Chairman R. Hiscox called the meeting to order at 7:00 p.m. The meeting was taped.
Approval of Minutes: Motion by A. Havican, seconded by T. Galvin to approve the minutes of the August 7, 2002 meeting as amended. Unanimous.
Correspondence:
Motion by D. Pomeroy, seconded by T. Galvin to accept the correspondence. Unanimous.

Land Use Inspector's Report: Bill Donovan reported that he has been contacted by Cathy Christiano who would like to amend the Resolution of Approval for her Home Occupation which allows her to see 2 clients every hour and a half, with a maximum of eight clients per day, to read "or one client every hour between 8:00 a.m. and 5:00 p.m., not to exceed eight clients per day". Chairman Hiscox stated that with the volatility of the situation in that neighborhood regarding Mrs. Christiano's Home Occupation Permit, the Commission needs to proceed with caution regarding any changes made to the Resolution of Approval. It was agreed by Bill and the Commission that Mrs. Christiano should come before the board so they can have her on record to explain exactly how she would like the Resolution of Approval amended. Bill presented the Commission with a copy of a letter from Kenneth Skov, Water Superintendant of the City of Waterbury, to the Council of Governments, Central Naugatuck Valley stating that the City of Waterbury may be interested in selling 160 acres of land known as Prospect Resevoir #2 and 60 acres of land on East Mountain. The Commission asked that Bill bring this information to the attention of the Land Trust Committee and the Town Council's Land Acquisition Subcommittee. Bill will be meeting August 22, 2002 with Dick Harrell of H.M.A. to discuss preliminary ideas for revisions to the Regulations. Bill will be looking for input from the Commission as well as other members of the town's various councils and committees who have to deal with the Regulations. Most of the drafting will be done in "workshop" manner, however public meetings will be held before any final changes are made. Chairman Hiscox reminded the Commission that there is a proposed ordinance change being drafted to impose fines on individuals who do not comply with the Regulations. Bill also reported that Chris Keeler, owner of Prospect Pools, came in to discuss the Cease and Desist Order that was issued to them. Chairman Hiscox requested that Bill send a second letter to residents who have temporary garages on their property. Also, for Bill to look into 19 Bayberry and the back of 27 Juggernaut, as it appears there is equipment for tree service businesses being stored on those properties which is in violation of the Regulations. There are also dump trucks being parked at two home locations on Matthew Street. Bill also needs to contact Dunkin' Donuts and Texaco regarding additional signage. Motion by T. Galvin, seconded by A. Havican to accept the Land Use Inspector's Report. Unanimous.
Public Hearings:
a. Edward J. Hankey & Jane Valetkevich, 189 Straitsville Road. Application for an 8-lot Subdivision at 200 Coachlight Circle. The public hearing was opened at 7:20 p.m. Robert Cole of Harry Cole & Sons presented the Commission with a revised site plan map showing the changes made to satisfy the suggestions of David Carson on OCC Design Consortium, L.L.C. regarding seeding, grading and an increase in drainage easement. Chairman Hiscox mentioned that the Land Trust Committee should be contacted regarding taking over the proposed Open Space Access Strip. The hearing was then open for public comment. Michael Learned, 28 Coachlight Circle, expressed concerns. Chairman Hiscox read into record a petition presented by Mr. Learned with fifty six signatures of people who oppose the application for the subdivision. Chairman Hiscox also read into record a letter from Robert Amantea of Design Development Group who expressed concerns regarding the proposed subdivision. The applicants were told to bring this application before the Wetlands Commission as a courtesy. The public hearing was continued to September 4, 2002 at 7:15 p.m.
b. Robert S. Pinto, 35 Union City Road. Application for a Special Permit & Site Plan for Auto Sales & Service for Property Located at 30 Union City Road. The public hearing was opened at 7:45 p.m. There were no comments from the public. Motion by D. Pomeroy, seconded by A. Havican to close the public hearing. Unanimous. Commissioners reviewed the Draft Resolution of Approval for this application. Motion by D. Pomeroy, seconded by A. Havican to approve the Resolution of Approval as presented for Robert S. Pinto for a Special Permit & Site Plan for an Auto Sales & Service Area & Store for property located at 30 Union City Road. Unanimous.
New Business:
a. Paul J. Schieffer, Inc., 21 Apple Hill Drive. Application for a two year extension on the Congregate Elderly Housing Zone for property owned by Paul J. Schieffer, Inc. located at 54A Talmadge Hill Road. Motion by D. Pomeroy, seconded by T. Galvin to approve a two year zone extension for Congregate Elderly Housing at property owned by Paul J. Schieffer, Inc. located at 54A Talmadge Hill Road with all stipulations from previous meeting pertaining to the use and development of the property to remain in effect.

Chairman Hiscox asked all Commissioners to come in with a list of changes they would like to see included in the Zoning Regulations. Discussion on these proposed changes will begin at the next meeting.
