Chairman Erickson called the meeting to order at 6:04 pm.

Motion by C. Graveline, seconded by D. Brown, to accept minutes from regular meeting on June 27, 2006. Unanimous.

Old Business:
Toll Brothers: Arty. Knott stated that a public hearing is required by law before a municipa sewer system can be installed. The public hearing for the proposed sewer system within the Tol Brothers development will require that the property owner, R.M.K. Prospect Associates, b( named in the public notice. Immediately following the public hearing the WPC A will meet wit! the Town Council to establish the necessary resolutions for the Town to enter into a developer; agreement with Toll Brothers and to amend the intermunicipal agreement with the City o Waterbury. Attorney Knott has discussed the proposed sewer connection with Lynn McHale Acting General Manager, Waterbury Water Pollution Control. The Waterbury Water Pollutioi Control has requested to interact with the Town of Prospect directly rather than dealing witl private property owners. Arty. Knott recommended that the existing intermunicipal agreemen with the City of Waterbury be amended to include the Toll Brothers development. Atty. Knot has drafted the developers agreement and is working with Toll Brothers, Atty. Fitzpatrick t( develop an agreement that satisfies all parties. Attorney Knott is recommending that Toll Brothers establish a twenty foot wide easement for the sewer line to be owned by the Town o Prospect. The sewer facilities within the easement would include the proposed flow meter Attorney Knott stated that because the proposed sewer system will be a public sewer system thi State Statutes dictate required procedures. Along with owning the sewer system the Town o Prospect will be responsible to maintain and repair the sewer system. In the developer agreement it will state that Toll Brothers will be responsible for any required maintenance o repairs for a period of five years. Prospect WPCA will establish sewer use charges based 01 Waterbury's rates plus reasonable fees to establish a capital fund for repair and maintenance.

It is critical that Prospect establish a Town Sewer Plan to establish control over any sewei facilities that may be proposed in the future. The Waterbury Board of Aldermen will address the proposed amendment to the intermunicipal agreement at their August 7, 2006 meeting Tentatively, Waterbury will schedule a public hearing for August 21, 2006 to address the amendment. Prospect Town Council could then vote at their August 22, 2006 meeting to go tc public hearing for the establishment of a public sewer system within the Toll Brothers development. The Prospect public hearing could then be scheduled for September 5, 2006. Motion by C. Graveline, seconded by D. Brown pursuant to Section 7-247a of the Connection General Statutes, Prospect WPC A will hold a joint public hearing for the purpose of authorizing the construction of a sanitary sewage system by Toll Brothers, Inc. on property owned by R.M.K. Prospect Associates, LLC to be connected to the City of Waterbury public sewage system, which sanitary sewage system is to be located in the Town of Prospect and the City of Waterbury, as shown on maps and plans on file in the Mayor's office, and which sewer systerr will serve the Prospect Commons Elderly Housing Development to be constructed on said property, which development was approved by the Town of Prospect Planning and Zoning Commission at its meeting on May 3, 2006. The public hearing will be at a time and place as established by the Town Council.

Boulder Brook Agreement: Atty. Casagrande is working with Atty. Fitzpatrick to establish a final draft of the TESCO developers agreement. Upon completion of the agreement it may be necessary for WPC A to hold a special meeting to authorize the Town to enter into the agreemenl with TESCO. Sewer Use Ordinance: The Sewer Use Ordinance needs to go to public hearing to make it official.

New Business: Town Sewer Plan: C. Erickson suggested having Chesprocott and possibly Connection Department of Environmental Protection attend a WPC A meeting to discuss the establishment oi a Town Sewer Plan. Atty. Knott recommended seeking the consulting services of Metcalf & Eddy to draft a sewer plan.

Motion by C. Graveline, seconded by D. Brown, to adjourn the meeting at 7:10 pm Unanimous.
