V. Chairman G. Graveline called the meeting to order at 7:01 p.m. The meeting was taped. A. Delelle was seated for R. Hiscox.

Approval of Minutes: Motion by T. Galvin, seconded by D. Pomeroy to approve the minutes of the June 16, 2004 meeting as presented. Unanimous.

Correspondence:
1. Letter of Appreciation dated June 25, 2004 from Robert Hiscox to Bill Donovan re: Plan of Conservation & Development, Zoning and Subdivision Regulations. Motion by D. Pomeroy, seconded by T. Galvin to accept the correspondence. Unanimous.

Public Participation: Ed DiLoreto of Prospect Service Center, 20 Union City Road, discussed a proposal for a change of use for his current gas station to a gas station/convenience store and a proposed added garage at 1 Old Schoolhouse Road to conduct an auto repair and maintenance business. The current residential home at 1 Old Schoolhouse Road would be demolished and a new garage built in its place. Bill Donovan indicated that the proposed new business is in a Business District Zone and would require a special permit. The change in use for the gas station located at 20 Union City Road would require an application for a change in use. Mr. DiLoreto will be placed on the agenda for the next meeting for the two applications.

Old Business: None

New Business:
a. Luigi Demagistris, 198 New Haven Road. Application for a 2-Lot Re-subdivision. Luigi Demagistris and Bill Donovan gave an overview of the application subdividing a 4.24-acre parcel with the intent to build a garage for auto repairs. Bill Donovan explained that due to the retirement of the surveyor for this subdivision, Mr. Demagistris was not able to file a Mylar map within the allotted time period from the date of the previous approval by the Planning & Zoning Commission. A Mylar map is now available and Mr. Demagistris is asking for approval for a third time on the proposed re-subdivision. Fees were set and paid in the amount of $50.00 and $20.00. Motion by T. Galvin, seconded by D. Pomeroy to accept the application for a 2-lot re-subdivision at 198 New Haven Road and set a public hearing for July 21, 2004 at 7:30 p.m. Unanimous.

New Business:
b. David Kaufman, 2 George Street. Application for a Home Occupation Permit – Lawn Care Service. Bill Donovan stated that he had issued a permit for this home occupation prior to July 1, 2004, however asked Mr. Kaufman to present the application to the Planning & Zoning Commission to address any concerns the Commissioners may have. David Kaufman stated that he is the only person residing at this address who will be engaged in the business. He has one employee who may occasionally park a vehicle at his residence during the day. There is no outside storage of equipment and no storage of chemicals on the premises. Mr. Kaufman stated that equipment maintenance is done inside the garage. The Commissioners cautioned Mr. Kaufman that maintenance of equipment should not be done before or after normal business hours. Mr. Kaufman has a standard panel truck with signage and an enclosed trailer. There will be no additional sign. Plows for winter snowplowing are stored in the garage. Bill Donovan indicated a 5-year renewal period as allowed in the new regulations would apply. The Commissioners had no other concerns.

Land Use Inspector’s Report: Bill Donovan distributed copies of the new Subdivision and Zoning Regulations for the Commissioners. HMA suggested to Bill Donovan that the Town Council should adopt a schedule for both zoning and subdivision fees and expenses. Discussion was held on the requirement for a property appraisal for calculating open space fees as required in the new regulations. Bill stated that June 2004 was the busiest month he has had with regards to issuing zoning permits and acquired this to people with home businesses wanting to be registered before the new regulations took effect. Bill also indicated that the Town Council has approved an ordinance appointing the Planning & Zoning Commission as the agency responsible for overseeing the Town’s acquifer protection. The Inland Wetlands Commission has approved the Town’s application for filling behind the Senior Center for additional parking. Motion by D. Pomeroy, seconded by T. Galvin to accept the Land Use Inspector’s Report. Unanimous.
