Chairman Pomeroy called the meeting to order at 7:00 p.m. The meeting was taped.

Approval of Minutes:
Motion by A. Havican, seconded by A. Delelle to approve the June 17, 2009 minutes. Unanimous.

Public Hearing: None

New Business:
a. Tina Tanguay, 27 Merriman Lane - Home Occupation Application - Accounting/Tax Services. Mrs. Tanguay appeared before the commission and stated that she would like to use a portion of her home for an accounting/tax service business. Mrs. Tanguay provided the commission with a plot plan showing the proposed work area in her home and parking for 4 vehicles. Mrs. Tanguay stated that she will be the only employee and that she would not have any commercial vehicles, outdoor storage or signs. Mrs. Tanguay stated that most of her work will be done away from her home but understood that her business office hours would be Monday through Friday from 9:00 a.m. to 5:00 p.m. Chairman Pomeroy stated that the commission would accept the application tonight and schedule a public hearing. With no further comments, Motion by A. Havican, seconded by A. Delelle to accept the Special Permit Application for a Home Occupation: Public Accountant/Tax Service Office from Tina Tanguay, 27 Merriman Lane and set a public hearing for July 15, 2009 at 7:10 p.m. Unanimous.

b. Joseph K. Skrip, 25B Gramar Ave. - Special Permit Application - Truck Customizing & Restoration/Used Car Dealership. Joseph Skrip presented the commission with his Special Permit Application and site plan for his proposed Truck Customizing and Restoration/Used Car Dealership business at 25B Gramar Avenue. Mr. Skrip stated that once he has Planning & Zoning’s approval, he will need to file a similar application with the Zoning Board of Appeals to meet the Department of Motor Vehicle’s requirement. G. Ploski asked Mr. Skrip if the State would require that an A-2 Survey be done on the property and Mr. Skrip stated yes. After commission discussion, Motion by A. Havican, seconded by G. Ploski to accept the Special Permit Application from Joseph K. Skrip to operate a Four Wheel Drive Truck Customizing & Restoring and Used Car Dealership at 25B Gramar Avenue and set a public hearing for July 15, 2009 at 7:45 p.m. Unanimous. Land Use Inspector Bill Donovan asked Mr. Skrip to please contact the Building Inspector and the Fire Marshal prior to the public hearing to see if they will require any changes or modifications to the application.

c. Elaine Schieffer, 133 Cook Road - Application for a 1-lot Re-subdivision. Attorney Warren Hess, 180 Church Street, Naugatuck, CT appeared on behalf of the applicant and presented the commission with an Application for Approval of a 1-lot re-subdivision and site plan for 133 Cook Road. Attorney Hess also provided the commission with a letter dated 3/17/09 from Chesprocott Health District indicating that Chesprocott has conducted soil testing and have reviewed this re-subdivision plan and have determined that Lot 1 has an existing house, wells and septic system and has adequate area for a code-complying septic system if the septic system fails, and that Lot 2 has soils suitable for a septic system designed by a Professional Engineer due to a seasonable high water table. With no further comments, Motion by G. Ploski, seconded by A. Havican to accept the application from Elaine Schieffer, 133 Cook Road for a 1-lot re-subdivision and set a public hearing for July 15, 2009 at 8:00 p.m. Unanimous.

Old Business:
b. Review Subdivision and Zoning Regulations for public hearing on 7/15/09. Fire Marshal Keith Griffin appeared at the commission’s request to address safety concerns on the proposed regulation change to eliminate Section 6.11.1.4 regarding the maximum 500’ rear lot driveway access distance. After lengthy discussion, Fire Marshal Griffin stated that he would welcome seeing a driveway maximum of no greater than 750 feet. Chairman Pomeroy furthered asked Fire Marshal Griffin his opinion on the Regulation’s current 35’ height restrictions on structures to which Fire Marshal Griffin responded that the Town’s Fire Department does not have a ladder truck and at the 35’ peak of roof height restriction, the Fire Department is just able to reach the highest window in order to get someone out of a building if necessary.

a. Review Proposed Open Space Plan. Chairman Pomeroy asked the commission members if they had a chance to read through the proposed Open Space Plan and asked for discussion. The commission members stated that they had all read through the proposed plan and all agreed that they thought the proposed plan was extremely well done. Motion by A. Havican, seconded by A. Delelle to go forward and set a public hearing to review the proposed Prospect Open Space Plan created by The Open Space Planning Subcommittee of the Prospect Conservation Commission as an adopted amendment to Prospect’s existing Plan of Conservation and Development. Unanimous.

Land Use Inspector’s Report:
Bill reported that the Torrington Planning & Zoning Commission just approved a wind turbine with conditions. Bill further stated that a precedent has now been set and he will try to obtain a copy of the approval so the commission may review the conditions in anticipation of wind turbine applications in Prospect’s future. Chairman Pomeroy asked Bill for an update on the Platt Drive unregistered vehicle complaint brought up at the last meeting. Bill stated that he will continue to follow up on this as he had written to the property owner but did not receive a response. G. Graveline stated concern over the number of vehicles constantly being sold from 33 Waterbury Road which is between The Dairy Bar and Webster Bank. G. Ploski stated that if these cars are being transferred in from other dealer locations, it is illegal for a car dealership to sell their vehicles from any location other than their dealership lot and asked Bill to report this to the Department of Motor Vehicles. G. Ploski asked Bill if Juliani Motors, 69 Waterbury Road had ever brought in a site plan in accordance with the commission’s request. Bill responded that he had not received a site plan from Juliani and G. Ploski asked him to please follow up on this issue. J. Crumb stated concern over the fact that a stop sign was not required at the Toll Brothers’ Regency at Prospect project where it accesses Scott Road. Bill stated that he would contact the project manager, Dan Walton, and ask him if Toll Brothers would put a stop sign up. Motion by A. Delelle, seconded by A. Havican to accept the Land Use Inspector’s report. Unanimous.
