Approval of Minutes: Motion by A. Havican, seconded by D. Pomeroy to approve minutes of the June 6, 2001 meeting as presented. Unanimous.
Correspondence:
Motion by G. Graveline, seconded by A. Havican to pay the above-referenced invoice for $4,900.00 from Harrall-Michalowski Associates. Unanimous.

b. Domenico & Franca DiLoreto, 20 Union City Road. Application to amend Sections 210 & 300 of the Zoning Regulations to include Auto/Motor Vehicle Repair & Maintenance and Commercial Towing Operations/Business as permitted uses within a General Commercial zone. Edward DiLoreto and Attorney Michael Broderick III are authorized agents for this application. The Commissioners questioned the wording in the definitions presented and requested more definitive descriptions to elminate any vagueness or uncertainty as to what exactly the application is requesting be allowed. Motion by D. Pomeroy, seconded by G. Graveline to accept the application of Domenico & Franco DiLoreto to amend Sections 210 and 300 of the Zoning Regulations and permit Auto/Motor Vehicle Repair and Commercial Towing Operations within a General Commercial zone. Unanimous. A Public Hearing for this application is scheduled for July 18th at 7:30 pm.
c. Crumb Realty, 7 Grammar Avenue. Application for a Nursery School/Day Care Facility at 129 Union City Road (Lot 5 Prospect Industrial Park). Jim Kulpa of Milone & MacBroom Engineering and James Crumb addressed the commission as authorized agents for this application. Darren Overton of Milone & MacBroom also added to the presentation. Mr. Kulpa explained the proposal is for a child care facility with a projected maximum capacity of 70 children and 15 employees. Normal operating hours would be from 6:30 a.m. to 6:30 p.m. Mr. Kulpa described the facility as a one-story structure with 17 available parking spaces that include 2 handicapped spaces. There will be one common entrance/exit driveway onto Route 68. An outside play area will be located in the rear of the building and over the designated septic area. The parcel is boundary and industrial/residential north of Route 68. The commissioner's immediate concern with the plan as presented was the limited parking and drop-off area and the consequent potential of backing up customer cars on Route 68 that are attempting to drop off or pick up children. Another related concern with limited parking or site access is the potential interference or blocking off of fire or other emergency vehicles. The applicant's engineer related they have reviewed the site plan with the Prospect Fire Marshall who was satisfied with the site layout. The applicant also related that upon approval of the plan by Planning & Zoning, the authorizing State agencies would design the required outside play area. Chairman Hiscox stated the play area must be shown on the site plan to be considered approved by the Commission. Another issue discussed has been the history of water runoff from this parcel flowing off site and onto downstream properties. Mr. Kulpa and Mr. Overton detailed their proposed storm water management plan to address storm water runoff and of site drainage. The plan as presented shows drainage being directed off site and onto the abutting Industrial property. G. Graveline queried whether there is a drainage easement over this abutting property. James Crumb mentioned he also owns the abutting property in question, and would place the necessary drainage easement on the land records. Other questions addressed the Town's drainage facilities that also discharge to the abutting Industrial parcel and whether additional water volume could create an overflow condition. It was decided that a site walk, where the Assistant Director of Public Works would be requested to attend, review, among other issues, the description and function of existing town storm water facilities and any potential impact from the proposed storm water design. The Commission also requested that the applicant present at the August 1st meeting an interior plan of the building, a description of the operation including hours of operation, shift changes, etc., traffic flow patterns, comparisons to other day care facilities of similar size and compliance with State guidelines for minimum building size. Motion by A. Havican, seconded by G. Graveline to accept application of Crumb Realty for a proposed Nursery School/Day Care Facility at Lot 5 Industrail Park (129 Union City Road). Unanimous. Motion by G. Graveline, seconded by A. Havican to set a Site Walk for Monday, July 16, 2001 at 6:00 p.m. Unanimous.
Land Use Inspector's Report: B. Donovan presented a graph presentation of comparative subdivision application fees charged by the various towns within the Lower Naugatuck Valley Region for a hypothetical subdiviosn. The study indicated that, depending upon the individual Town, a like project could result in assessed fees differing by thousands of dollars. Bill also reminded the Commissioners to review Sections 3-5 of the Draft Plan of Conservation and Development before our next meeting on July 18th that will include a Public Meeting and presentations by HMA Associates who are preparing the Plan of Development for the Town. Motion to accept the Land Use Inspector's Report by G. Gravline, seconded by A. Havican. Unanimous.
