Chairman Pomeroy called the meeting to order at 7:00 p.m. The meeting was taped.

Motion by A. Havican, seconded by A. Delelle to approve the August 18, 2010 minutes. Unanimous.
Correspondence:
1. State of Connecticut Department of Transportation letter dated 8/19/10 to Giuseppe & Rosa Geloso re: Villa Rosa Banquet Facility, Waterbury Road.
Motion by A. Delelle, seconded by A. Havican to accept the correspondence. Unanimous.
Public Participation:
Chairman Pomeroy asked the public for comments and stated that while public comments are strongly encouraged, the commission will only dedicate 10 minutes to any one subject. Fire Marshal Keith Griffin came before the commission to give them an update on Jay Calderaro, 25 Courtland Dr., Huntington, CT and her application for a second residential apartment on the second floor of 4 Summit Road which was approved by the Planning & Zoning Commission during their 8/4/10 meeting. Mr. Griffin reported mat since the 8/4/10 meeting Mrs. Calderaro has not complied with any of his or Building Inspector Bill Scarpati's requests to bring the apartment up to meet the State of Connecticut Fire and Building Codes as she had agreed to do so at the 8/4/10 meeting. Chairman Pomeroy read the minutes from the 8/4/10 meeting for the record that includes the Chairman's directive to Mrs. Calderaro to promptly secure the required Building Inspector and Fire Marshal approvals. After commission discussion, Mr. Griffin stated that he would contact Judy Dicine, Supervisory Assistant State's Attorney at the Waterbury Housing Court to notify her of this situation. Mr. Griffin also stated that he would provide the Planning & Zoning Commission with a formal written communication outlining this matter. The commission instructed Bill Donovan, upon receipt of the Fire Marshal's letter, to write to the applicant and advise her that her Planning & Zoning Commission approval for the second residential apartment is in jeopardy due to her failure to follow up with the Fire Marshal and Building Inspector as she was instructed to do so by the Planning & Zoning Commission as a condition of said approval. Bill stated that he would also send a copy of this communication to the tenant currently residing the apartment. Chairman Pomeroy asked Mr. Griffin to give the commission an update on this matter at the next meeting.

Public Hearing:
7:10 p.m. Tanya Rodriguez & Concetta Hernandez, 2 - 4 Summit Road - Special Permit Application for a child daycare center. Chairman Pomeroy read into record the "Notice of Public Hearing" for the public hearing as it appeared in the Republican- American on August 20 & August 27th, 2010. The applicants did not appear. The commission held general discussion on the application which included their safely concerns due to the proposed daycare building already having current fire code & building code violations in the residential apartment located on the second floor above the proposed daycare. Bill Donovan stated that the commission has the right to impose certain conditions to satisfy their safety concerns. G. Graveline asked what section of the regulations state that two primary uses are allowed on one property. G. Ploski stated that only residential zoned properties are limited to one primary use. J. Crumb stated that ultimately the applicants cannot get their State of Connecticut license to run a child daycare until the Fire Marshal signs off. Motion by G. Ploski to close the public hearing on Tanya Rodriguez & Concetta Hernandez, 2-4 Summit Road - Special Permit Application for a child daycare center. No second, motion fails to carry. The Chairman asked for comments from the public. With none, the public hearing was continued until September 15, 2010 at 7:10 p.m.
Land Use Inspector's Report:
Bill advised the commission that the State of Connecticut Department of Environmental Protection is requiring that Connecticut towns update their Flood Plain & Flood Hazard Regulations to comply with State of Connecticut standards. Bill stated that he is gathering information to draft the proposed changes and that a public hearing will likely be held sometime in October or November. Bill also reported that he has received numerous complaints about the recent blasting by Toll Brothers in the Regency at Prospect project. Bill stated that he met with Dan Walton, Assistant Vice President of Toll Brothers who stated that Toll Brothers has set up seismograph machines to monitor the blasts and that charges of the blasts will be cut down to try to reduce the vibrations. The commission asked Bill to look into trailers, boats, and heavy equipment that have been popping up in residential neighborhoods around town. Motion by A. Havican, seconded by G. Ploski to accept the Land Use Inspector's Report. Unanimous.
