Chairman Pomeroy called the meeting to order at 7:00 p.m. The meeting was taped.

Chairman Pomeroy seated K. Clifford for A. Havican.

Motion by A. Delelle, seconded by K. Clifford to approve the June 2, 2010 minutes. Unanimous.

Correspondence:
1. Letter dated 6/7/10 from Alberto Mimo, Chairperson, Prospect Conservation Commission re: review and access to any new development proposals or land changes.
2. Copy of letter dated June 4, 2010 from David A. Sawicki, Acting Executive Director, State Traffic Commission to James G. Bubaris, Bubaris Traffic Associates re: Villa Rosa Banquet Facility.

The commission briefly discussed Mr. Mimo’s letter and determined that they will need to have further discussion on this matter.

Motion by G. Ploski, seconded by J. Crumb to accept the correspondence. Unanimous.

Public Participation:
Chairman Pomeroy asked the public for comments and stated that while public comments are strongly encouraged, the commission will only dedicate 10 minutes to any one subject. No public comment.

Old Business:
a. TSC Properties, 170 Scott Road - Set effective dates for approved change of Zone Designation from Residential (RA-1) to Commerce Park District (CP) and Text Amendment to Zoning Regulations Section 3.8 Commerce Park District. Motion by A. Delelle, seconded by G. Ploski to set an effective date of July 12, 2010 for the Change of Zone Designation of 170 Scott Road from Residential 1 Acre (RA-1) to Commerce Park District (CP) approved June 2, 2010. Unanimous. Motion by A. Delelle, seconded by G. Ploski to set an effective date of July 12, 2010 for a text amendment to Zoning Regulations Section 3.1 Uses by District allowing General Contractors, Service and Equipment by Special Permit within a Commerce Park District approved June 2, 2010. Unanimous.

New Business:
a. Baki Belica, Baki’s Pizza Restaurant, 105 Waterbury Road - Expansion for Lounge. Chairman Pomeroy read an authorization letter from the property’s owner, Marcel Veronneau, President of LSJ Realty, for the record. Joe Testa appeared on behalf of the applicant and submitted a Change of Use Application, a site plan detailing parking spaces, and a design layout of the proposed waiting lounge area. Motion by J. Crumb, seconded by G. Ploski to accept the Change of Use Application from Bashkim Belica requesting to expand Baki’s Pizza Restaurant to add a restaurant lounge to replace the existent adjacent hair salon located at 105 Waterbury Road. Unanimous. Mr. Testa stated that Mr. Belica is requesting to expand Baki’s Pizza Restaurant to add a restaurant lounge where the existent adjacent hair salon is located at 105 Waterbury Road. Mr. Testa stated that the lounge area will have seating for 17 patrons, will have two new handicapped accessible bathrooms, and, has already been approved by the Chesprocott Health District. Mr. Testa stated that in addition to beer, wine, and “hard liquor”, some food will be served in the lounge. The commission discussed Mr. Belica’s existing permit and by consensus agreed that the sale of “hard liquor” falls within the same realm as the sale of wine and beer. Motion by A. Delelle, seconded by G. Ploski to approve the Change of Use Application from Bashkim Belica requesting to expand Baki’s Pizza Restaurant to add a restaurant lounge replacing the existent adjacent hair salon located at 105 Waterbury Road. Unanimous.

Public Hearings:
7:10 p.m. Christopher & Whitney Caporaso, 176 Straitsville Road - Proposed amendments to Approved Special Permit for Commercial Greenhouses in a Residential Zone (continued from 6/2/10). Chairman Pomeroy read a letter into the record dated June 8, 2010 from Christopher Caporaso authorizing the commission to extend his public hearing for an additional 35 days. A site walk was scheduled for Tuesday, June 22, 2010 at 4:30 p.m. and a rain date for the site walk on Wednesday, June 23, 2010 at 4:30 p.m. Chairman Pomeroy asked the public for comments. With none, Chairman Pomeroy continued this public hearing until July 7, 2010 at 7:30 p.m.

Land Use Inspector’s Report:
Bill reported that the canvas hut at 28 Scott Road is now down. Bill stated that only one antique fire truck remains on the Elaine Court property recently discussed by the commission. Bill stated he will be following up on this matter as the remaining truck needs to be moved as it is not a customary use on residential property. Bill reported that he has received complaints about constant noise coming from running an antique car restoration business out of 179 Straitsville Road. Bill stated that he has spoken with the owner who states that he is not running a business and that restoring antique cars is just his hobby. After discussion, it was the commission’s general consensus, that unless there is proof of a business being run on the property, i.e. work order receipts, this type of matter is outside of their authority. Bill stated that Andy Adames, the owner of the Senor Panchos restaurant, contacted him about being allowed to occasionally put up a temporary tent near the restaurant’s existing patio for outdoor events. After discussion, the commission informed Bill that Mr. Adames would need to come before this commission if he wants to pursue this matter. The Chairman also asked Bill to follow up with Mr. Adames about the protective silt fencing that has been downed on the Senor Panchos’ property. J. Crumb asked Bill to look into the commercial truck being stored at 12 Straitsville Road. Motion by G. Ploski, seconded by J. Crumb to accept the Land Use Inspector’s Report. Unanimous.
