Chairman Robert Hiscox called the meeting to order at 7:00 p.m. The meeting was taped. F. Carpentier was seated for G. Graveline.

Approval of Minutes: Motion by T. Galvin, seconded by A. Havican to approve the minutes of the July 16, 2003 meeting as amended. Unanimous.

Correspondence:

  1. Council of Governments of the Central Naugatuck Valley Staff Recommendations re: Proposed Amendment to Section 311 to Allow for a Building Length of up to 225 Feet.
  2. Invoice #241 dated 7/21/03 from Connecticut Consulting Engineers, LLC, re: Plan Review of Gravel/Subdivision Prepared by OCC in the amount of $309.38.
  3. City of Waterbury Notice dated July 25, 2003 re: Water Supply Plan Approval and Availability - City of Waterbury Bureau of Water.

Motion by T. Galvin, seconded by D. Pomeroy to accept the correspondence. Unanimous. Motion by D. Pomeroy, seconded by A. Havican to pay the invoice for Connecticut Consulting Engineers, LLC, in the amount of $309.38. Unanimous. G. Graveline arrived at 7:05 p.m. F. Carpentier was unseated for the remainder of the meeting.

Old Business:

a. Town of Prospect - Board of Recreation, 36 Center Street. Site Plan Application for Volleyball Courts & Skating Rink - Hotchkiss Field. This application was accepted at the July 16, 2003 meeting. Assistant Director of Public Works, Gene McCarthy, Board of Recreation Chairman Mark Mikulski and Board of Recreation member Bill Sereduck were in attendance to review the Board of Recreation's overall plan for Hotchkiss Field and answer questions for the Commissioners regarding the proposed site plan for volleyball courts and a skating rink. The Commissioners were concerned with the proposed additional entrance to the park citing the Town's Plan of Development encouraging minimal road cuts, particularly along this corridor. Safety concerns were also noted due to the proposed entrance being located at an area on Route 69 where three lanes merge to two. Discussion was held on the feasibility of accessing the proposed volleyball courts and skating rink using the current entrance as well as the possibilities of sharing a driveway with the neighboring property or installing another traffic light. The Commissioners felt that the Board of Recreation should amend the site plan with an interior road utilizing the existing access off of Route 69.

b. Tesco Rentals, LLC, 151 & 155 Union City Road. Application for a Special Permit for a Residential Development for Elderly Persons. There was no discussion on this application.

Public Hearings: None

Land Use Inspector's Report: Bill Donovan discussed the industrial area on Scott Road being proposed for a commerce park. Bill asked the Commissioners to consider including in the draft regulations the creation of an overlay zone for a commerce park area in order to heighten the requirements within a proposed commerce park and give more control over the uses that would be allowed. Bill reviewed Public Act #03-184, indicating that the Planning & Zoning Commission will be approving the location of car dealerships and repair facilities as a requirement for State licensing rather than the Zoning Board of Appeals effective October 1, 2003. Bill also reviewed changes that will be effective October 1st regarding a one time 65-day extension in the application/public hearing/decision making process for zoning commissions. Motion by T. Galvin, seconded by A. Havican to accept the Land Use Inspector's Report. Unanimous.
