In the absence of Chairman Hiscox, Gil Graveline called the meeting to order at 7:02 p.m. The meeting was taped.

Approval of Minutes: Motion by A. Havican, seconded by J. Lehner to approve minutes of the 7/5/00 meeting as presented. Unanimous.

Motion by D. Pomeroy, seconded by A. Havican to accept the correspondence. Unanimous.

Old Business:
a. Jack L. Crumb, 129 Union City Road. Application for Zone Change from Industrial to General Commercial. The public hearing on this application was closed at the July 5, 2000 meeting. The Commissioners discussed the issues presented at the public hearing. No action was taken on this application.
b. Vincent LoRusso, 72-74 Waterbury Road. Site Plan Application for Car Dealership. This application was accepted at the July 5, 2000 meeting. Terry Meyers, Meyers Associates, P.C., presented a revised site plan map, showing the location inside the building for a waste oil tank and painting booth, as well as the location outside of the building for proposed canopies and a dumpster pad with a cedar fence enclosure. There are no existing floor drains in the building and the applicant is not proposing any floor drains. Vincent Lorusso, agent for John Barlow, presented a statement of proposed use for the property. G. Graveline read the statement dated July 19, 2000, signed by William J. LoRusso, stating the intended use of 72-74 Waterbury Road. A letter in support of this application dated July 17, 2000 from Peter Hughes, Chairman of the Prospect Economic Development Commission, was read as well as a legal opinion from the Town Attorney on the authority and/or responsibility of the Planning & Zoning Commission regarding deed restrictions. D. Wallace questioned the applicant regarding the total number of vehicles in the rental fleet and the parking availability on the property overall, including the fact that the rear parking area would be used by postal service employees. Mr. Meyers explained there was sufficient parking area being proposed with a total number of 32 spaces designated on the site plan. Robert Skrip, 106 Cheshire Road, spoke in favor of the application, stating that all new businesses are watched and monitored closely by the D.E.P. He stated he has worked with the applicants in conjunction with his own business, and knows them to be reputable businessmen. Marie Della Bella, 8 Orchard Drive, asked what the hours of operation would be and also adamantly stated that #74 Waterbury Road is now and always has been zoned Residential. She urged the Commissioners to review the land records carefully before approving this application. Bonnie Davis, 6 Orchard Drive, questioned the need for a spray booth in the building. Mr. LoRusso explained that even a small scratch repair in the paint on a vehicle requires a spray booth. He also stated that the hours of operation would be Monday through Friday, 8:00 a.m. to 5:00 p.m. and a half-day on Saturdays. Business would not be conducted on Sundays or holidays. G. Graveline noted that B. Donovan would be asked to provide a draft motion of approval for the next meeting.
c. Paint Ball Adventure Games, 54A Talmadge Hill Road. Amendment to "Motion of Approval." This application was accepted at the July 5, 2000 meeting. A letter dated July 14, 2000 from Paul J. Schieffer was submitted giving permission for Peter DaDonna to make permit applications for the business operations of Paint Ball Adventure Games on property located at 54A Talmadge Hill Road. Mr. DaDonna was not in attendance. No action was taken on this application.

New Business:
a. Michael Modine, 52 Waterbury Road. Change of Commercial Use – Sandwich Shop. A letter from Christopher & Anna Keeler, owners of 52 Waterbury Road, was submitted asking the Commission to allow representatives of Subway to present an application for a sandwich shop. Michael Modine of Subway presented an interior site plan map and a parking calculation plan. Sufficient parking would be available for each of the existing businesses as well as the proposed sandwich shop. Chesprocott has given their approval. A 14" x 42" sign would be put on the existing sign pole. Hours of operation would be 10:00 a.m. to 10:00 p.m., Sunday through Saturday. G. Graveline asked that the applicants speak to the property owners to see whether it wouldn’t be advantageous to put curbing in front of the parking spaces facing Route 69 to prohibit vehicles from rolling into moving traffic. Motion by D. Pomeroy, seconded by A. Havican to accept and approve the application for a change in use at 52 Waterbury Road for a sandwich shop. Unanimous.
Land Use Inspector’s Report: None
Public Participation: Harry Rich, 2 Spruce Drive, stated that a 15’ x 7 1/2’ portable building has been placed too close to his property by his neighbor at 4 Spruce Drive. B. Donovan has been made aware of the problem and has spoken with the owner but, according to Mr. Rich, no action has been taken to move this building. The Commissioners noted that B. Donovan would be instructed to enforce the zoning regulations and take any necessary action to correct this problem.
Motion by J. Lehner, seconded by D. Pomeroy to adjourn at 8:36 p.m. Unanimous.
