Acting Chairman G. Graveline called the meeting to order at 7:05 p.m. The meeting was taped.
A. Delelle was seated for R. Hiscox.
Approval of Minutes: Motion by A. Havican, seconded by T. Galvin to approve the minutes
of the July 3, 2002 meeting as amended. Unanimous.
Correspondence:
- Invoice dated July 12, 2002 from OCC Design Consortium, LLC in the amount of $337.50 for
review of Hankey Estates subdivision.
- Letter from Wallingford Department of Public Utilities, Water & Sewer Divisions, offering
a copy of the approved water supply plan.
Motion by A. Havican, seconded by D. Pomeroy to accept the correspondence. Unanimous.
Motion by D. Pomeroy, seconded by T. Galvin to pay the invoice from OCC Design Consortium, LLC,
in the amount of $337.50. Unanimous.
Public Participation: None
Old Business:
a. Domenic & Franca DiLoreto, 1 Old Schoolhouse Road. Application for a Special Permit
for an Auto & Truck Sales Area. The Commissioners reviewed the Draft Resolution and discussed
the clarifications made with regards to the number of vehicles that are allowed to be on display
during business hours. Board members reviewed Section 540.8 of the Zoning Regulations and found
this approval to be in compliance with the Regulations. Motion by D. Pomeroy, seonded by
T. Galvin to approve the Resolution of Approval as presented for Franca & Domenic DiLoreto for a
Special Permit for an Auot & Truck Sales Area as it satisfies the criteria set forth in Section
540.8 of the Regulations. Unanimous.
Public Hearings:
a. Edward J. Hankey & Jane Valetkevich, 189 Straitsville Road. Application for an 8-
Lot Subdivision at 200 Coachlight Circle. The public hearing was opened at 7:19 p.m. G.
Graveline read the legal notice as it appeared in the Waterbury Republican. G. Graveline read
some of the comments submitted by David Carson of OCC Design Consortium, LLC, and noted that the
complete findings are on file and can be reviewed. Stephen Guidice of Harry & Cole & Sons
represented applicant Edward Hankey and presented the Commission with an "Agent For" letter, as
well as a letter from Chesprocott with regards to issues that still need to be addressed. Mr.
Guidice presented a site plan map for the Hankey Estates subdivision. Mr. Guidice is in receipt
of the letter from OCC Design Consortium, LLC, as Prospect's reviewing engineer for this project
and plans to address the concerns raised by them as well as by Bill Donovan and Chesprocott. Bill
Donovan noted that protocol is for a final review to be done by OCC when the Commissions feels
their concerns have been satisfied. The hearing was then opened for public comment. Vincent
Corsino, of Ace Development, 250 Straitsville Road submitted a letter to the Commission addressing
some of his concerns. Ronald Jennings, 31 Coachlight Circle, expressed concerns. The public
hearing was continued to August 7, 2002 at 7:15 p.m.
New Business:
a. Robert S. Pinto, 35 Union City Road. Application for a Special Permit for Auto
Sales & Service for property located at 30 Union City Road. G. Graveline read the application
into the record. Mr. Pinto presented an "agent for" letter from Eugene Ober, the owner of 30 Union
City Road. Mr. Pinto also presented a letter from the Fire Marshall and from Chesprocott Health
District stating they had no concerns with Mr. Pinto operating his proposed business from this site.
Mr. Pinto further stated that the cars that are there to be served will be parked in the rear and
is is very rare that a serviced vehicle would remain on the property overnight. He expects to
have only three employees, including himself. G. Graveline read the letters from the Fire Marshall
and Chesprocott Health District into the record and asked if Mr. Pinto was required to go before
the Zoning Board of Appeals as part of the State licensing requirements. Mr. Pinto stated that
he was required to do so. Motion by D. pomeroy, seconded by T. Galvin to accept the application
for a Special Permit for Auto Sales & Service submitted by Robert S. Pinto and set a public hearing
for August 7, 2002 at 7:45 p.m. Unaimous.
Land Use Inspector's Report: Bill Donovan stated that a meeting with HMA, Inc., to review
the Zoning Regulations has tentatively been set for September 19, 2002. He recommened the Commissioners
review the Regulations to see what they feel should be revised. He also encouraged the input of
developers and engineers. Bill also stated that he has had some inquires from developers in Long
Island who may possibly be looking to propose a cluster development on Talmagde Hill Road that is
currently occupied by Prospect Paintball Adventure Games. He stated that the owners originally had
a 5-year period in which to receive approval from Planning & Zoning for a Congregate Elderly
Housing Development and were granted an additional 5 years which expires in October, 2002. Bill
also reported that the former machine shop on Route 69 Waterbury Road in a residential zone has a
new owner who is planning to revitalize the commercial use of the building. Bill mentioned that it
will have to be decided if the commercial use has been abandoned or subject to the non-use clause.
Motion by A. Havican, seconded by D. pomeroy to accpet the Land Use Inspector's Report.
