Chairman Pomeroy called the meeting to order at 7:00 p.m. The meeting was taped.

Chairman Pomeroy seated G. Graveline for A. Havican.

Motion by A. Delelle, seconded by G. Ploski to approve the April 21, 2010 minutes. Unanimous.

Correspondence: None

Public Participation:
Donald Holden, 26 Elaine Court - Discussed Land Use Inspector Bill Donovan’s 4/19/10 violation letter regarding his keeping four antique fire engines in his backyard.

Public Hearings:
7:10 p.m. Lombard Group, 39-41 Waterbury Road - Site Plan Application for reconstruction of 12 residential units & demolition of existing 19 units. The Chairman read a letter dated 4/9/10 from Prospect’s Fire Marshal Keith C. Griffin which stated that he has reviewed the preliminary plans for the proposed apartments at 39A Waterbury Road and that the driveway appears to be adequate for emergency vehicles to operate. The applicant, John Lombard of the Lombard Group, 20 East Main Street, Suite 300, Waterbury appeared before the commission. Mr. Lombard stated that he attended the last Inland Wetlands Commission meeting and that the Inland Wetlands Commission concluded that there are no wetland soils on this property. Mr. Lombard stated that if approved, he plans to move forward with this project as quickly as possible. Mr. Lombard further stated that he plans to install underground electric and remove as many of the telephone poles as he can. G. Graveline asked if the plan calls for each unit to have one parking space in the garage and one space on the driveway outside of the unit and Mr. Lombard stated yes. G. Ploski stated concern about the lack of delineation of a 15’ emergency access way on the site plan, concrete patios infringing into the 25’ right sideline setback, and the increase in the overall “footprint” and cubic volume of the proposed buildings. Chairman Pomeroy continued the public hearing to May 19, 2010 at 7:30 p.m. Mr. Lombard agreed to grant an extension of time on the public hearing. Bill Scarpati, Prospect’s Building Inspector, appeared before the commission and stated that he is strongly in favor of this application. Keith Griffin, Prospect’s Fire Marshal, appeared before the commission and stated that he is concerned about the fire safety of the property’s current condition and strongly recommended that the commission approve this application.

Land Use Inspector’s Report:
Bill reported to the commission that he has received complaints about a retail farm stand being run on 176 Porter Hill Road. Bill stated that while the property owners do have a special permit for commercial greenhouses, the special permit prohibits retail sales on the property and therefore he will send out a Cease & Desist letter. Chairman Pomeroy asked Bill to follow up on the ongoing violation of commercial tree cutting trucks parked on Plank Road. Motion by A. Delelle, seconded by G. Graveline to accept the Land Use Inspector’s Report. Unanimous.

Public Participation: None

The commission held general discussion on whether the storage of registered antique fire trucks on residential property is a customary accessory use of a property.
