Others Present: William Donovan Land Use Inspector, Wendy Boroski - Clerk

Chairman Sackter called the meeting to order at 7:01 p.m. The meeting was taped. A. Dorso was seated for vacated seat. L. Dixon was seated for S. Mulhall.

Approval of Minutes:
Motion by L. Dixon, seconded by C. Wentworth to approve the January 10, 2011 minutes, as presented. 5 votes in favor/1 vote abstain. Motion carried. Motion by L. Dixon, seconded by C. Wentworth to approve the January 24, 2011 minutes, as presented. Unanimous.

Communications:
1. Building Inspector’s Report – January 2011;
2. Connecticut Siting Council’s Notice of Public Hearing re: Petition No. 980 of BNE Energy, Inc. for proposed wind turbines at 178 New Haven Road;
3. Timothy Reilly, Save Prospect Corp. – letter dated 1/24/11 re: Requested for Consideration of Wetlands Setbacks – Wind Power Regulations;
4. River Alliance of Connecticut – Notice of Naugatuck River Forum.

New Business:
a. Application #01-11 TSC Properties, LLC, 170 Scott Road – Construction of a Commercial Building within a Regulated Area. Ronald George, Engineer and Land Surveyor of CCA, LLC, appeared on behalf of TSC Properties, LLC, where he presented a map depicting the proposed area where the commercial building would be built. Mr. George will contact W. Donovan to schedule a site walk once the proposed area has been flagged and the weather conditions permit the commissioners to view the wetlands area without too much snow coverage. Motion by A. Dorso, seconded by L. Dixon to accept Application #01-11, TSC Properties, LLC, 170 Scott Road – Construction of a commercial building within a regulated area. Unanimous.

b. Summit Woods Development, LLC, Mikayla Lane. Discussion on expiration of wetlands bond. Bond received, no action taken.

Old Business:
a. Regulations Review. W. Donovan and G. Gruber submitted proposed changes to the commissioners for review. S. Sackter requested all the commissioners to review the regulations and submit their proposed changes to W. Donovan by March 31, 2011, so they may be combined into one master list to be reviewed by the commissioners at the first meeting in April.

Enforcements:
The commission has been independently monitoring John Ciola, 64 & 80 Scott Road, with regard to work being done on the property as the warmer weather is thawing the ground. As of Monday, February 14, 2011, there appeared to be no further activity on the property.

Public Participation: None.

Land Use Inspector’s Report:
W. Donovan outlined the letter which was sent behalf of the Inland Wetlands commission to the Connecticut Siting Council regarding the wind turbine project.

Motion by L. Dixon, seconded by W. Caporaso to adjourn the meeting at 8:04 p.m. Unanimous.
