Approval of Minutes:
Motion by A. Havican, seconded by A. Delelle to approve the August 19, 2009 minutes. Unanimous. Chairman Pomeroy abstained from the vote.

New Business:
a. Larry Beausoleil - Prospect Estates, Saddle Court - Modification of approved site plan for the Prospect Estates Subdivision. Larry Beausoleil, 203 Cook Road, Prospect, CT, representative for Prospect Estates, appeared and requested a modification of the approved site plan for the Prospect Estates Subdivision located at 193 Cook Road now known as Saddle Court. Mr. Beausoleil requested that the site plan be amended to eliminate approximately 500 linear feet of guardrails on the northerly side of Saddle Court. Mr. Beausoleil stated that the original approved site plan showed guardrails around the entire cul-de-sac and up of the street leading to Cook Road. Mr Beausoleil further stated that there is a 10-foot snow shelf then a 2-foot drop which leads into trees and bushes on the northerly side of Saddle Court in the area where he is proposing the guardrail elimination. Mr. Beausoleil stated that the guardrails he is proposing to eliminate were never necessary but believes they may have just been added by the engineer to enhance the look of the site plan. He further stated that installing these guardrails on the northerly uphill side of the road would just be a waste of money to buy and install and would add unnecessary maintenance for the Town in the future. Mr. Beausoleil stated that he has spoken with Land Use Inspector Bill Donovan and Gene McCarthy, Assistant Director of Public Works, who have both agreed that the guardrails on the northerly side of Saddle Court are unnecessary. After commission discussion, Motion by A. Havican, seconded by G. Ploski to approve the modification of the approved site plan for the Prospect Estates Subdivision to eliminate approximately 500 linear feet of guardrails on the northerly side of Saddle Court. Unanimous.
Land Use Inspector’s Report:
Bill Donovan reported that in order to comply with Connecticut General Statutes Section 22a-354, The Department of Environmental Protection has completed their Level A (final) Aquifer Protection mapping for the Connecticut Water Company’s Indian Field Well Field. Bill stated that the Level A mapping area was approved by the DEP on June 30, 2009 and the approval of the Level A mapping initiates Prospect’s obligation to implement the Aquifer Protection Area Program as required by Connecticut General Statutes. Bill further stated that Connecticut General Statutes designate the Planning & Zoning Commission as The Aquifer Protection Agency for the Town of Prospect. Bill stated that the reconfiguration from Level B to Level A has shrunk Prospect’s Aquifer Protection Area significantly south and no longer includes any industrial or commercial areas - only residential property and the O & G Quarry on Salem Road. Bill stated that in order to comply with the Connecticut General Statutes, the Planning & Zoning Commission must establish the Aquifer Protection Area Boundary on the town’s zoning map by November 2009 and adopt regulations for the Aquifer Protection Area by January 2010. Bill stated that he is working with the Council of Governments to replace the current Level B Indian Field Aquifer Protection Area with a Level A Indian Field Aquifer Protection Area on our current zoning map. Bill stated that he will begin drafting the Aquifer Protection Regulations and that a public hearing will need to be held, before November 2009, in order to adopt the Aquifer Protection Regulations. Bill further stated that while a public hearing is not required to delineate the Aquifer Protection Area Boundary on our zoning map, he will bring the updated zoning map to the next Planning & Zoning Commission meeting for the commission’s review before he publishes a legal notice in the newspaper.
Bill stated that at the last Planning & Zoning Commission meeting, the commission approved an application for Earth Excavation, Deposition and Regrading Activities of more than 400 cubic yards of materials and asked the commission if they would like to review and hold discussion on Section 4.11 Earth Excavation, Deposition and Regrading Activities of the zoning regulations at a future meeting. After commission discussion, Chairman Pomeroy asked the clerk to add commission review and discussion of Section 4.11 Earth Excavation, Deposition and Regrading Activities to the meeting agenda for the September 16, 2009 meeting.
Chairman Pomeroy asked Bill if he followed up on the commercial vehicles and trailers parked at 89 Waterbury Road. Bill stated that he had and they are now gone.
G. Ploski asked Bill if he followed up on the recent correspondence complaints regarding 23 Old Schoolhouse Road and 105 Salem Road. Bill stated that had written to the property owner of 23 Old Schoolhouse Road who in response came in to pick up the appropriate application. Bill further stated that he has written to the property owner of 105 Salem Road and is waiting for a response. Bill stated that he would continue to follow up on both of these properties.
Motion by A. Havican, seconded by A. Delelle to accept the Land Use Inspectors Report. Unanimous.
