recent changes as allowed by State Statutes. S. Sackter asked about fill brought in at Prospect Estates. W. Donovan stated that he visited the site and felt that the quality of the fill being used did not require further investigation. The proposed ordinance allowing fines for wetlands violations has been submitted to the Town Council Ordinance Sub-committee for review. The commissioners discussed whether the initial fine amount of $750.00 should be changed to read “up to $750.00”. It was agreed that no change would be made at this time. W. Donovan reminded the Commissioners that if they are interested in attending the Municipal Inland Wetland Commissioners Training Program they need to let him know as soon as possible as the classes tend to fill up quickly.

Motion by S. Mulhall, seconded by J. Kaufman to adjourn at 7:27 p.m. Unanimous.
