Chairman Sackter called the meeting to order at 7:00 p.m. The meeting was taped.

Communications:
1. Summer 2010 The Habitat, a newsletter of the Conservation and Inland Wetlands Commissions, Inc.

L. Dixon was seated for S. Mulhall.

Approval of Minutes:
Motion by C. Wentworth, seconded by L. Dixon to approve the June 28, 2010 minutes as amended. 3 votes approved; 2 abstained. Motion carried.

Old Business:
a. #07-10 Jad Harb, Lots 5 & 6 Prospect Estates Subdivision – Proposed “As-Built” wetlands driveway crossing swale. Scott Poryanda of Connecticut Consulting Engineers presented a map depicted on “As-Built Wetlands Driveway Crossing Swale prepared for Harb Developers, LLC, Prospect Estates dated 08/06/10. Mr. Poryanda also presented the commissioners with a proposed Inspection/Maintenance Plan for Lots #5 and #6 Saddle Court, Prospect, CT. Mr. Poryanda stated the Harb’s are still working on completing all of the previously agreed upon conditions surrounding this property. S. Sackter stated he would present Ronald Walters, Senior Environmental Analyst of South Central Connecticut Regional Water Authority, a copy of the presented “As-Built” map for his review.

Public Participation:
The Inland Wetlands Commissioners expressed concern regarding the process of permits being granted by the commission. The commission would like Attorney Yoxall to assist with the appropriate verbiage required when changes or amendments to minutes would subsequently reflect on previously granted permits.

The Inland Wetlands Commission also discussed the option to review a copy of the Open Space changes made in January 2010 to the Planning and Zoning regulations, and also a copy of the Land Conservation and Development booklet.

C. Wentworth expressed his concerns regarding a heavy rainstorm, which occurred on July 19, 2010, at approximately 1:00 pm and caused substantial silting at the Wentworth Pond on 35 Candee Road. C. Wentworth provided photographs for the Inland Wetlands Commission to review. C. Wentworth was joined by S. Sackter and W. Donovan, where the area was investigated and it was determined the materials came from a recently seeded lawn, which had no hay and had not yet germinated. The property located at 201 Cooke Road is currently owned by Jones and is part of the Harb Development. W. Donovan contacted both parties as part of his investigation and was told by Mr. Harb that the Jones’s refused to close on their property until the silt fencing and hay were removed for aesthetic purposes. The commissioners will wait to hear W. Donovan’s report on this issue.

Motion by C. Wentworth, seconded by L. Dixon to adjourn the meeting at 7:58 p.m. Unanimous.
