Chairman Sackter called the meeting to order at 7:02 p.m. The meeting was taped. L. Dixon was seated for W. Caporaso; A. Dorso was seated for D. Celotto.
Approval of Minutes:
Motion by L. Dixon, seconded by C. Wentworth to approve the May 10, 2010 minutes as amended. 4 votes approved; 2 abstained. Motion carried.

Old Business:
a. #06-10 Larry Farrell, 21R Mikayla Lane – Agricultural uses within a regulated area. The commission discussed the letter dated 5/31/10 from Christine Segala and the findings of their 5/19/10 site walk Motion by S. Mulhall, seconded by S. Sackter to acknowledge as a permitted use as of right, Larry Farrell, 21R Mikayla Lane – Agricultural uses within a regulated area. Unanimous.
b. #07-10 Jad Harb, Lots 5 & 6 Prospect Estates Subdivision – Proposed improvements to existing driveway crossing swale. Scott Poryanda of Connecticut Consulting Engineers presented maps depicting a revised plan for activities to correct existing swale area issues. Mr. Poryanda stated the current concrete level spreader would be removed and replaced with a stone level spreader. He indicated approximately 200 sq. ft – 400 sq. ft of material would need to be removed and turf reinforcement blankets would be placed within the swale. This would be followed by intermediate rip rap, 10” – 18” stones. Ronald Walters, Senior Environmental Analyst of South Central Connecticut Regional Water Authority, in a letter dated June 14, 2010, explained the level spreader is not functioning properly. Based on the site plan submitted, Mr. Walters made the following suggestions: 1. Examine the possibility of removing the concrete level spreader, as the present construction will prevent it from staying level due to frost heave; 2. The silt containment basin and intermediate rip rap should allow for disbursed flow through wetland area which is well vegetated; 3. An inspection and maintenance plan should be developed for Prospect Estates to include individual responsibility for the stormwater management system; frequency for inspections; items that require inspection and proposed maintenance. Mr. Walters suggested a report of requirements and maintenance should be submitted to the Inland Wetlands Commission or Town staff.
The Inland Wetlands Commission discussed this matter at great length and had come to an agreement with Mr. Poryanda and Mr. Harb that the following conditions would be met: 1) A certified As-Built to be supplied to Inland Wetlands Commission upon completion of project; 2) Mr. Poryanda will personally supervise all work needed to complete this swale project; 3) Engineer will provide an inspection and maintenance plan of the area to be used to monitor this area in the future to the commission; 4) Homeowner’s responsibility for all future maintenance needed in this area to be listed on deed for Lot 5; 5) Inland Wetland markers to be placed on the boundaries of Lots 5, 6 and 7; 6) 12’ timber rails to be placed over water crossing in driveway for safety purposes; 7) Conservation Easement to be recorded on the land records; 8) Swale area project to be completed no later than July 31, 2010; 9) No other work to be done on Lots 5 and 6 until crossing completed; 10) A $10,000.00 bond to be posted on the property that can be returned upon work completion to the commissioners’ satisfaction. Motion by S. Mulhall, seconded by W. Caporaso to approve Application #07-10, Jad Harb, Lots 5 & 6 Prospect Estates Subdivision – Proposed improvements to existing driveway crossing swale with conditions. 3 votes in favor; 2 votes opposed. Motion carried.
New Business:
a. Application #09-10 Town of Prospect – Porter Hill and Brookwood Court - Drainage Improvements. W. Donovan presented maps on behalf of the Town of Prospect, which depicted the areas where drainage improvements would be made with funding received under the stimulus package. The areas are within the road right of way and would involve the lowering of approximately 18” of the sub base by removing old pavement and sub base materials, which will be replaced with super pave. Motion by S. Mulhall, seconded by C. Wentworth to waive the fees for Application #09-10, The Town of Prospect – Drainage Improvements/Porter Hill and Brookwood Court, as presented. Unanimous. Motion by C. Wentworth, seconded by S. Mulhall to accept Application #09-10, The Town of Prospect – Drainage Improvements/Porter Hill and Brookwood Court, as presented. Unanimous.
b. Application #10-10 Valerie O’Donnell, South Central Regional Water Authority - Cook & Roaring Brook Roads - Timber Harvest. Valerie O’Donnell, Forester for South Central Regional Water Authority presented a map which depicted an area where a carefully supervised removal of approximately 30% - 35% of canopy trees will be selectively cut leaving the stumps in place with no soil disturbance and with the streams and wetlands remaining fully shaded and totally undisturbed. Ms. O’Donnell stated current access roads to the north and south of the area will be used for tree removal, and the work will be done by Bob Clarington of Bob’s Land Clearing. Ms. O’Donnell stated she will contact the Land Use office prior to starting work. W. Donovan will meet with Trooper Nelson to determine if signs or flaggers would be appropriate safety tools to have in place when the large trucks are exiting the access roads. Motion by A. Dorso, seconded by C. Wentworth to acknowledge as a permitted use as of right, Valerie O’Donnell, South Central Regional Water Authority – Cook and Roaring Brook Roads – Timber Harvest, as presented. Unanimous.
c. Application #08-10 Jasmin & Idira Pindzic, 99 Salem Road – Above-ground pool within a regulated area. W. Donovan stated he issued a permit as the Inland Wetlands’ Agent for this above-ground pool which will have no impact on the wetlands.
d. Application #11-10 Brian & Mary Christiano, 19 Trotters Way - In-ground pool within a wetland. Brian and Mary Christiano presented a map depicting the area where they would like to install an in-ground pool. A site walk was scheduled for Tuesday, June 22, 2010 at 7:00 p.m., with a rain date of June 23, 2010 at 7:00 p.m. Motion by S. Mulhall, seconded by C. Wentworth to accept Application #11-10, Brian & Mary Christiano, 19 Trotters Way – In-ground pool within a wetland. Unanimous.

Public Participation:
The commission discussed the property located at 120 Cheshire Road where two dump truck loads of dead sand have been deposited at the back of the driveway. W. Donovan indicated he would inspect the area.
Land Use Inspector’s Report:
W. Donovan stated he inspected the Sharkey property located at 12 Yales Farm Lane where he found the silt fencing still in place and that the area that was seeded over has naturally regenerated itself. W. Donovan also traveled to the Baumann property located at 10 Juggernaut Road, where he met with Mr. Baumann and walked the property. W. Donovan found the dug pond was smaller than originally thought. W. Donovan reviewed the permit of right with Mr. Baumann and reminded him that fill could not be brought in to the wetlands area. W. Donovan stated Mr. Baumann is working within the permitted guidelines at this time. W. Donovan sent a letter and permit to John Ciola regarding his property located at 64 & 80-84 Scott Road which requested Mr. Ciola contact him regarding the bond. Mr. Ciola had stated at a previous meeting that he would contact W. Donovan to set up a time with commission members to conduct a site walk and determine the best location to create a wetlands crossing.
