Chairman Sackter called the meeting to order at 7:00 p.m. The meeting was taped. A. Dorso was seated for D. Celotto.
Approval of Minutes:
Motion by C. Wentworth, seconded by A. Dorso to approve the December 14, 2009 minutes as amended. Unanimous.

Old Business:
a. Application #16-09 – Bryan & Dana Sharkey, 12 Yale Farms Lane - Deposition of fill materials within a regulated area. The commission did not accept this application as presented at this time. The commission felt they needed further review of the Planning and Zoning Commission findings from a meeting held on Wednesday, December 16, 2009, to consolidate instructions for correcting the problem.
Enforcements:
a. Bryan & Dana Sharkey, 12 Yale Farms Lane - Earth Material Filling within a wetland a Regulated Area/Wetlands Impact. Mr. Sharkey stated immediately following the last IW meeting he installed 7 additional silt fences, placed 50 bales of hay and 6 rolls of erosion control blankets with grass seed to the area. Mr. Sharkey stated he met with W. Donovan last week at his property to review the area. Mr. Sharkey stated he contacted “Ed The Tree Man” at W. Donovan’s suggestion with regard to obtaining wood chips to be placed in the area of the embankment that collapsed. J. Kaufman stated he visited the site on January 11, 2010, where he took photographs on his iPhone of an area that had opened up and sucked in an erosion control blanket. J. Kaufman stated he was impressed by the size and height of the noted area. J. Kaufman expressed his concerns over two silt fences that showed a gap underneath and were non-functional. J. Kaufman suggested earth and stone should be placed under the silt fence to control silt flow. A. Dorso and S. Sackter suggested the use of hay bales instead of earth, since the ground is frozen and it would wash away any loose soil placed on top. J. Kaufman asked where the water sources of the different pipes are. J. Kaufman expressed his concerns regarding water flow over the septic and leeching field areas. Mr. Sharkey stated the water flowing from the bluish-green PVC pipe runs from a catch basin and has a natural flow of water, which runs crystal clear. Mr. Sharkey stated the black corrugated pipe is in place to catch run off from the driveway, which diverts the flow from the back yard and septic and leeching field areas. Mr. Sharkey stated the white PVC pipe is from curtain drains along his home. S. Mulhall stated he visited the site and observed all the additional fences, erosion control blankets, and seeded areas. S. Mulhall stated he feels Mr. Sharkey had made every effort and complied with everything the IWC had asked him to do. He stated he observed a break in the silt fence and none of the soil went down to the creek. S. Mulhall expressed his concerns with warm, rainy days. J. Kaufman asked Mr. Sharkey to place stones in the area of the breach to prevent further erosion. Mr. Sharkey stated he would be happy to place stones in front of the silt fencing to help stabilize the area. A. Dorso asked if Mr. Sharkey’s property was more than 100’ from wetlands. C. Wentworth explained the property was in the uplands within the directives. Mr. Sharkey stated he would call W. Donovan when the stone has been placed so the commission could schedule another site walk of the property. The commission is satisfied that Mr. Sharkey had shown good faith by immediately addressing the issue. The commission received permission from Mr. Sharkey to conduct additional site walks as needed. The commission decided to keep the Cease & Restore Order file open until all work is completed and reviewed.
New Business:
a. 2010/2011 Proposed Budget. Discussion was held on the current year’s budget and expenditures to date. It was determined that all line items should remain the same for next year with the exception of adding funds to purchase medallions if needed and a reduction in the Engineering budget to $2,000.00. Meeting Clerk, $2,550.00; Supplies, $175.00; Conferences, $275.00; Engineering, $2,000.00 for a total proposed budget of $5,000.00. Motion by J. Kaufman, seconded by C. Wentworth to approve the proposed 2010/2011 Inland Wetlands budget totaling $5,000.00. Unanimous.
Public Participation:
The commission discussed the non-compliance issues at Prospect Estates. J. Kaufman asked if the IWC had a bond on this property? C. Wentworth stated that the Planning and Zoning Commission held a bond for this property. The commission expressed concerns over the drainage issues. S. Sackter requested to have W. Donovan send a letter to the Planning and Zoning Commission to express the commission’s concerns.
The commission also discussed the Baumann property located at 10 Juggernaut Road with regard to the 275-gallon oil tank, which is set along the driveway. The commission expressed concern of a lack of containment in case of fuel spillage. The commission requested to have W. Donovan send a letter to Mr. Baumann addressing these concerns.
The commission discussed the demolition of the U.S. CAP property. The commission expressed concerns of soil and water contamination in the immediate and surrounding areas.

Motion by C. Wentworth seconded by S. Mulhill to adjourn the meeting at 8:30 p.m. Unanimous.
