Chairman Hiscox called the meeting to order at 7:01 p.m. The meeting was taped.

Approval of Minutes:
Motion by G. Ploski, seconded by A. Delelle to approve the minutes of the September 5, 2007 meeting.
A. Havican abstained. Motion carried.
Correspondence:
1.) LTF Builders request for a 90 day extension for the recording of the Mylar Map.
Motion by A. Havican, seconded by A. Delelle to approve the request from LTF Builders for a 90 day extension for the recording of the Mylar Map for the Woodmont Estates Subdivision at 157A Summit Road. Unanimous.
2.) WPCA – Copy of letter that was addressed to J. Commendatore and the Town Council re: Sewer Hookup at Boulder Brook and a copy of a letter to the DEP.
Chairman Hiscox asked B. Donovan if this issue has been resolved. B. Donovan stated that it is being resolved. The Town was questioned on why Boulder Brook was allowed to be built in an Aquifer Protection Area. This development was approved prior to the new Zoning Regulations which have a specific section on Aquifer Protections Areas. It was also approved prior to the Town’s Plan of Conservation and Development. B. Donovan also mentioned some DEP permits which still have not been filed.
3.) Council of Governments- Minutes from May 1st, 2007 meeting.
Motion by A. Havican, seconded by G. Ploski to accept the correspondence. Unanimous.

New Business:
Jim Juliani, 69 Waterbury Road – Amendment to Site Plan & Additional Use for Repossessed Vehicle Storage. Mr. Juliani will attend the October 3, 2007 meeting.
Sandra D’Uva, 64 Smoke Rise Circle – Prior common driveway subdivision approval.
Atty. Porzio represented Ms. D’Uva. Larry Beausoleil was also in attendance; he owns the property next to Ms. D’Uva. They are trying to straighten out an issue with a common driveway. Atty. Porzio asked whether or not they need to obtain approval from the Commission for a common driveway under Section 8d of the current Subdivision Regulations. Currently, most of the driveway is on Mr. Beausoleil’s property. What should have happened was a common driveway should have been approved in the early 90’s when this subdivision was approved. These are both rear lots and according to Mr. Beausoleil, the Town didn’t want the developer to construct a wide driveway but did require additional drainage facilities because of drainage issues. Ms. D’Uva is in the process of selling her home and there is a driveway easement on the land records which gives both property owners the right to use portions of the driveway. Since the two houses do not have 9 foot wide driveways, technically they do not comply with the regulations. B. Donovan stated that on the subdivision plan there are two 25 foot wide fee simple access ways for each property. Larry Beausoleil discussed the history of the subdivision approval. Atty. Porzio stated that everyone is content with the way the driveway is now situated as long as the Town and the Commission are ok with it as well. Chairman Hiscox asked B. Donovan to draft the appropriate document acceptable to both attorneys that indicates the way the driveway was constructed was in the best interest of the Town and they will not consider this to be a violation of Section 8d of the current Subdivision Regulations. The Commission also did not think it is necessary to have to tear down trees and change the drainage to comply.
Old Business:
Regulations Revisions – General Discussion
Chairman Hiscox mentioned a Workshop scheduled for Wednesday, September 26, 2007 at 7:00 p.m. to allow for public input and to discuss revisions to the regulations. G. Ploski submitted a small list of revisions he would like to have considered.

A Cease & Desist was issued to a property owner on Mixville Rd. for issues with a storage building.
R. Hiscox stated that the canvas hut on Plank Rd. is still there. The Commission feels a fine should be issued.
The canvas hut behind Community School is still there.
B. Donovan mentioned material at Quality Hardwood. The owners have been before the Commission and are supposed to be cleaning up the property. The bond has still not been filed and the fire road is not in place. J. Crumb stated he spoke with the property owner and a lot of material was cleaned up this past week. He feels that more business and material is coming onto the property than being removed from the property.
Cocchiola Property-Logs are still there and there is a large pottery stand out front.
Platt Drive- Auto Shop Complaint. B. Donovan stated a letter has been sent out.
Lombard Drive-Tree Carving operation. There have been no further issues.
Prospect Storage-No further issues.
Heritage Drive-Size of truck – Sheriscapes-Landscaping. Owner was contacted.
Tress Road- There were boats all over the yard. B. Donovan stated that a lot of the boats and trailers were moved to the back of the property.
Senor Panchos-Re: Bull Riding Event-Issues need to be addressed with Andy Adames if this is to happen again. Inadequate traffic control, Rolling Ridge was a parking lot; Is this the appropriate site for this kind of an event? They don’t want to create distraction on the neighboring properties and roads. The issue with vendors was also mentioned.
1 Old Schoolhouse Road (Cease & Desist/ Amendment to Site Plan) - Mr. Diloreto was not attendance. Mr. Diloreto informed the Land Use Office earlier that he, his engineer and his attorney will attend the Oct. 3rd meeting. Scott Poryanda with Connecticut Consulting Engineers was in attendance with a revised site plan and he understood that everyone was to be at tonight’s meeting. Atty. Zailckas did call the Land Use Office to say he would not be available for tonight’s meeting. Chairman Hiscox mentioned the “emergency access way” that is supposed to be around the buildings. Today, there were 2 separate trucks blocking the access way. Chairman Hiscox feels that this business has outgrown the property. The business owners need to comply with the site plan. B. Donovan will call them and express the Commission’s concerns again. A. Delelle stated that he feels the business is too big for the property as well.
B. Donovan mentioned Prospect Estates the 7 lot subdivision on Cook Road. The original subdivision plan showed the installation of an oil/water separator which would capture storm water runoff from not only the subdivision but also from several streets across from the subdivision. The plan was sent to the Army Corp. of Engineers for their review. The Army Corps. did not want the original offsite drainage shown on the approved plans to be directed into the Prospect Estates Subdivision as this design diverts water runoff from one watershed into a different watershed. Consequently, the only storm water runoff now going into the detention basin is road runoff within the subdivision. B. Donovan asked the Commission whether or not they think the oil/water separator is now necessary. B. Donovan checked with the town’s engineering consultants as well as other engineers and none see the benefit of the oil water separator at this time. Also, the last three larger subdivisions the Commission approved did not require oil/water separators.
Motion by A. Havican, seconded by G. Ploski to approve the amendment to the Prospect Estates Subdivision Site Plan eliminating the proposed oil/water separator. Unanimous.
Motion by A. Havican, seconded by A. Delelle to accept the Land Use Inspector’s Report. Unanimous.
