Robert Hiscox called the meeting to order at 7:00 p.m. The meeting was taped.
Approval of Minutes: Motion by G. Graveline, seconded by A. Havican to approve the minutes of the July 7, 2004 meeting as presented. Unanimous.
Correspondence:
Motion by T. Galvin, seconded by A. Havican to accept the correspondence. Unanimous. Motion by T. Galvin, seconded by G. Graveline to approve payment to HMA, Inc. in the amount of $290.00 for copies of zoning and subdivision regulations. Bill Donovan indicated that copies of the regulations are available for sale in the amount of $30.00 for zoning regulations and $20.00 for subdivision regulations. The vote on the motion was Unanimous.

a. Edward Brasche, 32 Clark Hill Road. Site Plan Application for Warehousing Building – 23 Industrial Road. Scott Poryanda of Connecticut Consulting Engineers represented the applicant and presented a site plan for a 7,500 square foot building to house equipment and vehicles for Ed the Treeman, LLC. The building will be serviced by city water and an on site septic system. Utilities will cross Industrial Road underground to connect on the opposite side of the street. Mr. Poryanda stated that storm drainage would be tied into the storm drain located on Industrial Road. Mr. Brasche indicated that he would be storing and producing firewood on site. Bill Donovan mentioned that a special permit might be required for the firewood processing. The Commissioners reviewed the regulations regarding “wood products” and agreed that although wood production was not the primary use of the building, Mr. Brasche should submit a separate application for a special permit for firewood production and storage. The Commissioners agreed that the fees paid with the site plan application would cover the cost for a special permit application. A bond would be required with the site plan approval due to the utility connections crossing a Town road and connection to the Town catch basin. Motion by A. Havican, seconded by G. Graveline to accept and approve the site plan application submitted by Edward Brasche for a warehouse building for property located at 23 Industrial Road with a site development bond in an amount to be determined by Town staff. Unanimous.
Public Hearings:
7:30 p.m. Luigi Demagistris, 198 New Haven Road. Application for a 2-Lot Re-subdivision. Chairman Hiscox read the notice of public hearing as it appeared in the Republican American on July 9th and July 16th. Mr. Demagistris and Bill Donovan explained that this is the third application for a re-subdivision at 198 New Haven Road. The Planning & Zoning Commission approved two previous applications, however a Mylar map was not filed within the allowed time frame on the past two approvals. Bill indicated that Mr. Demagistris has a Mylar map at this time. The Commissioners had no further questions for Mr. Demagistris. Motion by T. Galvin, seconded by G. Graveline to close the public hearing for a 2-lot re-subdivision for property located at 198 New Haven Road. Unanimous.
Motion by D. Pomeroy, seconded by G. Graveline to approve a 2-lot re-subdivision for property owned by Luigi Demagistris located at 198 New Haven Road as presented. Unanimous.
Motion by D. Pomeroy, seconded by G. Graveline to add to the agenda under “New Business” an application from Ed the Treeman, LLC for a special permit for firewood production and storage for property located at 23 Industrial Road. Unanimous.
New Business:
b. Ed the Treeman, LLC, 23 Industrial Road. Application for a Special Permit for Firewood Production and Storage. Ed Brasche presented the application for storage and wood production in conjunction with a new warehouse building to be located at 23 Industrial Road. Fees for this application were included with a previous site plan application approved earlier in the meeting. Motion by A. Havican, seconded by D. Pomeroy to accept the application for a special permit for firewood production and storage for property located at 23 Industrial Road and set a public hearing for August 4, 2004 at 7:15 p.m. Unanimous.
c. Blue Point Capital, LLC, 3, Hendrie Drive, Old Greenwich, CT. Pre-application Review for an Active Adult Community – Louis DiMuzio Property, New Haven Road. Jim Babb of Blue Point Capital and Bart Hunter of Times 3 Associates reviewed a site plan for a 350 unit “age targeted” community to include an 18-hole golf course, outdoor swimming pool and tennis courts. The development is proposed for approximately 150 of the 170 acres owned by Louis DiMuzio that is located between Route 69 and Putting Green Lane. Townhouses would be two and three story units with 1 & 2 car garages. Each unit is proposed to be 1,800 to 2,000 square feet. Flats would be 1,300 to 1,800 square feet with 2 bedrooms. The commissioners questioned the definition of “age targeted” relating to owners under the age of 55. The applicants were instructed to carefully review the regulations to determine whether the proposed development would require an amendment to the zoning regulations to allow for an “age-targeted” community. Sanitary connections are still being investigated. There is consideration being given to municipal sewer connections through the Town of Naugatuck. Chairman Hiscox referred the applicants to review the Town’s Plan of Conservation and Development regarding sewers. Mr. Hunter stated that he may wish to come back to the Commission for further review of this project. Chairman Hiscox encouraged the applicants to continue to check back with the Commission on an informal basis as the project progresses.
Land Use Inspector’s Report: Bill Donovan distributed a copy of a proposed message board sign for CVS Pharmacy on Waterbury Road. Bill stated that the Zoning Board of Appeals recently denied an application from CVS indicating that the type of sign was not what the Town wants. CVS has requested that the Planning and Zoning Commission provide an interpretation of the Town’s sign regulations regarding message board signs. The Commissioners discussed the sign regulations citing the need to promote public safety. G. Graveline stated that the intention of a message board sign was to get the attention of motorists and that a sign of this type would detract from safe driving. Mr. Graveline also reminded the Commissioners that the Town of Prospect was recently denied a driveway entrance to Hotchkiss Field in the same area due to safety concerns. The Commissioners unanimously agreed that a strict reading of Section 8.2.4 of the regulations prohibits intermittent moving signs with the exception of a time and temperature sign. Bill reported that he has received complaints regarding the home occupation permit issued for ServiceMaster on Amber Court. There are reports of employees meeting at the home and parking vehicles on Amber Court as well as outdoor storage of trash and a dumpster on the property. There was also a report of an outdoor tank being used for dumping cleaning materials that is emitting an odor. Bill was directed to notify the owner that he is violating his permit and if the problems are not corrected the permit will be revoked. Motion by A. Havican, seconded by T. Galvin to accept the Land Use Inspector’s Report. Unanimous.
