Acting Chairman Thomas Galvin called the meeting to order at 7:03 p.m. The meeting was taped. A. Delelle was seated for R. Hiscox.

Approval of Minutes: Motion by D. Pomeroy, seconded by A. Havican to approve the minutes of the July 21, 2004 meeting as presented. Unanimous.

Correspondence:
1. Council of Governments of the Central Naugatuck Valley Notice of Address Change – 60 North Main Street, Third Floor, Waterbury, CT 06702-1403.

Motion by A. Havican, seconded by D. Pomeroy to accept the correspondence. Unanimous.

Public Hearings:
7:15 p.m. – Ed the Treeman, LLC, 23 Industrial Road. Application for a Special Permit for Firewood Production and Storage. Acting Chairman T. Galvin read the notice of public hearing as it appeared in the Republican American on July 23rd and July 30th 2004. Scott Poryanda of Connecticut Consulting Engineers represented the applicant and presented the application for wood processing at 23 Industrial Road. Mr. Poryanda indicated that the wood processing is a secondary operation to Edward Brasche’s tree cutting business. Mr. Brasche estimated that he would process about 200 cords of wood per year on site. Logs would be dropped to the back of the parking lot and processed and stored behind the warehousing building. Hours of operation are proposed to be 8:00 a.m. to 6:00 p.m., Monday through Friday. There would be no wood processed on weekends or holidays. The hearing was opened to the public for questions. Barbara Bragg, 12 Rozum Circle, asked how many hours per day a chain saw or wood splitter would be running and how much noise is generated from the equipment. The Commissioners reviewed Section 10.4.4 of the Regulations regarding noise. D. Pomeroy asked Bill Donovan to have Section 10.4.4. defined to provide a clearer interpretation. T. Galvin asked the applicant to provide specifications on noise levels associated with the equipment being used for processing wood for the next meeting. John Pannone, 26 Rockridge Terrace, stated that in his opinion there is no chain saw that can operate within the levels specified in Section 10.4.4. and asked the Commission to deny this application. Mr. Pannone feels the surrounding residential property values have depreciated enough due to recent development in the industrial park. There were no further comments from the public. The public hearing was continued to August 18, 2004 at 7:15 p.m.

New Business:
a. Raymond P. Donnelly, Jr., 9 Union City Road. Application for a Special Permit for a Home Occupation – Yard Maintenance. Mary Donnelly, 9 Union City Road was in attendance representing her husband who is asking for a Special Permit for his yard maintenance/landscaping business at 9 Union City Road. Motion by D. Pomeroy, seconded by A. Havican to accept the application for a Special Permit for a home occupation for yard maintenance/landscaping for property located at 9 Union City Road and set a public hearing for August 18, 2004 at 7:30 p.m. Unanimous.

b. Mahler Realty Advisors, Inc., Waterbury, CT. Pre-Application Review for an Active Adult Community – RMK Associates Property, Scott Road. Keith Mahler, president of Mahler Realty Advisors reviewed a proposed site plan for 176 acres on Scott Road where a commerce park was previously being considered. Mr. Mahler stated that the Commerce Park is no longer being proposed. The new proposed development would be a 55 and older private, gated community consisting of clusters of six to eight single-family detached residences per acre. Each residence would be 1½ stories with an average of 1,800 square feet of living area. Single-family residential homes are proposed along Scott Road as a buffer to the gated development. The gated community would be serviced with sewers and city water. Mr. Mahler asked for an interpretation of the regulations regarding the proposed detached residences. Bill Donovan reviewed the regulations with the Commissioners, stating that he felt the detached residences would be allowed within the current regulations.
