August 4, 2010

Chairman Pomeroy called the meeting to order at 7:02 p.m. The meeting was taped.

Motion by A. Delelle, seconded by G. Ploski to approve the July 21, 2010 minutes. Unanimous.

Correspondence:
1. Letter dated 8/4/10 from Land Use Inspector Bill Donovan re: Site Improvement Bond Release for the Prospect Estates Subdivision.

Motion by A. Havican, seconded by A. Delelle to accept the correspondence. Unanimous.

After commission discussion on Land Use Inspector Bill Donovan’s letter dated 8/4/10, Motion by G. Ploski, seconded by A. Havican to approve August Lenhart, Prospect Estates LLC’s request for a final release of the remaining $18,850.00 bond on the Prospect Estates Subdivision. Unanimous.

Public Participation:
Chairman Pomeroy asked the public for comments and stated that while public comments are strongly encouraged, the commission will only dedicate 10 minutes to any one subject. No public comment.

G. Ploski excused himself from the meeting. Chairman Pomeroy seated G. Graveline in his place.

Public Hearings:
7:10 p.m. Christopher & Whitney Caporaso, 176 Straitsville Road - Proposed amendments to Approved Special Permit for Commercial Greenhouses in a Residential Zone (continued from 7/21/10). Whitney Caporaso appeared before the commission and briefly outlined her proposed amendments. The Chairman read into record a letter dated 7/25/10 from Residents of Porter Hill Road opposing the proposed amendments. Mrs. Caporaso presented the commission with an updated site plan dated 7/27/10 which includes the proposed roadside stand, the parking area and the overflow parking area. Mrs. Caporaso stated that the west sideline of her property is now lined with Willow and Cherry trees and that she plans to close off the Porter Hill Road driveway once the sugarhouse is completed. Chairman Pomeroy asked for comments from the public. No public comment. Mrs. Caporaso stated that she is asking for a roadside stand in accordance with Zoning Regulations Section 5.2.7 and not a retail market. She stated that she is only seeking to sell agricultural products which she produces on the property. Motion by J. Crumb, seconded by A. Havican to close the public hearing on Christopher & Whitney Caporaso, 176 Straitsville Road - Proposed Amendments to Approved Special Permit for Commercial Greenhouses in a Residential Zone. Unanimous.

G. Ploski returned to the commission. G. Graveline was unseated.

New Business:
a. James Juliani, 69 Waterbury Road - Site Plan Review. Mr. Juliani appeared and presented the commission with an updated site plan dated July 16, 2010. Mr. Juliani stated that he plans to rent a portion of his business property to a vehicle repossession company. Mr. Juliani stated that the repossession company would use the already fenced-in portion in the rear of the property which had been used for a repossession company in the past. G. Ploski asked Mr. Juliani to increase his emergency access way on the northern side of his building to 15’ to comply with the Zoning Regulations and Mr. Juliani agreed. G. Graveline asked if there were any lights that could be a nuisance to the neighbors. Mr. Juliani stated that there is only one motion flood light in the middle of the back lot for security and that the light shines down across the lot. Motion by G. Ploski, seconded by A. Havican to approve the updated site plan dated 7/16/10 from James Juliani, 69 Waterbury Road with an additional revision to show required emergency access around the commercial building as discussed. Unanimous.

b. Jay Calderaro, 2-4 Summit Road - Change of Use Application. Jay Calderaro, 25 Cortland Drive, Huntington, CT appeared and presented the commission with a Change of Use Application to convert two office spaces, Units 4E & 4F on the second floor of 4 Summit Road, into a one bedroom residential apartment. Included in Mrs. Calderaro’s application are 5 sheets of plans entitled: 1) 4 Summit Road Second Floor - P; 2) 2 Summit Road First Floor Plan; 3) 2 Summit Road Second Floor Plan; 4) 4 Summit Road First Floor; and, 5) 4 Summit Road Second Floor. Also included in the application is a letter of approval dated 7/30/10 from Lorraine DeNicola of the Chesprocott Health District and a letter dated 8/3/10 from Scott A. Meyers, P.E. of Meyers Associates, P.C. detailing parking calculations for the number of parking spaces available on site and verifying compliance with the Zoning Regulations. Land Use Inspector Bill Donovan gave a brief history on the site and stated that while Mrs. Calderaro is here tonight for Planning & Zoning approval; she will also need to follow through to meet all State Fire and Building Codes. Mrs. Calderaro stated that she would immediately follow up with both the Fire Marshal and the Building Inspector. After commission discussion, Motion by A. Delelle, seconded by G. Ploski to accept and approve the Change of Use Application from Jay Calderaro, 2-4 Summit Road for a second residential apartment to be located on the second floor of 4 Summit Road in Units 4E & 4F. Unanimous. Chairman Pomeroy directed Mrs. Calderaro to promptly secure the required Building Inspector and Fire Marshal Approvals.

c. Tanya Rodriguez & Concetta Hernandez, 2-4 Summit Road - Special Permit Application for a child daycare center. Tanya Rodriguez and Concetta Hernandez appeared and presented the commission with a special permit application to operate a child daycare center. Mrs. Rodriguez stated that the daycare center will be located in units 4A, 4J & 4K all on the first floor of 4 Summit Road. Mrs. Rodriguez provided a site plan which included an outdoor play area for the children. Mrs. Rodriguez stated that she and her sister will be the only employees and will have a maximum of 16 children ages three and up. Jay Calderaro, 25 Cortland Drive, Huntington, CT appeared and stated that she is the owner of the property and authorizes Mrs. Rodriguez and Mrs. Hernandez to proceed forward with this special permit application. Bill Donovan asked the applicants to provide the commission with a copy of the State Statute for child daycare centers in Connecticut. Motion by A. Havican, seconded by A. Delelle to accept the Special Permit Application for a child daycare center from Tanya Rodriguez & Concetta Hernandez at 2 - 4 Summit Road. Unanimous. The commission discussed with the applicants the need for the applicants to provide a more detailed site plan. Motion by A. Havican, seconded by G. Ploski to set a public hearing for September 1, 2010 at 7:10 p.m. for the Special Permit Application for a child daycare center from Tanya Rodriguez & Concetta Hernandez at 2 - 4 Summit Road. Unanimous.

d. Prospect Estates Subdivision, Saddle Court - set date for hearing to call subdivision bond in order to complete installation of buried water tank. No action taken: see Correspondence on page 1.

Land Use Inspector’s Report:
Bill reported that the Office of Policy and Management set an effective date of July 23, 2010 for the recently approved interim change from the “Rural Lands” designation of 157 and 175 Waterbury Road (Rte. 69) to “Growth Area” on the State’s locational guide map. Bill also reported that Prospect’s Water Pollution Control Authority lifted their sewer moratorium effective July 23, 2010 and with these two actions, the Villa Rosa project can go forward with submitting their application to the WPCA. Bill stated that Dave Carson, the engineer for Villa Rosa continues to work with the State Traffic Commission on this project. Motion by G. Ploski, seconded by A. Havican to accept the Land Use Inspector’s Report. Unanimous.
