Zoning Board of Appeals

November 28, 2000

Chairman Dominic Moschella called the Prospect Zoning Board of Appeals meeting to order at 7:01 p.m. Members present: Dominic Moschella, Martin Atkins, Carl Graveline; Alternates Donato Orsini and Maryann Anderson. Absent: Harold Bernier and Betty Lou Holley. Chairman Moschella seated Donato Orsini for Betty Lou Holley.

CORRESPONDENCE: Letter from Mayor Chatfield re: ZBA Budget; Letter from Town Clerk, Patricia Valliancourt re: 2001 meeting dates; Planning & Zoning minutes of 10-18 & 11-1. MOTION made Carl Graveline, seconded by Martin Atkins to place correspondence on file. Motion Unanimous

Motion made by Carl Graveline seconded by Donato Orsini to approve minutes of October 24, 2000. Motion Unanimous

OLD BUSINESS: none

New Business:

Motion made by Martin Atkins, seconded by Carl Graveline to schedule Zoning Board of Appeals meetings for 2001 the 4th Tuesday of every month at 7 p.m. with the exception of December 25, 2001. Motion Unanimous

Motion made by Carl Graveline, seconded by Martin Atkins to cancel the December 26, 2000 meeting since it is a legal holiday and the Town Hall will be closed, if necessary board may call a Special Meeting for December. Motion Unanimous

2001 Zoning Board of Appeals budget discussed: Possible increase in clerks salary; Martin Atkins questioned surplus - goes into the General Fund. Motion made by Martin Atkins, seconded by Carl Graveline to request a 5% increase in the clerks salary which would be $1385 a year. Martin Atkins questioned $250 in training materials. Motion Unanimous.

7:17 p.m. PUBLIC HEARING: ZBA Application 14-2000 of Herbert Corbett, legal Notice published in the Republican-American Nov. 14 & Nov. 23 read into the minutes. Mr. Corbett reviewed request for garage in backyard, property is pie shaped. Reviewed driveway & location of house and well. No questions or comments from the board members. No one spoke in favor or opposition. Public Hearing closed at 7:20 p.m.

Motion made by Martin Atkins, seconded by Donato Orsini to approve ZBA Application 14-2000 of Herbert Corbett, property located at 125 Summit Road, a 10 foot left side line and a 3 foot right side line variance for construction of a 26X30 garage. Hardship being configuration of lot and location of well and septic. Motion Unanimous.

Members discussed denial of ZBA Application 11-2000, Herwood Cochran, 14 Cook Road, compared it to other approvals. Carl felt it was a minimal variance and compared it to other variances the board has given in the past. Discussed what wasn't an extreme request, felt it was a minimal variance request also. Dominic Moschella felt that the principle of going from a conforming lot to 2 non-conforming lots. Also felt it would be blatanly going against regulations.

Motion made by Carl Graveline, seconded by Martin Atkins to adjourn. Meeting adjourned at 7:40 p.m.
