Vice-Chairman Delelle called the meeting to order at 7:00 p.m. The meeting was taped.

Vice-Chairman Delelle seated D. Santoro for D. Pomeroy.
Motion by A. Havican, seconded by G. Ploski to approve the September 15, 2010 minutes. Unanimous.

Public Participation:
Vice-Chairman Delelle asked the public for comments and stated that while public comments are strongly encouraged, the commission will only dedicate 10 minutes to any one subject. Shawn Baumann, 10 Juggernaut Road appeared hi response to Land Use Inspector Bill Donovan's letter to her dated 10/4/10 about a rodeo-type event which took place on her property on 10/3/10. Mrs. Baumann stated that it was not a rodeo but a party for her daughter who had invited 15 of her friends who also brought their horses. Mrs. Baumann stated that upon receiving a complaint from a neighbor she turned down the music which had been playing earlier in the morning. Land Use Inspector Bill Donovan stated that this type of activity is an expansion over her current livestock permit. Mrs. Baumann stated that she was unaware that a separate permit would be needed for this type of event and stated that she would come before the Planning & Zoning Commission if she wanted to hold this type of event in the future.

Old Business:
a. Tammy Paolino, 10 Barry Lane - drainage issue. Ms. Paolino appeared and briefly recapped the drainage problems on her property at 10 Barry Lane which she spoke to the commission about at their last meeting. Rich Gruszka, D.V.M., owner of 93 Waterbury Road, appeared and explained his position on the drainage situation briefly detailing the history of past work that has been done on his property and he also explained the repair and expansion of a rip rap water spreader completed in the Spring of 2010 hi order to improve downstream water dispersal. Mr. Gruszka also stated that at the time that the rip rap water spreader was repaired/expanded, he offered to have Ms. Paolino's trench dug out but she declined his offer. For the record Vice Chairman Delelle read a letter dated 12/11/95 from James Moody, Chairman, Prospect Planning & Zoning Commission, to Richard Gruszka, D.V.M, 93 Waterbury Road. The commission reviewed the site plan for 93 Waterbury Road dated 6/19/90 and the Town Drainage Plan of Barry Lane dated 5/18/10. Mayor Robert Chatfield appeared and outlined the work that the Town has done to try to improve the drainage situation in the area and also stated that this is a civil matter not a Department of Transportation of Town issue. After discussion between all parties, a meeting was scheduled to take place in the area where the drainage issue is occuring which will include Mayor Chatfield, Land Use Inspector Bill Donovan, Planning and Zoning Commission member Jack Crumb, Ms. Paolino, Mr. Gruszka and other neighboring property owners. Vice Chairman Delelle requested that this matter be carried over to the next Planning and Zoning Commission meeting.
b. Senor Panchos, 280 Cheshire Road - discussion on outdoor events. No action taken.
New Business
a. Country Hills Estates, 80 Cook Road - Set hearing to call the bond. At the request of the Town's attorney and after commission discussion, motion made by D. Santoro, second by G. Ploski to set a hearing for October 20, 2010 at 7:10 p.m. to call the bond on the Country Hill Estates Subdivision. Unanimous.
Land Use Inspector's Report:
Bill reported that Greg Zupkus of BNE Energy has submitted a proposal to the Town of Prospect for two wind turbines generators to be built on 178 New Haven Road. Bill stated that Mayor Chatfield will hold a town meeting at the fire house within the next few weeks for residents in which to hear a presentation by BNE Energy and to ask any questions that they may have on the project. Bill stated that the State of Connecticut Siting Council will also hold a public meeting in the near future to answer questions and obtain feedback from the Town and its residents. Bill reported that his office has finalized drafting proposed revisions to the Town's Floodplain and Flood Hazard Areas Regulations as required by FEMA in order for Prospect to remain eligible to participate in the National Flood Insurance Program. After commission discussion, motion by A Havican, seconded by G. Ploski to set a public hearing for November 3, 2010 at 7:10 on proposed amendments and additions to Zoning Regulations Section 4.13 Floodplains and Flood Hazard Areas; Article 2.2 Definitions; Article 15 Zoning Board of Appeals; and Subdivision Regulations Sectionr IV General Regulations. Unanimous. Motion by G. Ploski, seconded by A. Havican to accept the Land Use Inspector's Report. Unanimous.
Public Participation:
Tom Satkunas, New Haven Road stated concern over possible noise which may be generated from the proposed wind turbines to be built on 178 New Haven Road.
