Chairman Sackter called the meeting to order at 7:00 p.m. The meeting was taped. A. Dorso was seated for J. Kaufman.

Approval of Minutes:
Motion by C. Wentworth, seconded by S. Mulhall to approve the January 11, 2010 minutes as presented. Unanimous.

Communications:
1. CT Association of Wetland Scientists – Notice of Annual Meeting on February 23, 2010
2. Prospect Water Pollution Control Authority – Notice of Workshop for Development of Wastewater Facilities Plan on January 25, 2010
3. Prospect Estates, Larry Beausoliel, Agent – Letter dated January 25, 2010 – Requesting a one-year extension of time on the Wetlands Permit.

New Business:
a. John Ciola, 64 & 80-84 Scott Rd, Prospect – Land clearing in a regulated area and a wetlands crossing. Mr. Ciola and Scott Poryanda of Connecticut Consulting Engineers, presented a plan proposing the removal of trees within 25’ of a wetlands to create a tree farm for Christmas trees and nursery stock. Photographs and maps were presented. Motion by D. Celotto, seconded by S. Mulhall to accept Application #01-10, John Ciola, 80-84 Scott Road, and Application #02-10, John Ciola, 64 Scott Road, as presented. Unanimous. A site walk was scheduled for Saturday, February 13, 2010 at 9:00 am.

b. Jad Harb, Lots 5, 6 & 7 Prospect Estates, Prospect – Request for Extension of Inland Wetlands permit for Lot 5: septic, house and driveway crossing; Lot 6: house and driveway crossing, and the placement of wetlands boundary markers for Lots 5, 6 & 7. Mr. Harb requested an extension pertaining to work still needing completion on his 3 lots. The Inland Wetlands Commission discussed the driveway crossing and level spreader issues which have not been corrected to date. The commission granted Mr. Harb an extension of his Inland Wetlands Permit with the condition that no further approved regulated activities will be permitted until the level spreader matter is resolved to the commission’s satisfaction. Mr. Harb will meet with William Donovan, Land Use Inspector, to review the list of directives outlining the work needing to be done. Motion by S. Mulhall, seconded by D. Celotto to grant an extension of the Inland Wetlands Permit for John Harb, Lot 5, Lot 6 and Lot 7 of Prospect Estates, until April 30, 2010, with the condition that no further approved regulated activities will be permitted until the level spreader matter is resolved to the commission’s satisfaction and Mr. Harb complies with a list of directives to correct the area to be provided by the Town Engineer and William Donovan, Land Use Inspector by February 22, 2010. Unanimous.
