Vice-Chairman Delelle called the meeting to order at 7:00 p.m. The meeting was taped.

Motion by A. Havican, seconded by G. Ploski to approve the October 6, 2010 minutes. Unanimous.
Correspondence: None
Public Participation:
Vice-Chairman Delelle asked the public for comments and stated that while public comments are strongly encouraged, the commission will only dedicate 10 minutes to any one subject. Shawn Baumann, 10 Juggernaut Road appeared to continue her discussion with the commission at the last meeting. Mrs. Baumann stated that she plans to hold future events on her property similar to the one she held recently and that her interpretation of the zoning regulations do not require her to obtain the Planning & Zoning Commission's approval in order to hold such events. G. Ploski referred Mrs. Baumann to Section 4.7 Agricultural Uses of the zoning regulations, specifically Section 4.7.9 on Page 109, which directs the commission to respond to public complaints and further states "Any change in the proposed activity such as an increase in the number of animals must be approved by the Commission".
Hearing:
7:10 p.m. Country Hills Estates, 80 Cook Road - Hearing to call the bond on the Country Hill
Estates Subdivision. No action taken.

Old Business:
a. Tammy Paolino, 10 Barry Lane - drainage issue. Ms. Paolino appeared regarding the drainage problems on her property at 10 Barry Lane which she spoke to the commission about at their last few meetings. J. Crumb stated that he inspected the area after the last meeting and believes that the majority of the water flowing onto 10 Barry Lane is originating from 91 Waterbury Rd. (Big Dipper) flowing onto 93 Waterbury Rd. (Prospect Vet) and then onto 10 Barry Lane. J. Crumb stated that while he believes this issue is a civil matter between neighbors, he will continue to try and get all of the parties together to try to come to a reasonable resolution. After commission discussion, Vice Chairman Delelle requested J. Crumb give the commission an update at the next meeting.
b. Senor Panchos, 280 Cheshire Road - discussion on outdoor events. No action taken.
New Business:
a. Michael Marino & Donna Thompson, 22 Chandler Drive — Home Occupation Application: Landscaping Business. Michael Marino appeared and presented the commission with a home occupation application for a landscaping business. Motion by A. Havican, seconded by G. Ploski to accept the application from Michael Marino, 22 Chandler Drive for a Home Occupation: Landscaping. Unanimous. He stated that he does not have any commercial lettered equipment only a lawnmower, leaf blower, and a weed whacker, all which are kept inside his garage. He further stated that he drives a pickup truck and does not have any commercial vehicles and that he will not have any outdoor storage or signage. The commission discussed their option to require a public hearing and agreed that because there would not be any signs, customers, or traffic created by the home occupation, they did not feel a public hearing was necessary. Motion by G. Ploski, seconded by J. Crumb to approve the Home Occupation Application submitted by Michael Marino, 22 Chandler Drive for a Home Occupation: Landscaping. Unanimous.
Land Use Inspector's Report:
Upon report from Land Use Inspector Bill Donovan, the Land Use Clerk presented the following to the commission:
1) 2-4 Summit Road - Bill received updates from Fire Marshal Keith Griffin & Building Inspector Bill Scarpati indicating that progress is being made on the required work and that the stairs, platform and new 2nd floor exit have been completed.
2) 170 Scott Road — Bill believes that the commercial business equipment being stored on this property violates the regulations as no permit for the commercial use of this property has been granted by the Planning & Zoning Commission. After discussion, the commission concurred with Bill that this property is currently in violation of the zoning regulations and that the property owner needs to submit the appropriate application with a detailed site plan.
3) 50 Waterbury Road - The Land Use Office has received complaints about the boat "for sale" located in the front parking lot of the commercial plaza. As the boat is owned by the plaza owner, Bill is inquiring if the commission views this as a zoning violation. After discussion, the commission did not believe this to be a zoning violation. Motion by A. Havican, seconded by G. Ploski to accept the Land Use Inspector's Report. Unanimous.
