Chairman R. Hiscox called the meeting to order at 7:02 p.m. The meeting was taped.

Approval of Minutes:

Motion by T. Galvin, seconded by D. Pomeroy to accept the minutes of the December 4, 2002 meeting as amended. Unanimous.

Motion by D. Pomeroy, seconded by G. Graveline to pay HMA, Inc. $1,925.00 for invoice #883394 dated 12/26/02. Unanimous.

Motion by A. Havican, seconded by T. Galvin to accept the correspondence. Unanimous.

Public Participation: Kolleen Gillis inquired what is being done regarding the storage trailer and construction equipment located on 27 Platt Drive. Bill Donovan stated he contacted Mrs. Christiano and she told him the siding for the storage trailer has been ordered and is on site and the siding will be done as soon as the weather breaks. She also told him the backhoe will be used for grading the driveway in the Spring. The Commissioners asked Bill to stay on top of the situation and to request a letter from the Town Attorney confirming the Town's position. Mr. & Mrs. Hennigan, 20 Platt Drive expressed their increasing concerns with the alleged zoning and Home Occupation Permit violations for 27 Platt Drive.

Public Hearings:

a. O & G Industries, Inc. Spring Road. Renewal of Special Permit for Earth Removal. The public hearing was opened at 7:21 p.m. Chairman Hiscox read into record the letter from O & G Industries requesting their renewal permit be granted for two years. Chairman Hiscox read into record the Notice of Public Hearing as it appeared in the Waterbury Republican. Ken Ferroni representing O & G Industries reviewed the information presented with his renewal application with the Commissioners. Addressed the complaints that had been logged over the past year concerning trespassers, and blasting related complaints as well as the measures O & G has taken to address these complaints. The hearing was then opened for public comment. Various abutting property owners complained about the dirt bikes, effects of blasting on their homes, trucks traveling too fast, road not being wide enough for traffic, dust problems from the quarry, and not being notified of blasting dates and times. Mr. Faroni addressed the complaints and told anyone who wanted to be notified of blasting dates and times to give him their name and phone numbers and they would be contacted with future blasting schedules. Motion by T. Galvin, seconded by D. Pomeroy to close the public hearing. Unanimous.

b. Tesco Rentals, L.L.C., 151 Union City Road. Application for a Zone Change from Residential to General Commercial. The public hearing was opened at 8:34 p.m. Hank Berberat, representing Tesco Rentals, L.L.C. withdrew this application. The public hearing was closed.

Old Business:

a. Edward J. Hankey & Jane Valetkevich, 200 Coachlight Circle. Application for an 8-Lot Subdivision. (Public Hearing closed December 4, 2002). The Commissioners discussed that Lot 8 has not yet been approved by Chesprocott. Motion by D. Pomeroy, seconded by T. Galvin to approve the Draft Resolution of Approval for a 7-Lot Subdivision, Hankey Estates. Unanimous.

b. Proposed Regulation Revisions / Update. The planners will be in attendance at the January 22, 2003 meeting.

New Business:

a. Shannon Development, L.L.C., 80 Straitsville Road. Application for a 5-Lot Subdivision. Motion by D. Pomeroy, seconded by G. Graveline to accept the Application for a 5-Lot Subdivision and set a public hearing for February 5, 2003 at 7:15 p.m. Unanimous.

b. Addona Catering, 72-74 Waterbury Road. Application for a Special Permit for a Banquet Facility. Motion by T. Galvin, seconded by A. Havican to accept the Application for a Special Permit for a Banquet Facility and set a public hearing for February 5, 2003 at 7:45 p.m. Unanimous.

c. Hank Berberat, 151 Union City Road. Application for Text Change to Section 311 of the Regulations, Elderly Housing. Motion by D. Pomeroy, seconded by A. Havican to add this item to the agenda. Unanimous. Motion by D. Pomeroy, seconded by A. Havican to accept the application for Text Change to Section 311 of the Regulation, Elderly Housing and set a public hearing for January 22, 2003 at 7:15 p.m. Unanimous.

Land Use Inspector's Report: Bill Donovan presented the Commission with a request release the remaining $21,000.00 maintenance bond for West Ridge Estates Subdivision. Motion by D. Pomeroy, seconded by G. Graveline to release the remaining $21,000.00 maintenance bond for West Ridge Estates Subdivision. Unanimous. Bill also reported he forwarded elderly housing regulations from other towns to the planners for them to look at. Bill also noted the Commission needs to decide if they want to be specific about what type of zone (commercial, industrial, etc.) would they want a Sports Dome Facility located in when changing the regulations. Bill has contacted the person running a tree service from his home on Juggernaut road and told him his equipment has to be moved off site. The Commissioners asked Bill to have the person in charge of the Texaco Station on Rt. 69 come in and answer to the Commission on why there are continued violations regarding items for sale being displayed on sidewalks. Gil Graveline also mentioned to Bill that the Fire Marshall might want to inspect the Texaco Station to be sure the counter attendant has clear view of the gasoline dispensers. The Commissioners discussed with Bill clarifying in the Regulations, which board or commission is involved in changing a site plan. Chairman Hiscox asked Bill to put some thought into how he would like the breakdown of the Commissions budget for 2003 to read. He asked Bill to consider allocating some money for additional clerical help in the office or a part time assistant. Bill mentioned there have been complaints from Rozum Circle residents regarding the trucks coming in and out of the storage facility. Some of the other items mentioned for discussion when changing the Regulations were: defining a commercial vehicle, how long can a vehicle be parked on property before it is considered being stored there, and defining storage. The Commission also asked Bill to check into whether the business on the corner of Plank Road and Summit Road has expanded the use of the lot. Motion by T. Galvin, seconded by A. Havican to accept the Land Use Inspector's report. Unanimous.

Public Participation: Paul Violet, 147 Union City Road, asked what had Bill found regarding the allowed use of 151 Union City Road. Bill stated he found it was intended to be a buffer. The Commission discussed with Mr. Violet the different interpretations that could be used to describe "buffer". Mr. Violet also shared his knowledge of some of the elderly housing complexes that have been developed throughout the state.

Motion by A. Havican, seconded by T. Galvin to adjourn at 10:00 p.m. Unanimous.
