Robert Hiscox called the meeting to order at 7:00 p.m. The meeting was taped. F. Carpentier was seated for D. Pomeroy.
Approval of Minutes:Motion by T. Galvin, seconded by G. Graveline to approve the minutes of the March 4, 2004 meeting as attended.Unanimous.
Correspondence:
Motion by T. Galvin seconded by G. Graveline, to accept the correspondence. Motion by A. Havican, seconded by G. Graveline to approve payment to HMA, Inc. in the amount of of $1,900.00 for Invoice #883796 dated March 31, 2004 re: subdivision update. Unanimous.
D. Pomeroy arrived at 7:05 p.m. Consequently, F. Carpentier was unseated for the remainder of the meeting.
New Business: a. Schedule Public Hearings-Revisions to Plan of Conservation & Development Zoning Regulations & Zoning District Map and Subdivision Regulations. Bill Donovan distributed copies of proposed legal notices including scheduled times for public hearings to be held on May 12, 2004 as discussed at the previous meeting. Motion by D. Pomeroy, seconded by G. Graveline to set a public hearing on May 12, 2004 at 7:00 p.m. on an amendment to the Town of Prospect Plan and Development. Unanimous. Motion D. Pomeroy, seconded by G. Graveline to set a public hearing on May 12, 2004 at 7:30 p.m. on the comprehensive revisions to Prospect Zoning Regulations and Zoning District Map. Unanimous. Motion by D. Pomeroy, seconded by G. Graveline to set a public hearing on May 12, 2004 at 8:30 p.m. on the comprehensive revision to Prospect Subdivision Regulations. Unanimous.
b.Town of Prospect, 36 Center Street Request for Approval Under Section 8-24 - Municipal Improvements. Bill Donovan presented a copy of the Town's current capital plan as proposed by Mayor Robert Chatfield regarding reconstruction and improvements to Town roads and improvements to Town parks including new fences. Mayor Chatfield is seeking Planning & Zoning approval as required under Section 8-24 of the Connecticut General Statuties before the Town can apply for bonding. Motion by A. Havican, seconded by t. Galvin to approve the request of Mayor Robert Chatfield for reconstruction and improvements to Prospect Town roads and improvement to Town Parks including new fences in accordance with Section 8-24 of the Connecticut General Statutes. Unanimous.
Old Business:
a. Discussion of Revision to the Subdivision Regulations - HMA, Inc. Dick Harrall, of Harrall- Michalowski Associates, reviewed and recommended revisions and additions made to the Subdivision Regulations. Chairman Hiscox asked that the revisions include written notification to the P & Z chairman when a preliminary review is being conducted by the Land Use Officer and Town Staff. Discussion was held on open space fees. Mr. Harrall stated that the Commission should be requiring applicants to provide a current certified appraisal of the property being subdivided for calculation of open space fees. Mr. Harrall also suggested the "Road Ordinance" should not be included in the Subdivision Regulations, but that a request should be made to the Town Council to pass a "Road Ordinance" setting the guidelines for subdivision applicants to comply with Discussion was also held on the proposed definition of the "buildable square."
Chairman Hiscox suggested canceling the April 21, 2004 meeting as there is no business currently before the
Commission and there are three scheduled meetings during May. The Commissioners agreed to cancel the
April 21st meeting. Motion by A. Havican, seconded by T. Galvin to adjourn at 10:15 p.m.
