Acting Chairman G. Graveline called the meeting to order a 7:09 p.m. The meeting was taped. A. Delelle was seated for R. Hiscox.

Approval of Minutes: Motion by T. Galvin, seconded by D. Pomeroy to approve the minutes of the July 17, 2002 meeting as amended. Unanimous. Motion by T. Galvin, seconded by D. pomeroy to approve the minutes of the July 25, 2002 Special Meeting as presented. Unanimous.

Correspondence:

Motion by T. Galvin, seconded by A. Havican to accept the correspondence. Unanimous.

Public Hearings:
a. Edward J. Hankey & Jane Valetkevich, 189 Straitsville Road. Application for an 8-lot Subdivision at 200 Coachlight Circle. The public hearing was opened at 7:18 p.m. Stephen Guidice of Harry Cole & Sons presented the Commission with a letter from soil scientist Cynthia Rabinowicz stating that the wetlands she observed are 10-15 feet away from the corner of the lot, as well as a copy of the letter sent to the South Central Regional Water Authority. Mr. Guidice explained revisions made to the site plan map with regards to the road drainage and runoff, stating there would be no drainage or runoff to Coachlight Circle because he changed the grade of the road to be the same as that of Coachlight Circle. He also stated he is working on putting a detention basin in the back of Lot 6. Gil Graveline read into the record a letter from Attorney Douglas Royce of Carmody & Torrence. Mr. Guidice stated it is intended to be a temporary Cul de Sac. Gil Graveline read into the record a letter from Mr. Guidice requesting a thirty five day extension of the public hearing. There were no comments from the public. The public hearing was continued to August 21, 2002 at 7:15 p.m.

b. Robert S. Pinto, 35 Union City Road. Application for a Special Permit for Auto Sales & Service for Property Located at 30 Union City Road. The public hearing was opened at 7:45 p.m. Gil Graveline read the Notice of Public Hearing as it appeared in the Waterbury Republican. Robert Pinto presented a site plan map showing 15 parking spaces, including one handicapped space. He also pointed out the loading area to the rear of the building and a waterproof concrete slab and block to contain a 275 gallon tank for disposing of oil and other hazardous materials obtained when servicing vehicles. Mr. Pinto stated he does not plan to make any changes to the outside lighting and he intends to replace the sign that is currently in front of the property. Bill Donovan will draft a Resolution of Approval for the next meeting. There were no comments from the public. The public hearing was continued to August 21, 2002 at 7:45 p.m.

New Business: None

Land Use Inspector's Report: Bill Donovan stated that the court ruled in the Town's favor regarding limitation on the number of clients for the Christiano Home Occupation on Platt Drive. Mrs. Christiano has since asked Bill if she could change her Resolution of Approval to see one client per hour without exceeding the maximum of eight clients per day. This change would only require an amendment to the current Resolution. Bill has issued a Cease and Desist Order, by certified mail to Chris and Anna Keeler for continued accessory commercial use of their residential property on Nancy Mae Avenue. As of this meeting, the certified letter has not been delivered. The Commission advised Bill to have the Sheriff serve the Keelers with the Cease and Desist Order. Bill also sent letters to the owners of 87-89 Union City Road regarding junk cars on their property. Bill mentioned that the Town Council is working to create a Town Ordinance that would allow the Zoning Enforcement Officer to impose a $150.00 fine for continued violations of zoning regulations. Bill will be meeting with Dick Harrell of HMA Associates on August 22, 2002 to discuss updating the zoning regulations. Bill asked the commissioners to please begin to make notes on any of the regulations that they believe needs to be reviewed. Motion by A. Havican, seconded by T. Galvin to accept the Land Use Inspector's Report. Unanimous.
