Chairman Sackter called the meeting to order at 7:02 p.m. The meeting was taped.

Approval of Minutes:
Motion by L. Dixon, seconded by S. Mulhall to approve the March 22, 2010 minutes as presented. Unanimous.

Communications:
1. The Habitat Newsletter – Spring 2010;
2. Letter from the Honorable Mayor Robert Chatfield dated April 12, 2010.
3. Building Inspectors Report – March 20, 2010.

Old Business:
a. & b. John Ciola, 64 & 80-84 Scott Rd, Prospect – Land clearing in a regulated area and a wetlands crossing. Mr. Ciola addressed the commission to confirm the soil scientist had re-flagged his property and it was ready for a site walk. A site walk was scheduled to take place on Tuesday, April 27, 2010 at 6:00 p.m., wherein Mr. Ciola’s soil scientist will attend to address any questions or concerns the commission may have.

Enforcements:
Bryan & Dana Sharkey, 12 Yales Farm Lane - Earth Material Filling within a Regulated Area / Wetlands Impact. Mr. Sharkey reviewed his actions to date with regard to the Inland Wetlands Commission’s request to stabilize and maintain the area for the winter. W. Donovan previously visited the site and found Mr. Sharkey everything to be in compliance with the enforcement order. The commissioners felt Mr. Sharkey had complied with their request and released the enforcement to allow him to begin repair to said area under New Business Application #04-10. Motion by A. Dorso, seconded by S. Mulhall to release the Enforcement of Bryan & Dana Sharkey, 12 Yales Farm Lane – Earth Material Filling within a Regulated Area / Wetlands Impact, as presented. Unanimous.

New Business:
a. Application #04-10 - Bryan & Dana Sharkey, 12 Yales Farm Lane - Earth Material Filling within a Regulated Area / Wetlands Impact. Mr. Sharkey appeared before the commission to discuss his fulfillment of the enforcement and to present an application which would allow him to begin repairing and permanently stabilize the area, and to remove the sediment that washed into the wetlands area. Motion by S. Mulhall, seconded by A. Dorso to accept Application #04-10, Bryan & Dana Sharkey, 12 Yales Farm Lane – Earth Material Filling within a Regulated Area / Wetlands Impact, as presented. Unanimous.

Motion by L. Dixon, seconded by A. Dorso to add David Greer and John Lombard to the April 12, 2010 Agenda listed as new business, as presented. Unanimous.

b. Application #05-10 – David & Kelly Greer, 90 Cook Road – Portion of residential home to be within the wetland review area. Mr. Greer presented an application and map depicting the area where the porch of this residence would be approximately 180 square feet into the regulated area and approximately 88 feet from the wetlands. A site walk was previously conducted on the property in October 2008 for regulated activities associated with a proposed re-subdivision. Motion by S. Mulhall, seconded by W. Caporaso to accept Application #05-10, David Greer, 90 Cook Road – Portion of residential home to be built within wetland review area, as presented. Unanimous.

c. John Lombard – 39-41 Waterbury Road – Determination if this area is relevant to the Inland Wetlands Commission. Mr. Lombard presented maps, a soil survey and a letter from Stephen Giudice, L.S., Harry E. Cole & Son Engineering, Surveying & Planning, dated April 6, 2010. After careful review of the materials presented, the Inland Wetlands Commission determined said property was not an Inland Wetlands matter.

Motion by S. Mulhall, seconded by W. Caporaso to adjourn the meeting at 7:52 p.m. Unanimous.
