Chairman Robert Hiscox called the meeting to order at 7:00 p.m. The meeting was taped.

Approval of Minutes: Motion, by A. Havican, seconded by G. Graveline to approve the minutes of the March 2, 2005 meeting as amended. Unanimous.

Correspondence:

  1. Connecticut Federation of Planning & Zoning Agencies – Membership Dues through March 31, 2006 in the Amount of $90.00.
  2. Invoice dated March 8, 2005 from Land-Tech Consultants, Inc., for Review of Revised Plans and Prepare Letter for 115 Waterbury Road in the Amount of $237.50.
  3. Connecticut Federation of Planning & Zoning Agencies Quarterly Newsletter – Winter 2005.
  4. Copy of General Permit Application for Miscellaneous Drainage Projects to be Conducted on Dept. of Environmental Property Across the State from the Connecticut D.E.P.

Motion by D. Pomeroy, seconded by G. Graveline to accept the correspondence. Unanimous. Motion by A. Havican, seconded by D. Pomeroy to pay Land-Tech Consultants, Inc., for professional services rendered for review of 115 Waterbury Road in the amount of $237.50. Unanimous. Motion by G. Graveline, seconded by D. Pomeroy to pay the Connecticut Federation of Planning & Zoning Agencies membership dues in the amount of $90.00. Unanimous.

Old Business:
a.CJN Realty, LLC, 115 Waterbury Road. Application for a Special Permit for a Commercial Building for Professional Offices and Services. The public hearing was closed on March 2, 2005. Chairman Hiscox read comments received from Chesprocott Health District dated March 8, 2005. Bill Donovan stated that he has received a signed copy of the plans with the engineer’s signature and a stamped approval by Chesprocott. The Commissioners reviewed the Resolution of Approval as prepared by Bill Donovan. Motion by A. Havican, seconded by D. Pomeroy to approve the Resolution of Approval for a Special Permit for a commercial building for professional offices and services for property located at 115 Waterbury Road as presented. Unanimous. It was stated for the record that in the Commission’s judgment, the subject project complies with the criteria set forth under Section 12.10 – special Findings of the Prospect Zoning Regulations.

Public Hearings: None

New Business:
a. Prospect Resource Group, Hamden, CT. Presentation of Proposed Sanitary Sewer Route Requiring Petition to Amend the Plan of Conservation & Development. Mark Lancor of Dymar spoke as the engineer/site planner for the applicant. Mr. Lancor explained that tonight’s presentation is an informal discussion to bring the Commissioners up to date regarding a proposed sewer extension along Route 68 and a portion of Route 69 from the Borough of Naugatuck to service a proposed elderly housing project to be located on Route 69. The applicants have worked extensively with the Borough of Naugatuck to establish that Naugatuck’s sewage treatment system has capacity for the proposed project as well as a small sewage shed to service properties along Route 68. The applicants have also had meetings with Town staff and the Town’s planning consultants to determine the effects of Town property tying into the sewer system. Mr. Lancor reviewed a conceptual sewer layout stating that the applicant is looking for comments and concerns from the Commission in anticipation of presenting a petition for amending the Town’s Plan of Development to establish a sewer district. The applicant is also requesting that they be allowed to meet with the Town planners at the applicant’s expense in drafting the proposed petition. The Commissioner’s agreed that it made sense for the applicant to work with the planners and utilize any information their office could provide regarding the Town of Prospect. Motion by D. Pomeroy, seconded by G. Graveline to allow Prospect Resource Group to work with Prospect’s planning consultants at Prospect Resource Group’s expense, for the purpose of preparing a petition for an amendment to Prospect’s Plan of Development to establish a sewer district. Unanimous. The applicants anticipate that their petition will be presented at the April 6, 2005 meeting.

b. G & G Trust, 103 Union City Road. Application for a Zone Change from Industrial to Business. Chairman Hiscox read a letter from Linda Kelly, Trustee for the G & G Trust, granting permission for Gregory Ploski to represent G & G Trust in this application. Gregory Ploski presented the Commissioners with the most recent site plan map for 103 Union City Road and reviewed the current businesses operating out of the building. In Mr. Ploski’s opinion, the current use of the property is more consistent with a Business/Commercial District as described in the Regulations. Mr. Ploski stated that the proposed zone change would conform to the Plan of Development. Motion by A. Havican, seconded by G. Graveline to accept the application for a zone change from Industrial to Business for property located at 103 Union City Road and set a public hearing for April 6, 2005 at 7:45 p.m. Unanimous.

Land Use Inspector’s Report: Bill Donovan distributed a copy of a letter sent from the Town Attorney regarding affordable housing provisions in Zoning Regulations pertaining to elderly housing. Bill asked the Commissioners to review the attorney’s comments prior to the public hearing on amendments to the Regulations scheduled for April 6, 2005. Bill also stated that there are new State water quality standards going into effect. Bill has received the 2004 Connecticut Stormwater Quality Manual and stated that the Council of Governments is offering an educational workshop regarding the new standards. Bill asked that anyone interested in attending should let him know by March 25th. A letter has been sent to the day care at 105 Waterbury Road informing them they are not in compliance with their permit regarding the outdoor play area. Bill reported that a citation hearing is scheduled for March 23, 2005 regarding a large commercial vehicle on Clark Hill Road. Motion by D. Pomeroy, seconded by A. Havican to accept the Land Use Inspector’s report. Unanimous.
