Chairman Erickson called the meeting to order at 7:10 p.m.
Approval of Resolution for Toll Brothers to Commerce Flow: Att. Knott passes out the proposed resolution. He continues to say that he has received the original approval letter from Lynn McHale and passes out an email from Maurice Fortier saying that the approval letter looks fine and requests a letter be sent from the Prospect WPCA telling the Waterbury WPC who the official contact is from Prospect and that persons phone number with any problems with the Regency at Prospect and Pond Place. Atty. Knott asks Chairman Perugini-Erickson to send them a letter. He continues to tell the board that he has received a photocopy of both the Subordination Agreement and the Warranty Deed that were filed in the Prospect land records as well as the Original Title Insurance Endorsement with the Certificate of Title. Att. Knott then passes out a Certificate of General Partners which names all officers that are authorized to sign for Toll Brothers Inc. He affirms to Chairman Perugini-Erickson that the Deed of Easement is properly signed. Lastly he reads the resolution dated 3/31/08 to the board "Be It Resolved: Having received the certified and stamped as built drawings from Toll Brothers Inc. for the easement area and Phase 1 of "Prospect Commons", and the Town Engineer, Scott Poryanda, having advised the authority that those documents show that the construction of the sewers meets the approved plans, and further all other preconditions as required by the Waterbury/Prospect Inter Municipal Sewer Agreement. Amendment No. 1 and the Owners and Developer's Agreement Sewer Service, having been met. The WPCA hereby authorizes the Prospect Building Official to grant Certificates of Occupancy as appropriate for all units in Phase 1 only. This authority is granted subject to the requirements of Paragraph 24 of the Owner's and Developer's Agreement and Section C-4 of the Waterbury Prospect Agreement">
Scott Poryanda states that they did revise the plans to reflect the changes and they do have as-builts. The first line started was replaced up to a half a percent. He spoke with Gene McCarthy the other long line in front of units 59 and 60 was removed and raised and is not at four tenths of a percent and was completed Friday. The first closing on unit 60 was at 4:00 today and everything seemed to be a go. Chairman Perugini-Erickson questions if Bill Scarpati did issue the Certificate of Occupancy S. Poryanda was unsure but things he must have. S. Poryanda continues to say that he did speak with Dan Rossi and asked for a set of plans for Phase 2 so that if there are any changes that need to be made they can be made so that this does not happen again. Motion by D. Brown to pass the resolution as prepared by John Knott to grant the Certificate of Occupancy for phase one seconded by D. Wartko, Unanimous. Chairman Perugini-Erickson asks Bill Donovan is he would be able to give a copy of the resolution to Bill Scarpati.
