Chairman R. Hiscox called the meeting to order at 7:07 p.m. The meeting was taped. F.
Carpentier was seated for A. Havican.
Approval of Minutes: Motion by G. Graveline, seconded by F. Carpentier to approve
the minutes of the June 19, 2002 meeting as presented. Unanimous.
Correspondence:
- Invoice dated June 28, 2002 from Harrall-Michalowski Assoc., Inc. for the Plan of
Conservation and Development.
- University of Connecticut Cooperative Extension System Newsletter.
- Approved minutes dated May 28, 2002 of Zoning Board of Appeals.
- 2002 Business Address of Licensed Members of the Connecticut Chapter - American
Society of Landscape Architects dated June 27, 2002.
- "Protecting the Quinnipiac River Watershed: An Exploration of Present and Future Local
Land Use Regulations" from Yale University School of Forestry and Environmental Studies.
Motion by F. Carpentier, seconded by G. Graveline to accept the correspondence.
Unanimous. Motion by G. Graveline, seconded by F. Carpentier to pay the invoice from
HMA, Inc., in the amount of $2,000.00 Unanimous.
Public Participation: Tony Augelli, 106 Clark Hill Road, inquired about the skate
park supposedly being proposed on Center Street. Chairman Hiscox stated that no application
has been submitted to the Planning & Zoning Commission for a proposed skate park.
New Business:
b. Peter Daddona d.b.a. Paint Ball Adventure Games, 54A Talmadge Hill Road.
Application for Annual Renewal of Special Permit for "Paint Ball Adventure Games".
Chairman Hiscox explained that the application before the Commission is a renewal of
a Special Permit with no charges from the previos year. Chairman Hiscox noted that
there have been no concerns brought before the Commission regarding the activities allowed
for under the Special Permit. It was recommended that the permit be extended for a 1-year
period to February 2003 as there have been no complaints or changes to the activities.
G. Graveline asked about the new use, "Speed Ball" that was included in the previous
approval. Peter Daddona explained that "Speed Ba;;" would be put in use soon. B. Donovan
mentioned a recent concern of the Public Works Department with dirt bikes in the area
due to the close proximity of Caplan Park and asked Mr. Daddona to notify the proper
authorities if he notices dirt bikes on the property used by Paint Ball Adventure Games.
Motion by G. Graveline, seconded by F. Carpentier to accept and approve the application
for annual renewal of Special Permit for Paint BAll Adventure Games for a 1-year period
to February 2003. Unanimous.
Public Hearings:
a. Tesco Rentals, LLC, 155 Union City Road. Application for a Special Permit for
an Indoor Golf and Sports Complex. The public hearing was continued from May 15, 2002 and
opened at 7:17 p.m. Chairman Hiscox read a letter dated July 2, 2002 from Hank Berberat of
Tesco Rentals, LLC, stating that he is withdrawing the application for a Special Permit without
prejudice, noting that if a new application is submitted, it was agreed that all fees would be
waived. Chairman Hiscox clarified that fees for a new application would be waived only if the
new application was for another indoor sports facility. The application was withdrawn.
Old Business:
a. Domenic & Franca DiLoreto, 1 Old Schoolhouse Road. Application for a Special
Permit for an Auto & Truck Sales Area. The public hearing on this application was closed
on June 5, 2002. Chairman Hiscox noted that B. Donovan had drafted a Resolution of Approval
for the Commissioners to review and suggested that a vote on the Resolution be held at the
next meeting in order to allow all of the Commissioners to review the Resolution before voting.
The Commissioners reiterated that there is to be no outside storage of vehicles. The Zoning
Board of Appeals has approved the location for an auto dealership and Mr. DiLoreto has applied
to the State of Connecticut for the dealership license. The Commissioners discussed the number
of vehicles that may be displayed outside for sale, with the intent to strictly limit outside
display to preserve the residential atmosphere of this area. B. Donovan asked for clarification
on Item #7. It was noted that on a day to day basis, one truck would be allowed outside for
display. If a customer was on site to look at more than one vehicle, the additional vehicles
could be parked outside temporarily until the customer left the premises. All repairs would
be performed indoors. Discussion on the application would be carried to the next meeting.
New Business:
a. Edward J. Hankey and Jane Veletkevich, 189 Straitsville Road. Application for an
8-Lot Subdivision at 200 Coachlight Circle. Stephen Guidice of Harry Cole & Son represented
the applicants and briefly reviewed the application. There are 20 acres of land owned by Edward
Hankey & Jane Valetkevitch remaining from the Tradition Estates Subdivision. Mr. Hankey is
proposing an 8-lot subdivision for 10 acres of the remaining 20. The lots will be serviced
by private wells and septic systems. Chesprocott has reviewed the subdivision plan. A soil
scientist will be reviewing the plan to determine if Inland Wetlands approval is required.
Chairman Hiscox asked for a map showing the relationship of this proposed subdivision to the
College Farms Subdivision in order to provide an overall picture of the area. Chairman Hiscox
also asked that a letter be submitted for the record naming Mr. Guidice as agent for the
property owners for this application. Motion by F. Carpentier, seconded by G. Graveline to
accept the application for an 8-lot subdivision, Hankey Estates, 200 Coachlight Circle and
set a public hearing for July 17, 2002 at 7:15 p.m. Unanimous.
c. Edward Brasche, 28 Clark Hill Road. Application for a Home Occupation Permit
- Tree Service. Chairman Hiscox read a letter from Frances Newcomb, the owner of property
located at 28 Clark Hill Road, appointing Edward Brasche as agent for presenting this
application. Mr. Brasche was not in attendance. Bill Donovan stated that the application
indicates that (1) F350 pickup truck would be stored at 28 Clark Hill Road. All other vehicles
that will be utilized for this home occupation will be stored at Prospect Self-Storage on
Industrial Road. Bill spoke with Mr. Battiste of Prospect Self-Storage and confirmed that Mr.
Brasche is due to sign a contract for storage of his vehicles. Motion by G. Graveline,
seconded by F. Carpentier to accept and approve as presented an application for a Home
Occupation Permit at 28 Clark Hill Road for a tree service. Unanimous.
Land Use Inspector's Report: Bill Donovan submitted a recommendation signed by
Bill Donovan and Gene McCarthy, Assistant Director of Public Works, for a bond reduction
for the self-storage facility at 38 Industrial Road. Motion by G. Graveline, seconded by
F. Carpentier to approve the reduction of the original bond amount of $70,000.00 to $24,000.00
for the self-storage facilities at 38 Industrial Road. Unanimous. Bill reported that
"Grandma's Place" is about set to open. A Certificate of Zoning Compliance was issued.
Bill also reported that the City of Waterbury has approved the contract for the sewer
connection for the medical facility on Route 69. Bill stated that Diane Lauber will soon
be resigning as Planning and Zoning Clerk and Diane introduced her sister, Anne Marie Burr,
who will be replacing her. F. Carpentier mentioned that there are multiple signs on the
premises of Curtis Water Gardens on Union City Road and asked whether they are allowed.
Bill will look into the matter. Motion by F. Carpentier, seconded by G. Graveline to accept
the Land Use Inspector's Report. Unanimous.
